DEPARTMENT OF VETERANS AFFAIRS

FAR Part 6 – Determination for Limiting Sources (D&F) (<SAT)

Acquisition Plan Action ID: SLEEP LAB Plan 36C247-20-AP-4001

1. Contracting Activity: Department of Veterans Affairs, VISN 07, CAVHCS Contracting

2237: 619-20-3-490-0663

2. Description of Action: The Cardiopulmonary Service requires the utilization of a Sleep Lab Diagnostic System to support medical diagnosis for sleep disorders such as sleep apnea, periodic limb movement disorder, narcolepsy, restless legs syndrome, insomnia and nighttime behaviors like sleepwalking and REM sleep behavior disorder. This diagnostic study may be requirement for Veteran compensation and pension. The proposed action is intended for a brand name or equal firm-fixed-price (FFP) procurement.

3. Description of Supplies or Services:

The estimated value of the proposed action is $ 72,889.78

The vendor is to provide a solution to upgrade the current sleep lab unit which is currently inoperable. This will involve purchase, delivery, installation of an Alice 6 LDx Sleep Lab Unit or a comparable system for the Central Alabama Veterans Health Care System (CAVHCS), Cardiopulmonary Service. This effort includes all equipment, operational software, transportation, delivery, installation, set-up, labor and materials, testing and training, as well as the necessary oversight and supervision from the vendor.

4. Authority:

Pursuant to Federal Acquisition Regulation (FAR) Subpart 6.303-2, 11.104, 11.105, and 13.501 the following brand name requirement is being justified and approved as an exception to fair opportunity under the statutory authority FAR Subpart 6.302-1(c) entitled “Only one responsible source and no other supplies or services will satisfy agency requirements because the supplies or services ordered are unique or highly specialized”.

|_| An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A);

|_| Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; (FAR 8.405-6(a)(1)(i)(B));

|_| In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405-6(a)(1)(i)(C)); or

|X| Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)).

5. Rational/explanation to support cited authority:

Based on market research, it was determined that limited competition is available among authorized SDVOSB resellers for this brand name item. The Alice 6 LDx Sleep Lab system is unique because it offers an upgrade to the existing inoperable sleep lab system housed by CAVHCS while other solutions would require a complete replacement of the existing system. Philips is the only manufacturer to produce such a solution that is available on the commercial market. VA does not possess the proprietary technical knowledge of the inoperable hardware components to maintain and upgrade the current sleep lab system. This solution is advantageous to the government because it prevents substantial duplication in cost that are not expected to be recovered by competition.

6. Efforts made to ensure that offers are solicited from as many potential sources as is practicable:

During market research, requests for information were sent via email to all vendors listed on VIP, SBA, and GSA, under NAICS code 334510. In response 7 vendors stated that they had the ability to provide the Alice 6 solution or an equivalent item to CAVHCS. Therefore, this procurement will not be set-aside to one vendor as a sole source acquisition but will be set aside for SDVOSB concerns in an effort to fulfill the VA Rule of Two and permit competition to the maximum extent practicable.

7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:

The Contracting Officer anticipates to verify that the proposed action will be determined fair and reasonable by comparing received quotes to public price lists advertised on the manufacture’s website. Pricing and product information for the Alice 6 Sleep Lab LDx can be found at the following link: https://www.usa.philips.com/healthcare/solutions/sleep/sleep-diagnostics

8. Other facts supporting the use of other than full and open competition:

In addition to the aforementioned information the customer has stated that the Alice 6 LDx Sleep Lab system meets their needs for the following reasons:

a) All VA sleep techs at CAVHCS are familiar with the Alice system. Training would be minimal, trouble-shooting through the night will be familiar, report formatting and ongoing report updates would be easily done because again we are all familiar.

b) The technical support, hardware durability and quality of Philips products is perceived to be of better quality than that of the their competitors.

c) Software has a reputation of being easy to work with and minimal disruptions.

d) CAVHCS BioMed is confident the Alice6 system will connect with the current sleep lab network (server and review stations), and the current electrodes, probes, and thermistors will connect to the Alice6 system.

e) The Alice system has the devices to increase our service capabilities by including Home Sleep Apnea Testing and Actigraphy and all using the same software.

9. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition:

a) Firm 1: Veterans Healthcare Supply Solutions (SDVOSB)

b) Firm 2: First National Group (SDVOSB)

c) Firm 3. Trilla Med (SDVOSB)

d) Firm 4: POCUS Systems (SDVOSB)

e) Firm 5: US1 Supply LLC (SB)

f) Firm 6: Alliant Healthcare (SDVOSB)

g) Firm 7: Electra-Med Corporation (SDVOSB)

10. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:

In the future, any acquisition that is not for the procurement of unique or highly specified items will be competed to the maximum extent practicable.

11. Note: that this determination satisfies the requirements of FAR 6.303.

12. Certification: I certify that the supporting data under my cognizance, which are included in this justification, are accurate and complete to the best of my knowledge and belief.
