Justification and Approval for Other Than Full and Open Competition (>SAT)

This is a Department of Veterans Affairs Justification and Approval (J&A) form for a sole source acquisition to renew preventative maintenance services for Waverly Glen Ceiling Lifts at Tuscaloosa Veterans Affairs Medical Center in Tuscaloosa, Alabama. The contracting activity is Network Contracting Office 07 (NCO 07) located in Decatur, Georgia. The acquisition is structured as a Base Plus 4 Year contract for preventative maintenance and service repair of over fifty ceiling lifts/rooms. The justification invokes the statutory authority under 41 USC §3304(a)(1) for "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements," as implemented by RFO 6.103-1.

The sole source contractor is Savaria Concord Lifts Inc. (listed as a large business), the OEM-authorized vendor identified by the original equipment manufacturer Handicare. Market research confirmed that other potential vendors identified through SBA Small Business searches (two VOSB/SDVOSB vendors) and GSA searches (16 possible VOSB/SDVOSB vendors) are not authorized by the OEM to provide maintenance services. The contracting officer determined that anticipated costs will be fair and reasonable based on comparison with the previous award adjusted for inflation from FY21 and similar services provided within the VA during the past two fiscal years. The justification notes that as ceiling lifts reach end-of-service, the facility will review the market for comparable replacements and alternative service providers from other vendors to address competitive barriers in future acquisitions.
