About this file

This document appears to be a set of questions and answers related to a federal contract solicitation for home sleep study supplies and services. The key details are:

The solicitation is for a single-award IDIQ contract for home sleep study test (HST) supplies and services (Solicitation #36C24924Q0231). The government requires the contractor to provide home sleep study devices and supplies to veterans as identified by the VA Neurology service. All data from the devices will be interpreted by VA physicians, not the contractor. The NAICS code for this solicitation is 339112 (Surgical and Medical Instrument Manufacturing), although the agency acknowledges this may not fully capture the service component and plans to amend the solicitation. The agency currently uses the Somnoware software platform for HST and will provide access to the winning contractor. The requirement is to detect both obstructive and central sleep apnea. No sleep study interpretation services are required from the contractor.

QUESTION 1: Who is doing the interpretations of the sleep studies—our physicians or the VA physicians?

Said another way, is the final deliverable the sleep study interpretation or the raw data of the sleep study?

Answer: All data from watchpat device will be interpreted by only the VA and not the vendor that is providing the device.

Question 2: Why is the NAICS code 339112 Surgical and Medical Instrument Manufacturing being used for this for this Solicitation as this code does not contain the service elements this Solicitation requires?

The Title of the Project on page 5 is “Home Sleep Study Supplies and Service.” The scope of work indicated “the contractor provide by mail, to all the veterans identified by the Neurology service, items necessary to provide Home Sleep Study supplies and services…” Typically, this service is provided under code 621610 Home Health Care Service.

Answer: NAICS 339112 (Surgical and Medical Instrument Manufacturing) is the most appropriate NAICS for WatchPat device, based on our Market Research. An amendment will be posted after Q &A suspense has passed to address the service component as all data will be transferred to and interpreted by VA clinicians and not the distributor. I expect amendment to be posted early on May 14, 2024.

Question 3: Why is the language “all proposals sent in that are not from an authorized reseller will be disqualified” included on page 36? The equipment itself it not the product being sold to the VA—the service results in a sleep study report or sleep study data being provided to the VA as the final product.

Would a recent invoice showing the recent purchase of these devices be acceptable given manufacturers widely sell their products broadly for non-governmental use but limit official “authorization letters” for governmental use to limit competition?

Answer: The language on page 36 of the solicitation is to ensure all items are OEM items distributed through an authorized distributor and the supply chain of custody prevents the receipt of Grey Market

Items. This is in line with VAAR Clause 852.212-71/72 Gray Market Items and this clause will be added in the amendment to the solicitation post question suspense on 5/13/2024. This should help clarify the intent of maintaining supply chain integrity.

Question 4: What software is currently utilized for HST (ex. CloutPAT, Somnoware etc)

Answer: Somnoware

Question 5: Would the access be given to winning offeror to use the existing platform or do they have to initiate new service?

Answer: VHA will give access to the winning offeror.

Question 6: Is the interpreting of the results also required for this service?

Answer: No, the Neurologist will interpret the data.

Question 7: Requirement for HST, is it to detect OSA (Obstructive Sleep Apnea) or to detect CSA (Central Sleep Apnea)?

Answer: The requirement for HST is to detect OSA (Obstructive Sleep Apnea) and detect CSA (Central

Sleep Apnea)

Question 8: Is this solicitation for conducting the home sleep studies (raw data) or includes a report

(data & interp by a sleep physician)?

Answer: All data from watchpat device will be interpreted by only the VA and not the vendor that is providing the device.
