B.4 PERFORMANCE WORK STATEMENT

Performance Work Statement Pond and Aquarium Services

1.0 INTRODUCTION

1.1 The Government requires pond and aquarium maintenance services for the Gold Star Memorial Pond located at the Malcom Randall VAMC Gainesville, the small pond, and 4 aquariums located at the Lake City VAMC. Engineering service.

2.0 DESCRIPTION/SCOPE/OBJECTIVE

2.1 The Contractor must provide all labor, equipment, tools, material, supervision and other items and services necessary to perform the work as defined in this Performance Work Statement.

3.0 APPLICABLE DOCUMENTS

4.0 PERFORMANCE REQUIREMENTS

4.1 The contractor shall perform pond and aquarium services inclusive of providing all supplies/equipment IAW all governing doctrine and industry standards for the proper and safe intended performance therewith.

4.2 The contractor shall take full responsibility for any damages caused to any part of the equipment or pond waters, animals therein, etc. All chemicals used shall be IAW all Government policies and procedures.

4.3 Maintenance Bed Tower: The Contractor is responsible for maintaining an estimated 1,500-gallon Gold Star Memorial pond located in front of the Bed Tower. This service shall include but not be limited to:

· Keeping the water clean and clear on a continuous basis using various methods such as pond cleaning equipment and chemicals (approved by the Government IAW any EPA standards industry or otherwise).

· The contractor shall keep the sides and the bottom of pond clean.

· The contractor is responsible for maintaining and adjusting the height of the water fall and jets to maintain the proper height year around.

· Contractor shall be responsible for purchasing and planting colorful plants and flowers on a seasonal basis inside the pond area. To ensure colorful plantings annuals will be maintained by the contractor year around per the season. Example: plant annuals for each time of the season- Winter, Spring, Summer and Fall.

· Contractor shall keep the fenced area of the pond free of weeds.

· It is the responsibility of the contractor to keep plants trimmed and pruned as necessary.

· Services are expected to be performed on a weekly basis.

· It is the sole responsibility of the contractor` to ensure pond pumps are in good working order year around. If any issues are noted during the contractor’s weekly visit to the site, contractor shall immediately notify the Grounds shop Supervisor of said problems(s).

4.4 Maintenance Lake City:

· Contractor is responsible for maintaining 1- 275 gallon capacity pond, 1- 65 gallon aquarium, 1-75 gallon aquarium, 1-90 gallon aquarium, 1- 150 gallon aquarium, 1- 75 gallon aquarium. The pond is located directly behind the CLC on the exterior of the facility. 90 gallon tank is located at CLC 2, 75 gallon tank is located in CLC 3, 65- gallon tank is located in CLC 4, 150- gallon tank located in 3 South; the Hospice Unit.

· Contractor shall keep water changed on an as needed basis to maintain clean and clear water.

· Contractor shall use chemicals that will aid in the cleanliness and clarity of the water year around.

· Contractor shall maintain and clean all filter/boxes.

· Contractor shall periodically maintain all lights to ensure they are operating properly. It is the sole responsibility of the contractor to notify engineering, Lake City, if issues with the lighting are noted during contractor visits to the site.

· Contractor shall maintain all aquarium decorations- including pebbles/rock ensuring a clean and neat appearance.

4.4.1 LIST OF AREAS:

1. Gainesville 1,500-gal pond. Front of Bed Tower- no fish.

1. Lake City pond 275-gallon pond Gold fish 10.

1. CLC 4 65 gallon. African Cyclids 10.

1. CLC 3 75 gallon. African Cyclids 15.

1. CLC 2 90 gallon. African Cyclids 15.

1. Hospice Unit 3 south 150 gallons. African Cyclids 35.

1. Recreation Therapy Services 75 gallon. Tropical fish varieties 10.

4.5 Safety Regulations:

· The Contractor shall use all safety equipment as required by OSHA and VA regulations.

· All OSHA and VA safety regulations shall be observed during the performance of the service contract.

· All contractors must have completed the 10- hour OSHA safety course.

· The VA Safety Officer shall have full authority to see that the contractor obeys all safety rules and regulations relative to the fulfillment of this project.

· Provide the necessary barricades/signage where required.

· The contractor shall designate a “competent person” in accordance with 29 CFR 1926.32(f) which states, “One who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous or dangerous to employees and who has authorization to take prompt corrective measures to eliminate them.” The contractor shall instruct each of his employees in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.

· Maintain site and building access free and unobstructed to facility emergency services.

· Prohibit smoking in not designated areas.

· Dispose of waste and debris from project site after each service. Additionally, the contractor shall comply with the following requirements if the project is inside the building and certain work is being done:

· Develop a plan detailing project specific fire-safety measures.

· Maintain site and building access free and unobstructed to facility emergency services.

5.0 PERFORMANCE LOCATION AND HOURS

5.1 Primary places of performance are the Malcom Randall VAMC 1601 SW Archer RD Gainesville FL and Lake City VAMC 619 S. Marion Ave. Lake City, FL.

5.2. Government normal duty hours are from 0800-1630, Monday through Friday, excluding Federal holidays. Contractor access will be provided during this time.

5.2.1 Outside normal duty hours may occur. These times shall be coordinated with and at the convenience of the Government.

6.0 DELIVERABLES

6.1 All service records shall be provided to the Government within a timely manner (one (1) week of services rendered).

7.0. CONTRACTOR PERSONNEL AND MANAGEMENT

7.1. Contractor Personnel. The Contractor shall be responsible for employing technically qualified personnel to perform the work specified in this PWS. The Contractor shall maintain the personnel, organization and administrative control necessary to ensure that the work delivered meets the contract specifications and requirements.

7.2. Contractor Badges. Notwithstanding the requirement to wear a Government furnished badge, Contractor personnel shall also wear a laminated contractor identification badge always when performing services under this Contract, including when on Government directed travel the badge will contain a personal picture, name of employee, and Contractor's name. Badges shall be worn on the outer garment attached to the outer shirt or jacket pocket by a button or clip or worn around the neck secured by an appropriate identification card lanyard.

7.3. All Contractor personnel attending meetings, answering Government telephones, and working in other situations where their Contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public or Congress that they are Government officials. They must also ensure that all documents or reports produced by Contractor personnel are suitably marked as Contractor products or that Contractor participation is appropriately disclosed.

7.4. Safety/Security Requirements. The Contractor shall comply with all applicable federal, state and local laws and ensure performance is secure while protecting material, equipment, and supplies from damage and loss. Government security personnel shall have the express right to inspect for security violations at any time during the term of the contract.

7.5. All information generated in performance of this contract becomes property of the Government and must be surrendered upon request and/or completion of the contract. The Contractor must protect against the destruction and/or misplacement of all information produced under this contract, unless directed under local policy to destroy. This includes both hard and soft copies of data.

7.6. The Contractor shall not release any information (including photographs, files, public announcements, statements, denials, or confirmations) on any part of the subject matter of this contract or any phase of any program hereunder without the prior written approval of the COR.

7.7. Standards of conduct

7.7.1. Conduct of Personnel. Contractor personnel shall conduct themselves in a professional manner (i.e. timeliness, communication; spoken and written etc.). The Contracting Officer may require the Contractor to remove from the job site any employee working under this contract for reasons of suspected misconduct, a suspected security breach, or suspected to be under the influence of alcohol, drugs, or any other incapacitating agent. Contractor employees shall be subject to dismissal from the premises upon determination by the Contracting Officer that such action is necessary in the interests of the Government. The hospital director or designated representative has the authority to bar individuals from the Government facility. The removal from the job site or dismissal from the premises shall not relieve the Contractor of the requirement to provide sufficient personnel to perform the services as required by this performance work statement. The Government shall not reimburse the Contractor for travel and other expenses associated with the removal of personnel.

7.7.2. Contractor personnel are not authorized to carry or possess personal weapons to include, but not limited to, firearms and knives with a blade length more than three inches, while assigned under this contract.

7.7.3. Working Attire and Appearance. Contractor personnel shall present a professional appearance commensurate with standards delineated for Government civilian personnel acting in similar capacities.

7.7.4. The Government reserves the right to review Contractor personnel qualifications. Upon request, resumes shall be provided to the Contracting Officer prior to clearance approval, for review and acceptance by the COR. The intent is verification purpose and not for the Government to become the hiring authority.

8.0 TRAVEL. NOT APPLICABLE

9.0 NON-PERSONAL SERVICE STATEMENT

9.1. Contractor employees performing services under this order will be controlled, directed, and supervised always by management personnel of the contractor. Contractor management will ensure that employees properly comply with the performance work standards outlined in the PWS. Contractor employees will perform their duties independent of, and without the supervision of, any Government official. The tasks, duties, and responsibilities set forth in the contract may not be interpreted or implemented in any manner that results in any contractor employee creating or modifying Federal policy, obligating the appropriated funds of the United States Government, overseeing the work of Federal employees, providing direct personal services to any Federal employee, or otherwise violating the prohibitions set forth in Parts 7.5 and 37.1 of the Federal Acquisition Regulation (FAR). The Government will control access to the facility and will perform the inspection and acceptance of the completed work.

10.0 PERFORMANCE STANDARDS AND QUALITY MEASUREMENT

10.1. Performance standards define desired services. The Government performs surveillance to determine if the Contractor exceeds, meets, or does not meet these standards. The Government shall use these standards to determine Contractor performance and shall compare Contractor performance to the Acceptable Quality Level (AQL). The Quality Assurance Surveillance Plan (QASP) method of surveillance will be by random inspection.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

C.2 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The preliminary notice does not commit the Government to an extension.

(End of Clause) C.5 VAAR 852.219-74 LIMITATIONS ON SUBCONTRACTING—MONITORING AND COMPLIANCE (JUL 2018)

(a) This solicitation includes VAAR 852.219-10 VA Notice of Total Service- Disabled Veteran-Owned Small Business Set-Aside.

(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6, or the limitations on subcontracting requirements in the FAR clause, as applicable. The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) retained by VA to assist in assessing the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to Contractor's offices where the Contractor's business records or other proprietary data are retained and to review such business records regarding the Contractor's compliance with this requirement.

(c) All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor's business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.

(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirement.

C.6 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2012)

(a) Definitions. As used in this clause—

(1) Contract financing payment has the meaning given in FAR 32.001.

(2) Designated agency office has the meaning given in 5 CFR 1315.2(m).

(3) Electronic form means an automated system transmitting information electronically according to the Accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests.

(4) Invoice payment has the meaning given in FAR 32.001.

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System. (See Web site at http://www.fsc.va.gov/einvoice.asp.)

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI). The X12 EDI Web site (http://www.x12.org) includes additional information on EDI 810 and 811 formats.

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances below, the contracting officer directs that payment requests be made by mail, the contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for:

(1) Awards made to foreign vendors for work performed outside the United States;

(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;

(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;

(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or

(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

C.7 VAAR 852.237-70 CONTRACTOR RESPONSIBILITIES (APR 1984)

The contractor shall obtain all necessary licenses and/or permits required to perform this work. He/she shall take all reasonable precautions necessary to protect persons and property from injury or damage during the performance of this contract. He/she shall be responsible for any injury to himself/herself, his/her employees, as well as for any damage to personal or public property that occurs during the performance of this contract that is caused by his/her employees fault or negligence, and shall maintain personal liability and property damage insurance having coverage for a limit as required by the laws of the State of Florida. Further, it is agreed that any negligence of the Government, its officers, agents, servants and employees, shall not be the responsibility of the contractor hereunder with the regard to any claims, loss, damage, injury, and liability resulting there from.

C.8 SUPPLEMENTAL INSURANCE REQUIREMENTS

In accordance with FAR 28.307-2 and FAR 52.228-5, the following minimum coverage shall apply to this contract:

(a) Workers' compensation and employers liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.

(b) General Liability: $500,000.00 per occurrences.

(c) Automobile liability: $200,000.00 per person; $500,000.00 per occurrence and $20,000.00 property damage.

(d) The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage.

D.1 WAGE DETERMINATION

Please note the listing below is not the all inclusive wage determination of each area of performance. It is the contractor’s responsibility to obtain and evaluate each wage determination locality.

SECTION E - SOLICITATION PROVISIONS

E.1 ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL ITEMS

Provisions that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available.

The following provisions are incorporated into 52.212-1 as an addendum to this solicitation:

Addenda to 52.212-1:

Reference word “offer” or “offeror” and insert “quote” or “quoter” in its place.

All quotes shall be submitted electronically (email) only (limit 5MB per email). Each quote shall include three (3) separate volumes, as listed below. Submission of a quote that does not contain all items requested below may result in elimination from consideration of award. Quoters must submit each volume as a separate electronic attachment clearly identified as described below. No price information shall be included in the technical or past performance volumes. Quoters are responsible for including sufficient details to permit a complete and accurate evaluation of each quote.

Quotes received via mail or by any other means will not be accepted. The Government is not accepting alternate quotes; only one (1) quote shall be submitted by the quoter. Be sure to respond to any information the Government is requesting within this Request for Quote.

Volume 1- Price

1. Completed SF1449, dated and signed by a principal of the firm.

2. Completed Section B Price/Cost Schedule. Quoters must use the Item Numbers in the Schedule. It is not permissible for quoters to use vendor created Item Numbers or Sub Item Numbers.

3. A statement confirming that the quoter’s Representations and Certifications at sam.gov are current and accurate.

4. Signed Certifications that may be included as Addenda to FAR 52.212-1.

5. Signed acknowledgments of each amendment (SF30). Applicable only if amendments to the solicitation have been issued.

6. A statement confirming that the quoter understands and abides by FAR 52.219-14 Limitations on Subcontracting; at least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern

Volume 2- Qualifications (Technical)

Quoters shall provide a narrative (including any descriptive literature and/or certifications) that demonstrates the quoters ability to meet the technical credentials and capability stated in the Performance Work Statement (PWS). The narrative shall not exceed four (4) pages, inclusive of the certification document, and address the following requirements:

1. All quoters shall submit their firms’ certification (Aquatic License) to perform the work required for the State of Florida.

2. Briefly provide a plan for furnishing all labor, services, and equipment to deliver the services listed in the Performance Work Statement.
