ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES Provisions that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available.

The following provisions are incorporated into 52.212-1 as an addendum to this solicitation:

1. Instructions for Quote Submission.

1. Period of Acceptance of Quotes. The Quoter agrees to hold prices for a period of one-hundred-fifty (150) calendar days from the date specified for the receipt of offers.

1. Quoters shall include a complete electronic copy of their quote with their submission. The Quoter will submit the documents in PDF form; no Word documents will be accepted.

1. Prior to submitting a quote, Quoters are required to conduct a site visit at the participating facilities at no cost to the Government. Quoter(s) must email the designated Point of Contact (POC) for each facility listed below, including Mr. Leonard Robinson at leonard.robinson@va.gov, to confirm and obtain specific details regarding the location, date, and time of the site visits. The dates and POCs are as follows:

Quoters who fail to attend the site visit will not be considered for the award. It is recommended that Quoters arrive 15 to 30 minutes prior to 10:00 AM EST.

1. Quotes must be received by December 19, 2025 by 11:00AM EST. Email your quote to Leonard.robinson@va.gov. No phone calls of any nature regarding this solicitation will be accepted. The subject line must have the solicitation the Quoter is responding to listed. There will be no automated email notification of receipt of quotes. All quotes received without requested documentation will not be considered. Failure to comply with ALL criteria as set forth by the solicitation and ALL documentation requested in this basis of award will result in your quote being rejected and therefore not evaluated. No quote will be accepted via postal mail.

1. Past Performance. The past performance of the apparent successful Quoter will be reviewed by the contracting officer prior to award as part of the contracting officer’s responsibility determination per FAR Part 9.

1. Requirements for Priced Quotes. Quoters shall complete and submit the Price Schedule in section B.3 which includes estimated use. No other format shall be accepted.

1. VAAR 852.219-76 - VA Notice of Limitations on Subcontracting—Certificate of Compliance for Supplies and Products: The formal certification required by VAAR 852.219-76 must be completed, signed, and returned with the Quoter’s quote. The Government will not consider quotes for award from Quoters that do not provide the certification, and all such responses will be deemed ineligible for evaluation and award.

1. Questions pertaining to this solicitation shall be emailed to leonard.robinson@va.gov by November 03, 2025 at 11:00 AM EST. Questions will be answered via an amendment to this solicitation on or about December 05, 2025. No telephone inquiries will be considered.

1. Per VA Acquisition Regulation 852.219-73 incorporated by reference in this solicitation and the resulting contract, Offers are solicited only from eligible Service-Disabled Veteran-Owned small business concerns (“SDVOSBs”). Offers received from entities that are not listed as certified SDVOSBs in the SBA certification database at https://veterans.certify.sba.gov/ at the time of offer and at the time of award shall not be considered.

1. Per FAR 52.204-7, included in this solicitation by reference, Quoters and quoters are required to be registered in SAM at the time an offer or quotation is submitted in order to comply with the annual representations and certifications requirements.

1. Any Quoter submitting a quote as a joint venture must provide a certification from each SDVOSB joint partner, signed by an authorized official of each partner to the joint venture, stating that the parties to the joint venture (1) have entered into a joint venture agreement that fully complies with paragraph (c) of 13 CFR § 128.402 and (2) will perform the contract in compliance with the joint venture agreement. Failure to submit the certification with the Quoter’s quote will render the Quoter ineligible for award

2. Response to Evaluation Factors.

1. Factor 1 – Experience. This factor will be used to assess Quoter’s experience supplying bulk oxygen and tank rentals. Quoters shall provide a narrative describing their specific experience providing contracted supplying bulk oxygen and tank rentals. For each reference contract the Quoter submits as evidence of its experience, the Quoter’s narrative must clearly state the following information:

1. the legal name of entity with whom the Quoter held the contract;

(2) the number of years providing similar supplies (Experience)

(2) pervious and/or current contract number(s);

(3) whether the contract was for supplying bulk oxygen, tank rental, or both;

(4) the total amount (Measured in CCF) of bulk oxygen supplied for each contract, and/or including the number of tanks rented under each contract

(4) a description providing details of the specific tasks the Quoter performed under that contract;

(5) in what geographic location the Quoter supplied bulk oxygen and/or tank rentals;

(6) the dates during which the Quoter performed the contract;

(7) whether the provided reference contract is for supplies and/or rental provided by the Quoter or provided by a proposed subcontractor of the Quoter’s;

(9) whether the Quoter or its proposed subcontractor was the prime contractor or a subcontractor for that provided reference contract;

(10) the name, phone number, and email address of a person at the entity with whom the Quoter (or Quoter’s proposed subcontractor) held the contract who can verify the information the Quoter provides in the narrative description for this factor.

1. Factor 2 – Price. This factor shall be used to assess the reasonableness of the Quoter’s proposed price. For this factor, Quoter’s shall submit their Prices using the Schedule of Supplies and Price from section B.3 of this RFQ.

NOTE: The information requested above is required for the Government to evaluate quotes for the Experience evaluation factor. General statements claiming experience providing contracted bulk oxygen and tank rentals that do not include specific references to prior contract work, or that do not include the information required above, are not acceptable.

Prior to evaluating quotes under the non-price and price evaluation factors, the government will conduct an initial compliance review to determine whether quoters have complied strictly with all solicitation instructions. Quotes which do not strictly comply with all solicitation instructions shall be rejected and will not be evaluated under the non-price and price evaluation factors.

Quotes shall be all-inclusive and not refer or require the government to external communication mediums to supplement the quotes. To be eligible for award, the submitted quote must conform to the solicitation requirements, including all stated terms, conditions, representations, certifications, and all other information required by the submission instructions of FAR 52.212-1 and its addendum, to include proper of completion of FAR 52.209-7, FAR 52.212-3 and FAR 52.204-24 (if the Quoter’s representations in FAR 52.212-3(v)(2)(i) and (ii) require as much).

FAILURE TO SUBMIT THE INFORMATION REQUIRED ABOVE TO SUPPORT THE QUOTER’S CLAIMED EXPERIENCE MAY BE VIEWED BY THE GOVERNMENT AS EVIDENCE THAT THE QUOTER LACKS EXPERIENCE IN PROVIDING CONTRACTED SUPPLY OF LIQUID OXYGEN , OR CONTRACTED TANK RENTALS, OR BOTH, WHEN EVALUATING QUOTES FOR THE EXPERIENCE EVALUATION FACTOR.
