DEPARTMENT OF VETERANS AFFAIRS

Acquisition Plan Action ID: 36C249-18-AP-1084

1. Contracting Activity: Department of Veterans Affairs, VISN 09, Memphis VAMC.

2237: 614-19-3-069-0029.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

Maintenance Agreement for Terumo Cardiac Equipment Service, Base Contract with Four Option

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

The Terumo Cardiovascular Systems equipment incorporates proprietary designs with unique OEM parts and supplies only available to Terumo trained associates and hospital employed, biomedical technicians. Due to liability reasons, Terumo will not train nor supply repair parts to 3rd Party entities to maintain TCVG products.

All Terumo Field Service Representatives (FSRs) continually receive updated training on the latest hardware, firmware, and custom Terumo Heart and Lung software. All Field Service Representatives (FSR), are trained and certified at Terumo. Terumo provides training and certification for VAMC bio-med employees. Memphis currently has no trained or certified technicians to perform the required maintenance and service on the Heart and Lung equipment.

4. Description of market research conducted and results or statement why it was not conducted:

Market research was conducted IAW with FAR Part 10. Market research via VIP and DSBS resulted in zero SDVOSBs, VOSBs, or small businesses. Terumo Cardiovascular Group the (OEM) was contacted, and the company provided a letter stating that the company was the only ones with the experienced and trained personnel to perform maintenance services. SAM was checked to verify that the OEM had an active registration with no active exclusions.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.

RE: 3RD PARTY SERVICE PROVIDERS

To whom it may concern, Terumo Cardiovascular Group 6200 Jackson Road, Ann Arbor, Michigan 48103 Main: 734.663.4145 Toll-free: 800.262.3304 www.terumo-cvgroup.com

Terumo Cardiovascular Group located in Ann Arbor Michigan has become aware of 3rd party service providers engaging in preventive maintenance and repair of Terumo brand equipment used in open heart surgery.

At Terumo Cardiovascular Group we strive to produce and maintain the safest and highest quality cardiovascular products in the world. One of the ways we maintain such leadership is through our world-class service department. The Terumo in-house service department is the only authorized service organization for maintaining and repairing Terumo CVS devices. It has come to our attention that some third-party firms have been presenting misleading information to customers by claiming that they are an authorized Terumo CVG equipment service provider when they are not. These third parties are trading on the Terumo CVG name and may not be providing proper service and maintenance for Terumo CVG products. Improper service on these devices jeopardizes the lives of patients.

Terumo CVS is committed to protecting its patients and customers. If you would like more information about Terumo CVS authorized service, please call 800 262 3304. If you have any questions or concerns about this letter or the information provided, please contact me directly at 734-7 41-6106.

Sincerely, Greg Dubiel, Service Director 734-741-6106
