Answers to Questions
1. Which requirements of sentence number 1 of the following posted Statement of Work, "The Contractor shall provide all personnel, equipment, tools, materials, vehicles, supervision, and other items and services necessary to perform refuse services at the Memphis Veterans Affairs (VA) Medical Center”, does the Government consider to be the Primary and Vital requirements of this contract?
Answer: The Government uses the aforementioned italicized verbiage to instruct all potential quoters that the Government will not be providing any of those items or services. The Government does not place emphasis on any particular item or service, but rather each quoter should make their own business determination as to the importance of each item or service.
2. Will the government allow a large company to provide the primary and vital aspects of this contract as a subcontractor to a responding SDVOSB and still move forward with an award to that SDVOSB?
Answer: The Government will make an award determination based on evaluation of the lowest priced quotation that is determined to be technically acceptable based on the applicable technical factor of Technical Capability. The factor of Technical Capability requires the quoter to submit a capability statement describing their technical capability and ability to meet the requirements of the Statement of Work. There is no requirement to provide any subcontractor information, nor will any subcontractor information be used to influence award decision.
3. Will the government enforce clause 52.219-14 LIMITATIONS ON SUBCONTRACTING (DEVIATION 2019-01) which is incorporated on pages 27 and 28 of 78 of the solicitation posting prior to making an award recommendation for any SDVOSB or will the Government rely on a competing SDVOSB to spend thousands of dollars on a protest to ensure that requirement is enforced by the government?
Answer: FAR 52.219-14 states: “At least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern.” There would have to be something on the face of a quoter’s quotation to suggest that it would not comply with the Limitations On Subcontracting (LOS). Otherwise, review of subsequent invoices would be required to ensure LOS compliance, which would be a contract administration function and not a solicitation action.
