About this file
This is a Justification and Approval (J&A) document for a sole source acquisition under the Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside authority. The Department of Veterans Affairs, Birmingham VA Medical Center (NCO 07) seeks to award a fixed-price supply purchase order for two Unity Vitreoretinal Cataract System (VCS) units (Part Number 900484665) to O.R. Elder, Inc., a certified SDVOSB. The acquisition is justified under 41 USC §3304(a)(5) and 38 U.S.C. § 8127(c), utilizing VAAR 819.7008 authority, which permits sole source awards to certified SDVOSBs up to $5,000,000. Specific pricing and extended amounts are redacted in the document.
The Unity VCS is required to replace an obsolete Alcon PHACO system that has been in service since 2018 and has become unreliable, experiencing failures during multiple procedures. Market research confirmed that the ALCON UNITY VCS possesses unique salient characteristics unavailable from any other manufacturer and represents the first integrated platform capable of performing both high-performance vitreoretinal and cataract surgeries. The justification establishes that no manufacturing competition exists and that dealer/distributor competition is not plausible due to inability to meet Non-Manufacturing Rule and Limitations on Subcontracting requirements. O.R. Elder, Inc. has been determined to be a responsible source, and pricing will be evaluated against historical pricing for similar equipment. The acquisition plan (36C247-26-AP-1551) received certification from Contracting Officer Jacob A. Tackett and approval from Senior Contracting Officer Joseph M. Locke.
