B.2 STATEMENT OF NEED
Background:
The Department of Veterans Affairs, North Florida / South Georgia Veterans Health System, currently has a requirement for the distribution and supply of medical-grade liquid bulk oxygen.
This will include a base period with four (4) one (1) year option periods.
General Requirement:
The purpose of this solicitation is to establish a committed source of supply of medical-grade liquid bulk oxygen for the Lake City VA Medical Center (LCVAMC). This facility currently owns one (1) 3500-gallon primary and one (1) 525-gallon reserve tank.
The offerors’ quotes shall meet or exceed the following:
The quantity of 106,000 CCF is an estimate for this facility’s annual requirement. There is no express or implied guarantee that these quantities will be purchased. The contract award resulting from this solicitation shall consist of a five (5) month base period and four (4) one-year option periods, which may be exercised by the Government at its sole discretion.
A Contracting Point of Contact (POC) will be designated and an alternate point of contact for this ordering facility. The POC’s will be responsible for local contract administration issues such as ordering and providing specific delivery instructions only. Designated POC’s information will be given within ten (10) days after notification of contract award. After receipt of award, the contractor shall contact each POC to ensure mutual understanding of facility requirements relating to the location, installation and setup of new leased tanks, the schedule of deliveries and specific details of any delivery instructions that are included in the solicitation.
After receipt of award, the contractor maybe requested to perform any in-service training to include the following facets for and government owned bulk oxygen tanks: the refill procedure, any preventative maintenance support requirements that may be needed from the medical center systems, and an explanation of all the volume alarm and low-pressure set-points at the
Governments designated date and time after award. This request may also include written procedures and training for pertinent LCVAMC staff, regarding protocols to accomplish emergency shutdowns or other sudden, unplanned termination of the refilling process.
The contractor maybe requested to assist the POC’s to perform alarm set point testing and written verification. Any code deficiencies in the Medical Center’s existing system, as defined by NFPA
55, Chapter 9, “Bulk Oxygen Systems”, must be identified by the contractor. A detailed explanation of these deficiencies must be presented in writing to the Contracting Officer and designated POC’s. Receipt of this written explanation shall be signed by each POC.
The Contractor maybe requested to verify in writing the access gauges on government-owned tanks. If requested after award, provide a written quote with price to repair and verify accuracy of the gauge(s).
Government–Furnished Property:
The Lake City VA Medical Center currently has on-site and owns two (2) medical grade liquid bulk tanks. The tanks provided are one (1) 3500-gallon primary and one (1) 525-gallon reserve.
Government-owned bulk oxygen storage tanks and appurtenances will be maintained by, and at the expense of the Government in a manner that will ensure compliance with applicable regulations, standards and normal good practices. If at any time the Contractor believes the
Government-owned tank is not being maintained properly, the Contractor shall immediately notify the Contracting Officer and facility POC in writing.
The Contractor shall be liable for loss of, or damage to, Government-furnished property when such loss or damage is attributable, in whole or in part, to the negligent acts or omissions of the
Contractor, its subcontractors, or their employees, agents, or representatives. In such cases, the
Contractor shall indemnify and hold the Government harmless from any resulting loss or damage to Government property, including but not limited to equipment, supplies, accessories, or parts furnished for use, storage, repair, or performance under this contract.
The Contractor shall further indemnify, save, and hold harmless the Government from any and all liabilities, claims, or costs arising from injury to, or death of, any person, or from loss of or damage to any property, when such injury, death, loss, or damage is connected with, incident to, or arising out of the Contractor’s use, occupancy, operations, or performance of work under this contract, and results in whole or in part from the negligent acts or omissions of the Contractor, its subcontractors, or their employees, agents, or representatives.
Nothing in this clause shall preclude the Government from receiving the benefit of any insurance carried by the Contractor that provides coverage for the loss, destruction, or damage of
Government property. The Contractor shall take no action that would prejudice the Government’s right to recover against third parties. Upon request of the Contracting Officer, the Contractor shall, at its own expense, provide all reasonable assistance and cooperation, including support in the prosecution of claims and execution of any necessary instruments of assignment to the
Government.
The Contractor shall maintain a minimum liability insurance in the amount of $500,00.00 per occurrence. Annual Certificate of Liability shall be provided to the Contracting Officer.
Delivery of Medical Liquid Bulk Oxygen:
Medical Grade Liquid Bulk oxygen shall be delivered to the Lake City VA Medical Center. Delivery hours: (8:00 AM – 3:30 PM)., Monday through Friday, excluding Federal holidays. In case of emergency, critical need, or national pandemic, medical center staff will be available for delivery any day, any hour. The Government will provide a list of Federal holidays at time of award.
The offeror shall deliver medical-grade liquid oxygen within the timeframe specified for the
LCVAMC. The timeframe identified may be either the number of calendar days after receipt of the
Government’s order, the specific days of the week for delivery, the specific time intervals between deliveries, a specified reorder point, or other specified ordering and delivery methods. If the time frame for contract or delivery is not identified, the contractor must provide 24-hour notice prior to delivery or upon mutual agreement between the facility and the contractor, alternate ordering/delivery methods such as pre-scheduled deliveries, calling for tank level readings, installing telemetry unit, etc. may be arranged. If for any reason the contractor is unable to deliver at the agreed day or time, the contractor will provide 24-hour notice to the POC, so that the facility can initiate an alternate backup action.
In accordance with VHA Patient Safety Alert dated April 4, 2004, all deliveries must be monitored by a qualified and trained technical representative that will be designated by the facility.
Contractor will be provided with names and contact information of primary and back-up facility representatives. This applies to all deliveries regardless of time or day of execution.
Primary and reserve tank(s) will be filled to a maximum functional capacity at each refilling procedure unless otherwise specified in the facility requirements or as agreed upon in a written document signed and dated by the POC.
At the time of each delivery, Contractor must provide a legible signed and dated written document that identifies the tank level prior to fill, the level after fill, and the quantity delivered. This document must be counter-signed by this facility representative supervising the delivery.
Due to recent and historical national pandemic response with special note to national supply chain deficiencies in production and transportation of bulk medical gases; if sufficient product is not available from Contractor’s indicated normal source of supply, Contractor will make reasonable efforts to obtain additional product from alternate sources with written consent and agreement from the Government. By written consent of the CO the Government will pay any additional costs associated with product obtained in this manner.

Pamphlet No. P-6, titled “Standard Density Data, Atmospheric Gases and Hydrogen,” shall be used when necessary to convert measurement of gases from one form to another. For example, the following conversion factor shall apply for conversion from gallons to cubic feet.
Calculation based on data in CGA P-6
1ft3 liquid O2 = 860.6 ft3 gas
1ft3 liquid O2 = 7.48052 gal
Therefore:
7.48052 gal (1ft3) liquid O2 = 860.6 ft3 gas
1 gal liquid O2 = 860.6 ft3 gas
7.48052
1 gal liquid O2 = 115.05 ft3 gas
Or more commonly quoted as 1 gal liquid O2 = 115.1 ft3 gas
Delivery Location:
• Lake City VAMC, located at 619 S. Marion Ave., Lake City, Florida, 32025.
Offerors shall fill out and return Attachment A with their offer. “Manufacturing Facilities”.
