About this file

This document is a Standard Form 30 Amendment of Solicitation/Modification of Contract issued by the Department of Veterans Affairs Network Contracting Office 6 in Hampton, Virginia. The amendment addresses Presolicitation Notice 36C24626R0013, issued December 22, 2025, for Project 659-26-200 (B21 HVAC Upgrades and Roof Replacement). The amendment provides Government responses to questions submitted by potential offerors regarding professional licensing requirements and does not extend the SF 330 submission deadline.

The primary clarification concerns the requirement for Architect-Engineer (A-E) personnel to comply with North Carolina state licensing requirements. The Government confirmed that lead designers in each discipline must be registered professionals but do not need to hold North Carolina licensure at the time of SF 330 submission. Offerors may submit qualifications without active North Carolina licenses provided they commit to obtaining and maintaining all required North Carolina professional licenses prior to contract award and before signing or sealing design documents, in accordance with applicable North Carolina law and VA contract requirements. This response aligns with standard federal A-E procurement practices under the Brooks Act and FAR 36, where professional licensure is customarily required prior to performance and execution of design documents rather than as a condition of proposal submission.

Responses to Questions—Notice ID 36C24626R0013 Project 659-26-200, B21 HVAC Upgrades and Roof Replacement

Question 1:

The solicitation states that “the firm and/or A-E on staff representing the project must follow State of North Carolina guidelines under State law for all licensing requirements to sign and seal drawings.” We respectfully request confirmation as to whether active North Carolina professional licensure is required at the time of SF-330 submission, or whether licensure is required prior to contract execution and document sealing, which is consistent with typical federal Architect-Engineer procurement practice.

Under the Brooks Act and FAR 36, A-E firms are selected based on demonstrated qualifications and competence, with professional licensure customarily required prior to performance and execution of design documents—not as a condition of submission.

Requiring state licensure at the qualifications stage may unnecessarily limit competition and appears inconsistent with standard VA A-E solicitations, where licensure is obtained or finalized upon selection or prior to Notice to Proceed.

We respectfully request the Government consider clarifying or revising this requirement to allow otherwise fully qualified A-E firms to compete, provided they commit to obtaining and maintaining all required North Carolina professional licenses prior to contract award and document sealing.

Response:

For this Presolicitation Notice—Request for SF 330, Architect-Engineer Qualifications, the board shall consider the specific experience and qualifications (i.e., education, training, registration, certifications, overall relevant experience, and longevity with the firm) of personnel proposed for assignment to the project, and their record of working together as a team when evaluating professional qualifications. The lead designer in each discipline must be registered but does not have to be registered in the particular state where the project is located at the time of SF 330 submission.

Accordingly, offerors may submit qualifications without North Carolina licensure, provided they commit to obtaining and maintaining all required North Carolina licenses prior to award and before signing/sealing documents, in accordance with applicable North Carolina law and VA contract requirements.
