Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 in conjunction with Part 13, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation for this action. Quotes are being requested, and a written solicitation will not be issued.
This solicitation is issued as a Request for Quote (RFQ). Submit written quotes on 36C24818Q0186.
The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-96 effective Nov. 06, 2017. This request for quote is issued December 18, 2017 and will end on January 10, 2018 at 10:00 AM EST and is set aside for 100% SDVOSB
The purpose of this Solicitation is to award a firm fixed priced contract to provide labor, equipment and materials to perform preventive maintenance/emergency repairs to the Tracer Summit and Metasys Building Automation Systems at the VA Caribbean Healthcare System, Clinics and Vet Centers. for the period of February 1, 2018 thru March 31, 2019 and four years’ option period for the VA Caribbean Healthcare System. The Contractor shall furnish all labor, equipment, supervision, parts, supplies, materials, shipping expenses, and travel necessary to accomplish the services described herein All the work will be in accordance with the Scope of Work below.
This procurement is being conducted under Subpart 13.5 Simplified Procedures for Certain Commercial items. The intent is to award a firm fixed price contract.
The North American Industrial Classification System (NAICS) code for this procurement is 238220, with a small business size standard of $15M in Annual Receipts. This procurement is a SDVOSB and all eligible offerors are encouraged to submit quotes. All offerors must be registered in System for Award Management (SAM) at http://www.sam.gov to be considered for an award of a federal contract http://www.sam.gov/ registered in the record must be complete and not missing elements such as representations and certifications.

Contractors interested in providing these services should submit their quotes via email to Rafael.Rodriguez2@va.gov. All questions or inquires must be submitted no later than 10:00 am Eastern Standard Time on December 28, 2017 Email all questions to the Contract Specialist’s above email address.
The Government will award a contract resulting from this RFQ to the responsible offeror whose quote is the lowest price technically acceptable (LPTA). Quotes are due by 10:00 A.M. Eastern Standard Time on January 10, 2018. Quotes received after this date and time will be considered late in accordance with 52.212-1(f) and will not be evaluated. Quotes shall be submitted via email to Rafael.Rodriguez2@va.gov.

C. SCOPE OF WORK
BACKGROUND
This SERVICE CONTRACT is required to provide the labor, equipment and materials to perform preventive maintenance/emergency repairs for the Tracer Summit and Metasys Building Automation System (BAS) at the VA Caribbean Healthcare System, Clinics and Vet Centers.
The Building Automated System is operated and monitored 24 hours/day, 365 day/year at VACHS’ Operations Control Center. There are two main Building Automated Systems programs installed at VACHS: Tracer Summit and Metasys. These programs provide building control through a single, integrated system, including: lighting, climate, scheduling, energy consumption and other controllable features. Specifically, these systems control and monitor all critical and non-critical mechanical and electrical utility systems for the entire San Juan Medical Center and remote clinics. There are over 1,000 software controlled points in Tracer Summit and over 500 software controlled points in Metasys (Control loops, trends, schedules, etc.) throughout VACHS.
APPLICABLE DOCUMENTS
In the performance of the tasks associated with this Performance Work Statement, the Contractor shall comply with the following:
1. FIPS Pub 201, “Personal Identity Verification of Federal Employees and Contractors,” March 2006
2. Per FAR 52.219-14 “Limitations on Subcontracting”, the Government will not allow more than 50% the work under this contract to be Subcontracted.
SCOPE OF WORK
a. The Contractor shall provide the labor, equipment and materials to perform preventive maintenance/emergency repairs to the Tracer Summit and Metasys Building Automation Systems at the VA Caribbean Healthcare System, Clinics and Vet Centers.
b. The Contractor shall furnish all labor, equipment, supervision, parts, supplies, materials, shipping expenses, and travel necessary to accomplish the services described herein.
PERFORMANCE DETAILS
a. Software Support Services:
i. Software upgrades and updates shall be created during the time of this agreement. These upgrades will enhance current system performance. Contractor must provide latest version of system manufacturer’s copyrighted operating software revisions, to all desktops and laptops that have the Tracer Summit and Metasys Programs. Currently, there are a total of eight (8 seats, but may have more seats in the future which would also be covered under this contract.
ii. There are over 1,000 software controlled points in Tracer Summit and over 500 software controlled points in Metasys (Control loops, trends, schedules, etc).
b. Hardware Preventive Maintenance:
i. A scheduled maintenance program shall be used to keep hardware system operating at optimum efficiency. Service technician assures state-of-the-art performance with minimum failure rate.
ii. There are over 8,000 hardware monitored points (sensor and controllers) of Tracer Summit and over 3,000 hardware monitored points of Metasys at
VACHS.
c. Control and Monitoring Points:
i. Currently there are approximately 12,000 Control and Monitoring Points in the Building Automated Systems (Tracer Summit and Metasys) at VACHS.
However, there may be additional points included in the BAS at a later time which will be included under this contract at no additional cost, not to exceed 15,000 control and monitoring points. At which time, the contract may be amended to cover additional costs.
PERFORMANCE PERIOD
The period of performance shall be 12 months from date of the contract award, with 4 options for 12 months/year (Base Year + 4 Option Years).
Any work at the Government site shall not take place on Federal holidays or weekends unless directed by the Contracting Officer (CO). (If required, the CO may designate the Contractor to work during holidays and weekends). There are ten (10) Federal holidays set by law (USC Title 5 Section 6103) that VA follows:
Under current definitions, four are set by date:
New Year's Day January 1 Independence Day July 4 Veterans Day November 11 Christmas Day December 25
If any of the above falls on a Saturday, then Friday shall be observed as a holiday. Similarly, if one falls on a Sunday, then Monday shall be observed as a holiday.
The other six are set by a day of the week and month:
Martin Luther King's Birthday Third Monday in January Washington's Birthday Third Monday in February Memorial Day Last Monday in May Labor Day First Monday in September Columbus Day Second Monday in October Thanksgiving Fourth Thursday in November
PLACE OF PERFORMANCE
Tasks under this PWS shall be performed in VA facilities located at the Veterans Affair Medical Center in San Juan, Arecibo Outpatient Clinic, Guayama Outpatient Clinic, Mayaguez Outpatient Clinic, Ponce
Outpatient Clinic, Saint Croix Outpatient Clinic, Saint Thomas Outpatient Clinic, Utuado Outpatient Clinic, Comerio Outpatient Clinic, Vieques Outpatient Clinic, Ceiba Outpatient Clinic, Arecibo Vet Center, Ponce Vet Center and San Juan Vet Center.
Due to the complexity of the VACHS and its criticality, it is required to have at least three (3) dedicated certified technician (two for Tracer Summit and one for Metasys) on-site during normal hours of operations. Normal hours of operations are between Monday through Friday 8:00 a.m. – 4:30 p.m., except Federal holidays.
TRAVEL
The Government anticipates travel under this effort to perform the tasks associated with the effort, as well as to attend program-related meetings throughout the period of performance. Include all estimated travel costs in your firm-fixed price line items. These costs will not be directly reimbursed by the Government.
The trips in support of the program for this effort are mainly to the Ponce and Mayagüez Outpatient Clinics and an estimated at 1-2 days in duration. There maybe an estimated 4-5 time per year. Contractor travel within the local commuting area will not be reimbursed.
SPECIFIC TASKS AND DELIVERABLES
The Contractor shall perform the following:
Software Support Services:
iii. Software upgrades and updates shall be created during the time of this agreement. These upgrades will enhance current system performance. Contractor must provide latest version of system manufacturer’s copyrighted operating software revisions, to all desktops and laptops that have the Tracer Summit and Metasys Programs. Currently, there are a total of eight (8 seats, but may have more seats in the future which would also be covered under this contract.
iv. There are over 1,000 software controlled points in Tracer Summit and over 500 software controlled points in Metasys (Control loops, trends, schedules, etc).
v. Weekly, service contractor shall review current data/graphics and verify that application programs are working as designed. A data file will be supplied in CD to Operations Control Center (OCC) personnel and Chief OOC, for the records.
vi. Service contractor shall provide software application support to maximize system utilization and optimization. This support will include on-site evaluation of current applications programs, and implementation of changes that enhance system operation and reduce operating expenses.
d. Hardware Preventive Maintenance:
i. A scheduled maintenance program shall be used to keep hardware system operating at optimum efficiency. Service technician assures state-of-the-art performance with minimum failure rate.
ii. There are over 8,000 hardware monitored points (sensor and controllers) of Tracer Summit and over 3,000 hardware monitored points of Metasys at VACHS.
iii. Contractor shall provide in writing the preventive maintenance protocol (policies and procedures), including the methods and frequency of testing and verifications of performance for the equipment.
iv. Each preventive maintenance service will be scheduled and completed in a computer-prepared service report, detailing exactly what was performed and to which equipment was done, what special tools, instrumentation, and diagnostic programs was used to maintain the system at optimum efficiency levels.
v. A Computerized Maintenance Management System (CMMS) program will be provided by the Contractor, to keep track of all maintenance records, generates work orders and work requests, manage preventive and predictive maintenance, inventory control and tracking asset history.
vi. At the completion of each month, a Summary Report will be provided to the VA Medical Center. Template of the report needs to be approved by VA prior to start this contract. Maintenance intervals will be determined by equipment run time, application, location, and service contractor’s computer data bank of maintenance experience and manufacturer’s specification, according to service contractor’s best judgment.
vii. Scheduled preventive maintenance shall be given to all equipment and points connected to the existing Tracer Summit System and Metasys Building Automation Systems (air handling units, supply/exhaust fans, pumps, reheat coil valves, generators, chillers, cooling towers, water tanks, etc). Scheduled preventive maintenance shall include, but not limited, the following:
1. Verify all sensors and controllers (i.e. temperature, humidity, smoke, amperage, flow, pressure, etc.)
2. Adjust all sensors (current, pressure, temperature and humidity) and control loops.
3. Clean and adjust connections to all control panels (Trane: BCUs, MPs and UPCMs, and Metasys: FEC, IOM, and NAE) as per manufacturer’s recommendation.
4. Check all control valves (i.e. VAVs, dampers, chilled water).
5. Calibrate all sensors at least once per year and calibrate all Critical
Sensors (ER, OR, SPM, MSC) once every 3 months.
e. Control and Monitoring Points:
i. Currently there are approximately 12,000 Control and Monitoring Points in the
Building Automated Systems (Tracer Summit and Metasys) at VACHS.
However, there may be additional points included in the BAS at a later time which will be included under this contract at no additional cost, not to exceed 15,000 control and monitoring points. At which time, the contract may be amended to cover additional costs.
f. Ongoing Support Services:
i. Service contractor will review the current data/graphic file and application programs, and install software updates/revisions that are required to maintain system operation on a weekly basis.
ii. Service contractor shall review with VA Medical Center, all work performed, answer any questions and determine if there are additional ways service contractor can be of service.
iii. People are the vital link in the successful operation of any high technology system. Operation and programming support to questions/concerns shall be available upon needed during regularly hours of work.
iv. On a regular basis, VA Medical Center will be kept informed of all new products developments, applications, tips, and other useful information which will allow VA Medical Center to maximize the use of the Building Automation System.
v. PROJECT MANAGEMENT CONTRACTOR PROJECT MANAGEMENT PLAN
The Contractor shall deliver a Contractor Project Management Plan (CPMP) that lays out the Contractor’s approach, timeline and tools to be used in execution of the contract. The CPMP should take the form of both a narrative and graphic format that displays the schedule, milestones, risks and resource support. The CPMP shall also include how the Contractor shall coordinate and execute planned, routine, and ad hoc data collection reporting requests as identified within the PWS. The initial baseline CPMP shall be concurred upon and updated monthly thereafter. The Contractor shall update and maintain the VA PM approved CPMP throughout the period of performance.
Deliverables:

REPORTING REQUIREMENTS
The Contractor shall provide the Contracting Officer’s Representative (COR) with Monthly Progress Reports in electronic form in Microsoft Word and Project formats. The report shall include detailed instructions/explanations for each required data element, to ensure that data is accurate and consistent.
These reports shall reflect data as of the last day of the preceding month.
The Monthly Progress Reports shall cover all work completed during the reporting period and work planned for the subsequent reporting period. The report shall also identify any problems that arose and a description of how the problems were resolved. If problems have not been completely resolved, the Contractor shall provide an explanation including their plan and timeframe for resolving the issue. The Contractor shall monitor performance against the CPMP and report any deviations. It is expected that the Contractor will keep in communication with VA accordingly so that issues that arise are transparent to both parties to prevent escalation of outstanding issues.
Deliverables:
A. Montly Progress Report
GENERAL REQUIREMENTS
a. Proposals will be considered only from offerors who are regularly established in the business called for, who are financially responsible, and able to show evidence of their reliability, ability, experience, facilities and personnel directly employed or supervised by them to render prompt and satisfactory service.
b. Personnel trained and experienced in providing service/maintenance on the equipment identified above shall perform all work.
c. Per FAR 52.219-14 “Limitations on Subcontracting”, the Government will not allow more than 50% the work under this contract to be Subcontracted. All qualifications submitted for the evaluation must be of the General Contractor not subcontractor. A resume of the employees involved must be included and a telephone number in which they could be contacted must be included.
d. Contractor must provide evidence with bid that at least three (3) of the Contractors employees must have the following licenses (otherwise there offer will not be considered):
i. Two of the following:
1. Metasys Extended Architecture for Engineers
2. Metasys NAE Configuration and programming
3. Metasys FEC Configuration and Programming
4. Metasys Custom Programming
ii. Tracer Summit Certifications
e. The contractor shall assure that its employees have received safety equipment training, medical surveillance programs, individual health protection measures, and manufacturer's product and material safety data sheets (MSDS) as required for the work by the U.S.
Occupational Safety and Health Administration. Contractor should comply with applicable additional safety codes and standards.
f. Debris, garbage and/or equipment removed as part of this contract shall be collected and precautions must be taken to ensure that is not otherwise dispersed outside the area during the cleaning process.
g. In the performance of this contract, the Contractor shall take such safety precautions as the Contracting Officer or his/her designee may determine to be reasonably necessary to protect the lives and health of occupants of the building. The Contracting Officer or his/her designee will notify the Contractor of any non-compliance with the foregoing provisions and the action to be taken. The Contractor shall, after receipt of such notice, immediately correct the conditions to which attention has been directed. Such notice, when served on the Contractor or his/her representative at the site of the work, shall be deemed sufficient for the purpose aforesaid. If the Contractor fails or refuses to comply promptly, the Contracting Officer may issue an order stopping all or any part of the work and hold the Contractor in default.
h. Contractor shall respond to the service call within two (2) hours after notification.
Contractor shall physically report on site VAMC within four (4) hours from the initial notification time if the problem cannot be corrected by telephone.
i. Contractor shall respond to all repair service for priority maintenance within four (4) hours after notification. Contractor shall report directly to the Graphic Control Center (787-641-7582, ext. 10264), this check in/out is mandatory during normal working hours from 8:00 A.M. through 4:30 P.M. and after normal working hours. Contractor shall provide a twenty-four (24) hour emergency service response, seven (7) days a week.
j. For emergency repair service, Contractor shall respond within two (2) hours after notification. Includes the immediate repair services on a call basis for inoperable equipment and respond with the time specified. Service includes all required repairs to bring the equipment to an operational status considering malfunction is causing immediate work stoppage to the VAMC. All service calls are unlimited for all priority maintenance, repair service, and emergency repair service.
k. Contractor shall supply all labor and parts; test instruments and tools required to perform all repair and maintenance work. All parts shall be furnished on an exchange basis and will be new standard parts. Exchange parts removed from the equipment in the schedule become the property of the Contactor. Contractor shall have the service manuals available to perform each maintenance or repair.
l. All maintenance (predictive, preventive, repair service and emergency repair service) shall include replacement of parts deemed necessary by the Contractor, except those parts that exceeding a dollar value of $3,000.00 each. Cost such as labor, shipping cost, travel expenses, lodging expenses, overhead, profit, any administrative cost, insurance, bonds and any other will be at no additional cost to the Government. If the contractor indicates that the material to be replaced exceeds the dollar value of $3,000.00 then he must provide at least three quotes and the Government could search other quotes. If the Government quotes are under $3,000.00 then the contractor must purchase it without any objections.
m. For the purpose of clarification, any item not specifically excluded shall be considered the contractor’s responsibility.
n. All travel costs associated with the performance of this contract are the responsibility of the contractor and are provided at no additional cost to the Government as part of this contract. Travel costs are defined as but are not limited to time and vehicle costs for personnel in travel to and from job site for all duties outlined in this specification, normal shipping charges on any parts or materials covered by this contract, costs associated with the normal shipping of parts or equipment out for repair that are covered under this contract, etc.
o. The Contracting Officer (CO) approval is required to install any part(s) that are not covered in this contract, and these parts will be paid either by amendment to the purchase order covering this PM service or by issuing a separate purchase order. Any part (s) or material damaged by the Service Technician due to maintenance work shall be replaced or repair at no additional cost to the Government. Contractor shall provide and bear the cost of labor for maintaining the specified equipment in good operating condition when such is required because of normal wear and tear.
p. Except for emergency callback service, the Contractor shall perform all work during regular working hours of regular working days 8:00 a.m. to 4:30 p.m. excluding Federal holidays, unless specifically instructed otherwise by the COR.
i. Technicians must be assigned to the VA Medical Center in San
Juan during regular working hours of regular working days 8:00 a.m. to 4:30 p.m. excluding Federal holidays, unless specifically instructed otherwise by the COR. If a technician is moved to the clinics or to other duties, then another technician must replace the one in San Juan before leaving.
ii. Emergency Callback Service shall be provided 24 hours a day, seven days per week, as requested by the COTR.
q. Upon contract award, the contractor accepts "as is" all equipment specified in the contract. Failure to inspect them, prior to contract award, will not relieve the contractor from performing services/repairs in accordance with the strict intent and meaning of the specifications at no additional cost to the VA.
r. The Contractor shall require all employees, including supervisors, to wear distinctive uniform clothing for ready identification, and assure that every employee is in uniform no later than the time specified by the COR, or otherwise no later than 10 working days from the date an employee first enters on duty. The uniform shall have the Contractor’s name, easily identifiable, affixed thereon in a permanent manner such as a badge or monograms.
s. The Government will not be responsible for incidental charges including, but not limited to, parking, tolls, mileage, phone, etc., on straight time or overtime work.

The Tasks identified above and the resulting Position Sensitivity and Background Investigation requirements identify, in effect, the Background Investigation requirements for Contractor individuals, based upon the tasks the particular Contractor individual will be working. The submitted Contractor Staff Roster must indicate the required Background Investigation Level for each Contractor individual based upon the tasks the Contractor individual will be working, in accordance with their submitted proposal.
CONTRACTOR PERSONNEL SECURITY REQUIREMENTS
Contractor Responsibilities:
a. The Contractor shall prescreen all personnel requiring access to the computer systems to ensure they maintain the appropriate Background Investigation, and are able to read, write, speak and understand the English language.
b. The Contractor shall bear the expense of obtaining background investigations.
c. Within 3 business days after award, the Contractor shall provide a roster of Contractor and
Subcontractor employees to the COR to begin their background investigations. The roster shall contain the Contractor’s Full Name, Full Social Security Number, Date of Birth, Place of Birth, and individual background investigation level requirement (based upon Section 6.2 Tasks).
d. The Contractor should coordinate the location of the nearest VA fingerprinting office through the COR. Only electronic fingerprints are authorized.
e. For a Low Risk designation the following forms are required to be completed: 1.OF-306 and 2.
DVA Memorandum – Electronic Fingerprints. For Moderate or High Risk the following forms are required to be completed: 1. VA Form 0710 and 2. DVA Memorandum – Electronic Fingerprints. These should be submitted to the COR within 5 business days after award.
f. The Contractor personnel will receive an email notification from the Security and Investigation
Center (SIC), through the Electronics Questionnaire for Investigations Processes (e-QIP) identifying the website link that includes detailed instructions regarding completion of the investigation documents (SF85, SF85P, or SF 86). The Contractor personnel shall submit all required information related to their background investigations utilizing the Office of Personnel Management’s (OPM) Electronic Questionnaire for Investigations Processing (e-QIP).
g. The Contractor is to certify and release the e-QIP document, print and sign the signature pages, and send them to the COR for electronic submission to the SIC. These should be submitted to the COR within 3 business days of receipt of the e-QIP notification email.
h. The Contractor shall be responsible for the actions of all personnel provided to work for VA under this contract. In the event that damages arise from work performed by Contractor provided personnel, under the auspices of this contract, the Contractor shall be responsible for all resources necessary to remedy the incident.
i. A Contractor may be granted unescorted access to VA facilities with a favorably adjudicated Special Agreement Check (SAC) or “Closed, No Issues” (SAC) finger print results, training delineated in VA Handbook 6500.6 (Appendix C, Section 9), and, the signed “Contractor Rules of Behavior.” However, the Contractor will be responsible for the actions of the Contractor personnel they provide to perform work for VA. The investigative history for Contractor personnel working under this contract must be maintained in the database of the Office of Personnel Management (OPM).
j. The Contractor, when notified of an unfavorably adjudicated background investigation on a
Contractor employee as determined by the Government, shall withdraw the employee from consideration in working under the contract.
k. Failure to comply with the Contractor personnel security investigative requirements may result in termination of the contract for default.
l. The C&A Requirements do not apply and that a Security Accreditation Package is not required.

The Government will utilize a Quality Assurance Surveillance Plan (QASP) throughout the life of the contract to ensure that the Contractor is performing the services required by this PWS in an acceptable manner. The Government reserves the right to alter or change the surveillance methods in the QASP at its own discretion.
FACILITY/RESOURCE PROVISIONS The Government will provide office space, telephone service and system access when authorized contract staff work at a Government location as required in order to accomplish the Tasks associated with this PWS. All procedural guides, reference materials, and program documentation for the project and other Government applications will also be provided on an as-needed basis.
The Contractor shall request other Government documentation deemed pertinent to the work accomplishment directly from the Government officials with whom the Contractor has contact. The Contractor shall consider the COR as the final source for needed Government documentation when the Contractor fails to secure the documents by other means. The Contractor is expected to use common knowledge and resourcefulness in securing all other reference materials, standard industry publications, and related materials that are pertinent to the work.
VA will provide access to VA specific systems/network as required for execution of the task via remote access technology on-site at Operations Control Center and to all main mechanical and electrical utility building systems required.
GOVERNMENT FURNISHED PROPERTY
The contractor shall have access to the Tracer Summit and Metasys systems. There are currently 12 seats (licences). Additionally, the contractor shall have access to all BAS controls and monitors throughout the VACHS, this includes, but is not limited to: controllers (i.e. temperature, humidity, smoke, amperage, flow, pressure, etc.), sensors (current, pressure, temperature and humidity) and control loops, including all control panels (Trane: BCUs, MPs and UPCMs, and Metasys: FEC, IOM, and NAE).
D. Contract Administration
The Contracting Officer is the only person authorized to approve changes or modify any of the requirements under this contract. The Contractor shall communicate with the Contracting Officer on all matters pertaining to contract administration. Only the Contracting Officer is authorized to make commitment or issue changes that will affect price, quantity or quality of performance of this contract.
In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer, the change shall be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in cost incurred thereof.
LIMITATIONS ON SUBCONTRACTING-- MONITORING AND COMPLIANCE

This solicitation includes FAR 52.219-14 Limitations on Subcontracting. Accordingly, any contract resulting from this solicitation will include this clause. The contractor is advised in performing contract administration functions, the CO may use the services of a support contractor(s) retained by VA to assist in assessing the contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to contractor's offices where the contractor's business records or other proprietary data are retained and to review such business records regarding the contractor's compliance with this requirement. 52.203-99 PROHIBITION ON CONTRACTING WITH ENTITIES THAT

(a) The Contractor shall not require employees or contractors seeking to report fraud, waste, or abuse to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.
(b) The contractor shall notify employees that the prohibitions and restrictions of any internal confidentiality agreements covered by this clause are no longer in effect.
(c) The prohibition in paragraph (a) of this clause does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information.
(d)(1) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Resolution Appropriations Act, 2015 (Pub. L. 113-235), use of funds appropriated (or otherwise made available) under that or any other Act may be prohibited, if the Government determines that the Contractor is not in compliance with the provisions of this clause.

52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within ;
provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.
SUPPLEMENTAL INSURANCE REQUIREMENTS
In accordance with FAR 28.307-2 and FAR 52.228-5, the following minimum coverage shall apply to this contract:
(a) Workers' compensation and employers liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.
(b) General Liability: $500,000.00 per occurrences.
(c) Automobile liability: $200,000.00 per person; $500,000.00 per occurrence and $20,000.00 property damage.
(d) The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage.

(c) The Contractor need not comply with paragraph (a) above if the Contractor has established a mechanism, such as a hotline, by which employees may report suspected instances of improper conduct, and instructions that encourage employees to make such reports.
