| ID | Document | Page Number | Section Title | Paragraph Number | Quoter's Questions | Government Response | |
| SN.01 | RFQ | Section II | Section II. MSPV Business Process B. Pricing: It states that the PVs will use the exact price [the BPA established price] plus a distribution fee agreed upon between the PV and VA – In the MSPV Prime Vendor solicitation (36C10G19R0022) Statement of Work, Section 1 Scope B.1.e. says the distribution fee will be capped at 5% - can we expect that cap will apply? | This question is not applicable to this Supply RFQ. | |||
| SN.02 | RFQ | Some products cross multiple solicitation categories as defined by the VA, can we offer products under multiple solicitations? For example, IV sets are requested in the needles and syringe solicitation, but there is a separate solicitation for IV & Irrigation Supplies. Because the solicitation responses are not necessarily released at the same time, we want to ensure the VA has coverage for these items. | Yes items can be quoted under multiple solicitations for which the items falls in the scope of the RFQ's category description (see Attachment B, Historical data tab) that they are authorized to sell by the OEM. Note that a item will only receive a BPA for only one category. | ||||
| SN.03 | RFQ | 11 | Section III. Work Requirements | C. | With the non-manufacturer blanket waiver and this additional Section III Work requirements language, C. Trade Agreement Act Requirements (applicable to Large Business), the use of "applicable to Large Business" opens a contracting loop hole for non-TAA approved items to be funneled through Small Business Suppliers. Is the government's intent to use Small Business Suppliers to purchase Non-TAA products with or without a product waiver? If not, the “applicable to Large Business” should be removed and TAA requirements need to apply to "all" suppliers equally. | Please see the additional guidance in the Addendum to FAR 52.212-1, instructions to quoters where it defines what clauses/provisions are relevant with the tiers. | |
| SN.04 | RFQ | What are the requirements for price changes? The solicitation does not provide direction? | Please see the Section II.C.3 Pricing Changes in the RFQ.2 | ||||
| SN.05 | RFQ | Protest Clauses | The solicitation has two service of protest clauses; which clause supersedes in this solicitation? FAR 52.233.2 or VAAR 852.233-71? | The VAAR is a supplement to the FAR. | |||
| SN.06 | RFQ | For products with existing TAA waivers, what is the MSPV 2.0 supplier submission requirements, review and approval process to accept the existing waivers? | The submission process isn't different, just include documentation of the existing waivers. | ||||
| SN.07 | RFQ | I am writing in regards to insulin syringes as part of the Medical / Surgical Prime Vendor Program (MSPV) 2.0 Syringes and Needles solicitation (36C24C19Q0034) posted June 20, 2019. Becton Dickinson (BD) was awarded a national contract for Insulin Syringes by the VA National Acquisition Center on April 23, 2018 (36E79718C00018). This award was for all Department of Veterans Affairs facilities, Department of Defense (DoD), Indian Health Services (IHS), Bureau of Prison (BoP) and Federal Healthcare Centers (FHCC). Therefore, it is our understanding that participating agencies should not be ordering from any other source than BD. We encountered this same issue under MSPV-NG where the SAC awarded contracts for competitive insulin syringes. We contacted our NAC CO, Diana Martinez, who confirmed our exclusive contract position under this national agreement. As a result, the SAC removed all competitive products from the MSPV-NG. I have copied Ms. Martinez for her visibility and any guidance she might have. In summary, we are requesting that all non-BD insulin syringes be removed from solicitation under MSPV 2.0 in accordance with our national award. We look forward to participating in the solicitation. In the meantime, please acknowledge receipt of this message and let us know if you have any questions or comments. 6/25/2019 | The subject matter experts will review and consider. VHA has used clinical subject matter experts that will make final determination of items deemed within scope for a category. However, items standardized by the Pharmacy PV program will not be considered for the MSPV 2.0 program. All patient safety concerns will be considered at the time of technical evaluation. | ||||
| SN.08 | RFQ | Section 4 | In consideration of section 4 on page 6, which excludes supplies already covered under the AbilityOne Procurement List from this solicitation, do organizations that currently sell products on the Procurement List through the AbilityOne program need to respond to this solicitation with products on the Procurement List in order to supply those products through MSPV 2.0? | No, AbilityOne vendors may bid non-Procurement List items. VHA will not consider items currently awarded on the AbilityOne Procurement List. VHA is in collaboration with the AbilityOne Commission, VA Office of General Counsel and the VA Office of Small & Disadvantaged Business Utilization to analyze the market to develop a strategy to apply rule of two. AbilityOne vendors are welcome to propose items not currently on the Procurement List that are believed to be within scope of any category. | |||
| SN.09 | Quote Sheet | When I copied the Cook part numbers from column b on the SN Historical Tab onto Column E on proposed supplies column b is indicating that the products are not from the historical data tab. a. | Is there a way to remedy this? | The error on the Syringes and Needles Quote Sheet has been corrected in the latest version of the Syringes and Needles Attachment B posted as an amendment. | |||
| SN.10 | Quote Sheet | Column’s H, J, L, N, O, P, Q, R, are only modifiable by drop down selection – Is there a way you could enable the file to have copy and/or paste functionality? The VA’s purchase over 1,000 line items of high use line items alone. This would help us respond to you quicker. | The columns have fixed lists to provide standardization to quote submissions. Additionally the file has built in macro validations that will alert and assist the user when they incorrectly enter data. These validation components of the Quoted Sheet will minimize the need to have quotes resubmitted with corrections. Per the Overview & Instructions tab, it is recommended that you copy & paste you quotes as 'values' into the Quoted Supplies tab. | ||||
| SN.11 | Quote Sheet | The data provided in this file identifies ~$660K in spend for the category of needles across several specialties. There is ~$1.1M in additional “needle” spend not identified in the historical data tab. Do I add the products to this file or is another needle solicitation forthcoming? Is there a way I could indicate product spend for the benefit of your team? | The Historical data provided are for reference purposes only and should be seen as estimates. Quoters are welcome to submit all supplies that falls in the scope of the RFQ's category description (see Attachment B, Historical data tab) that they are authorized to sell by the OEM. Each item, should be entered as a new row on the Quoted Sheet tab in Attachment B. All quoted items require a Distribution Authorization Letter from the OEM, even if the quoter is a subsidiary of the company or the company is a subsidiary of the quoter's company. | ||||
| SN.12 | RFQ/Presolicitation | I am counting 15 category solicitations or pre-solicitations on FBO today. Will there be additional categories added? If so could you share what those categories will be? i. | I am seeing products that do not belong in some of the categories (not needles & syringes) just looking for additional information so I can help your colleagues appropriately categorize the items. | Yes, each RFQ is posted in FBO. VA shared the category list with industry during an earlier RFI. | |||
| SN.13 | Quote Sheet | When we populate the exact match item numbers into the SN Proposed Supplies tab, anything populated from the SN Historical Data tab below row 15 automatically defaults to a “No” response, even though the OEM number is an exact match. | The error on the Syringes and Needles Quote Sheet has been corrected in the latest version of the Syringes and Needles Attachment B posted as an amendment. | ||||
| SN.14 | Quote Sheet | Is the SAC asking for cross reference/cross match information? If so, where should that information be entered into the spreadsheet? If not, why is the SAC not requesting that information? | This question is not applicable to this Supply RFQ. | ||||
| SN.15 | Quote Sheet | If we are providing an alternate cross for a Non-Medline item, where do we have to add this information as Attachment B only gives us the OPion of entering the data for items already found on Tab 2 (Historical Data). There is no other columns provided where we can provide the information for the alternate OPion. Column E is only for OEM found on Tab 2 (exact match but not for alternate OPion) and it is the same on all the other files. | ||||
| SN.16 | Quote Sheet | On Attachment B for solicitation number 36C24C19Q0034 - Syringes and Needles - When we populate the exact match item numbers into the SN Proposed Supplies tab, anything populated from the SN Historical Data tab below row 15 automatically defaults to a “No” response, even though the OEM number is an exact match. | The error on the Syringes and Needles Quote Sheet has been corrected in the latest version of the Syringes and Needles Attachment B posted as an amendment. | ||||
| SN.17 | RFQ | Volume I - Technical | Volume I – Technical: Can you please provide further information or requirements needed for the Technical part? | Please see language in 52.212-2 | |||
| SN.18 | RFQ | Volume II - Price | Volume II – Price (Attachment B – Pricing and Product Document): This file is password protected and we are not able to edit it. Can you please assist? | The file has built in macro validations that will alert and assist the user when they incorrectly enter data. This will minimize the need to have quotes resubmitted with corrections. The Quote Sheet is password protected to ensure these validation measures are not accidently corrupted. This will not prevent the user from filling out all fields required. | |||
| SN.19 | RFQ | Volume III | Volume III - Solicitation, quote, & Award Documents, Representations & Certifications: Can you please clarify what is needed as Award Document, representations and certifications? | ||||
| Quote bid sheet, and completed Reps & Certs 52.212-3 | |||||||
| SN.20 | Quote Sheet | For all the subsidiary company of Medline, what should we enter in column D as the OEM Name on attachment B and what kind of documentation is required from Medline subsidiary? Will it be a letter of authorization? | The Historical data provided are for reference purposes only and should be seen as estimates. Quoters are welcome to submit all supplies that falls in the scope of the RFQ's category description (see Attachment B, Historical data tab) that they are authorized to sell by the OEM. Each item, should be entered as a new row on the Quoted Sheet tab in Attachment B. All quoted items require a Distribution Authorization Letter from the OEM, even if the quoter is a subsidiary of the company or the company is a subsidiary of the quoter's company. | ||||
| SN.21 | RFQ | The solicitation requires the supplier and prime vendor to enter into a “commercial agreement” within 30 days of award of a BPA. The solicitations further state VA is not a party to the commercial agreements. Once the prime vendor contracts are awarded, a supplier has no leverage in this negotiation. A supplier is at the mercy of the prime vendor as it relates to charges, penalties and fees, payment terms, insurance requirements and other terms and conditions a prime vendor chooses to impose. These concerns are not addressed within the solicitation. Will the VA put a maximum in place for awarded prime vendors in terms of fees? Also, how can any supplier offer VA a fair and reasonable price with no committed volume, unknown fees, charges and penalties? | 60 days. This has been corrected. It should read 60 days in the Pre-solicitation notice. The RFQ correctly states 60 days. | ||||
| SN.22 | Quote Sheet | In Attachment B Quote Sheet, Column J, OEM UOM Description and Column L, Smallest UOM Available for Facility Purchase, only contains 3 UOM description OPions and does not allow the field to be typed in. Therefore, we are unable to input our items’ correct UOM. | The error on the Syringes and Needles Quote Sheet has been corrected in the latest version of the Syringes and Needles Attachment B posted as an amendment. | ||||
| SN.23 | RFQ | Can FSS Letters of Supply be used in leu of Authorized Distributor letter if signed within the last 90 days? | No, the RFQ specifically request Authorized Distribution letters. | ||||
| SN.24 | RFQ | Will the VA allow substitutions? The solicitation does not address this question. Prime Vendors can potentially withhold orders from an SDVOSB supplier, tell VA a product is not available, offer VA a private branded label product that generates more profit to the prime vendor, and VA would believe the SDVOSB is at fault. This can occur unless the VA prohibits the delivery of private branded products as substitutes if they are note offered as part of the initial supplier solicitations and resulting BPAs. | This question is not applicable to this Supply RFQ. | ||||
| SN.25 | RFQ | E.1 52.212-1 INSTRUCTIONS TO QUOTERS—COMMERCIAL ITEMS (OCT 2018) | In section E.1 52.212-1 Instructions to Quoters – Commercial Items, there are three volumes required to be submitted. For Volume I – Technical, there are no instructions on what is to be included in this document. Since Product Literature is being addressed in Volume II – Price, should the Authorized Distributor Letter be in Volume I - Technical? | Please see language in 52.212-2 for Technical Requirements. |
Authorized Distribution Letter should be included in Volume III.
SN.26 RFQ We would like to submit a RFP on the solicitation referenced above, we are a small business. Would we able to submit a proposal without the 8(a) or hub zone? Please see 52.212-2 in the RFQ.
