This document is a Standard Form 1449 (Solicitation/Contract/Order for Commercial Products and Commercial Services) issued by the Department of Veterans Affairs Network Contracting Office 6 for a medical simulation equipment requirement. The solicitation seeks to procure a Laerdal SimMan Essential Manikin and related equipment for the Durham VA Medical Center, with a total quantity of one (1) full-body manikin kit including a laptop, panel PC, portable router, installation, defibrillation training adapters, and associated software and accessories.

Key details include a solicitation issue date of 07-29-2025, quote submission deadline of 08-01-2025 at 05:30 PM EDT, and a proposed contract performance period from 08-05-2025 to 10-05-2025. ADDENDUM to FAR 52.212-4 CONTRACT TERMS AND CONDITIONS—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES Clauses that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available.

The following clauses are incorporated into 52.212-4 as an addendum to this contract:

C.1 VAAR 852.203-70 COMMERCIAL ADVERTISING (MAY 2018)

The Contractor shall not make reference in its commercial advertising to Department of Veterans Affairs contracts in a manner that states or implies the Department of Veterans Affairs approves or endorses the Contractor’s products or services or considers the Contractor’s products or services superior to other products or services.

(End of Clause) C.2 VAAR 852.215-70 SERVICE-DISABLED VETERAN-OWNED AND VETERAN-OWNED SMALL BUSINESS EVALUATION FACTORS (JAN 2023) (DEVIATION)

(a) In an effort to achieve socioeconomic small business goals, VA shall evaluate offerors based on their service-disabled veteran-owned or veteran-owned small business certification status and their proposed use of eligible certified service-disabled veteran-owned small businesses (SDVOSBs) and certified veteran-owned small businesses (VOSBs) as subcontractors.

(b) Eligible and certified service-disabled veteran-owned small businesses offerors will receive full credit, and offerors qualifying as veteran-owned small businesses will receive partial credit for the certified Service-Disabled Veteran-Owned and Veteran-Owned Small Business Status evaluation factor. To receive credit, an offeror must be listed at the time of submission of offers and at time of award, as a certified SDVOSB/VOSB in the SBA certification database on the SBA Veteran Small Business Certification Program portal at https://veterans.certify.sba.gov/ (see 13 CFR 128) and be otherwise eligible in accordance with SBA size standards for the acquisition and limitations on subcontracting requirements set forth in SBA regulations (see 13 CFR 121, 125 and 128.).

(c) Non-Veteran offerors proposing to use certified SDVOSBs or VOSBs as subcontractors will receive some consideration under this evaluation factor. Offerors must state in their proposals the names of the certified SDVOSBs and VOSBs with whom they intend to subcontract and provide a brief description of the proposed subcontracts and the approximate dollar values of the proposed subcontracts. In addition, the proposed subcontractors must be listed at the time of submission of offers and at time of award, as a certified SDVOSB/VOSB in the SBA certification database.

(d) Pursuant to 38 U.S.C. 8127(g), any business concern that is determined by VA to have willfully and intentionally misrepresented a company’s SDVOSB/VOSB status is subject to debarment for a period of not less than five years. This includes the debarment of all principals in the business.

(End of Clause)

C.3 VAAR 852.215-71 EVALUATION FACTOR COMMITMENTS (OCT 2019)

(a) The offeror agrees, if awarded a contract, to use the service-disabled veteran-owned small businesses (SDVOSBs) or veteran-owned small businesses (VOSBs) proposed as subcontractors in accordance with 852.215–70, Service-Disabled Veteran-Owned and Veteran-Owned Small Business Evaluation Factors, or to substitute one or more SDVOSBs or VOSBs for subcontract work of the same or similar value.

(b) Pursuant to 38 U.S.C. 8127(g), any business concern that is determined by VA to have willfully and intentionally misrepresented a company’s SDVOSB/VOSB status is subject to debarment for a period of not less than five years. This includes the debarment of all principals in the business.

Expenses incident to the examination and testing of materials or supplies that have been rejected will be charged to the Contractor.

(b) Perishable supplies. The Contractor shall remove rejected perishable supplies within 48 hours after notice of rejection. Supplies determined to be unfit for human consumption will not be removed without permission of the local health authorities. Supplies not removed within the allowed time may be destroyed. SECTION E - SOLICITATION PROVISIONS

ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES Provisions that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available.

The following provisions are incorporated into 52.212-1 as an addendum to this solicitation:

E.1 SPECIFIC INSTRUCTIONS TO OFFERORS AND EVALUATION CRITERIA

1. The Contractor shall submit one (1) copy of their quote in electronic format (PDF or MS Word) via email to daniel.spaulding@va.gov by Friday, August 1, 2025, 05:30PM EST. A complete quote shall include the following four (4) sections listed below:

Section I – QUOTE: Form (Standard Form 1449) – original signature and completed Contract Administration Data; DUNS Number and Solicitation complete with acknowledgement of any Solicitation Amendments that have been issued. Offerors shall complete FAR 52.225-2 Buy American Act Certificate and return it with their quote. Offerors shall indicate the country of origin of the product(s) being quoted. Offerors shall be compliant with the nonmanufacturer rule to be considered for award. The Contracting Officer may request additional information from an offeror to evaluate compliance.

Section II – PRICING: shall be submitted as requested in the Schedule of Supplies/Services comprised within the solicitation document listed in Section B of the SF1449 solicitation. Also provide a quote with separate line for labor/installation.

Section III - TECHNICAL FACTOR: Offerors shall itemize the specifications of the offered products sufficiently to allow the Government to evaluate the products against the salient characteristics provided in the solicitation. The offered products will be evaluated in comparison with the salient characteristics and other information provided in the solicitation to make a determination as to whether the quoted products and terms and conditions of the quote are technically acceptable. Offerors shall be compliant with the nonmanufacturer rule to be considered for award.

BASIS FOR AWARD:

The Government will award a firm fixed priced contract to the responsible offeror whose offer, conforming to the requirements in this request for quote, will be most advantageous to the Government if the evaluation process identifies a quote suitable for award. The Government will perform a comparative analysis of the submitted quotes in accordance with FAR 13.106-2(b)(3). The Government will evaluate the technical factor, past performance, Socioeconomic Status and Usage, and price. By submission of its quote, the offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. The Government intends to make a best value decision that may result in a quote other than the lowest priced quote being selected.

Factor 1: Technical Factor Offerors shall itemize the specifications of the offered products sufficiently to allow the Government to evaluate the products against the salient characteristics provided in the solicitation. The offered products will be evaluated in comparison with the salient characteristics and other information provided in the solicitation to determine whether the quoted products and terms and conditions of the quote are acceptable (equivalent in form and functionality). Responsive quotes will be compared to identify which quote provides the best value to the Government, considering the specifications, terms and conditions. Offerors shall be compliant with the nonmanufacturer rule to be considered for award.

Factor 2: Past Performance Past performance information identified in the Contract Performance Assessment Reporting System (CPARS) will be utilized to determine the quality of the offeror’s past performance as it relates to the probability of success of the required effort. The Government will evaluate customer satisfaction, responsiveness to customer needs, and past demonstration of meeting delivery schedules and the delivery schedules and the delivery of services. Emphasis will be on recent, relevant past performance within the last three (3) calendar years. Recent is defined as work performed within the last three years. Relevant is defined as work similar in size and scope of the work described in the Statement of Work (SOW).

Quoters with no relevant past performance or whom information is not available, shall not be evaluated favorably or unfavorably on past performance, but may be considered less favorably than a quoter with favorable performance history.

Factor 3: Price Prices shall be submitted in accordance with the Price Schedule contained in the Solicitation. Total price will be evaluated by the Government. In evaluating the quoter’s proposed price for this project, the Government concern includes determining fairness and reasonableness of the price.

Reasonableness determinations will be made on the basis of competitive quotes received, by comparing proposed cost/price with established commercial prices, other contract vehicles, and/or by comparing prosed cost/price with the Independent Government Cost Estimate (ICGE). The ICGE is not releasable to the public.

Factor 4: Buy American Act The evaluation procedures at FAR Subpart 25.5 - Evaluating Foreign Offers-Supply Contracts, and specifically 25.106(b)(1), will be utilized when evaluating offers for purposes of the Buy American Act and preference for domestic end products. This requirement is also subject to the Israeli Free Trade Act, so offers will also be evaluated in accordance with FAR 25.406 Israeli Trade Act.

Factor 5: Socioeconomic Status and Usage VA recognizes the contributions of our Nation’s veterans, and we strive to make contract awards to small businesses owned by veterans and service-disabled veterans. In an effort to achieve socioeconomic small business goals, VA will evaluate offerors based on their service-disabled veteran-owned small business (SDVOSB) or veteran-owned small business (VOSB) status, and their proposed use of eligible service-disabled veteran-owned small businesses and veteran-owned small businesses as subcontractors. Eligible service-disabled veteran-owned (SDVOSB) offerors will receive full credit, and offerors qualifying as veteran-owned small businesses (VOSB) will receive partial credit for this Service-Disabled Veteran-Owned and Veteran-Owned Small Business Status evaluation factor.

To receive evaluation credit, an offeror must be certified in SBA Dynamic Small Business Search Engine (DSBS) (https://dsbs.sba.gov/search/dsp_dsbs.cfm). Uncertified SDVOSBs or VOSBs will not receive any evaluation credit for the sake of this evaluation factor.

Non-veteran offerors proposing to use service-disabled veteran-owned small businesses or veteran-owned small businesses as subcontractors in proportions which meet or exceed the VA subcontracting goals for these firms (regardless of business size) will receive the lowest amount of credit under this evaluation factor. Offerors must state in their proposals the names of the SDVOSBs and VOSBs with whom they intend to subcontract and provide a brief description of the proposed subcontracts and the approximate dollar values of the proposed subcontracts. In addition, the proposed subcontractors must be certified in the SBA Dynamic Small Business Search Engine (DSBS) as an SDVOSB.

SDVOSB offerors will be weighed higher than VOSB offerors, if proposals are considered technically equal considering all factors and quoted prices are significantly balanced. Non-veteran offerors which use no SDVOSB or VOSB as subcontractors shall receive no credit under this evaluation factor. The following weights will be used:

a. SDVOSB offerors – Evaluation price downward adjustment equal to 10% of the offeror’s Total Proposed Price used for evaluation purposes only. Offerors shall be compliant with the nonmanufacturer rule to be considered for award.

b. VOSB offerors – Evaluation price downward adjustment equal to 5% of the offeror’s Total Proposed Price used for evaluation purposes only. Offerors shall be compliant with the nonmanufacturer rule to be considered for award.

c. Offers w/ SDVOSB or VOSB subcontractors – NOT APPLICABLE. This supply requirement solicitation is not anticipated to result in subcontracting opportunities.

System for Award Management: Federal Acquisition regulations require that federal contractors register in the System for Award Management (SAM) data base at http://www.sam.gov and enter all mandatory information into the system. Offerors shall have an active registration in the System for Award Management at the time of quote submission and shall maintain an active registration throughout the evaluation phase and contract award.

TECHNICAL QUESTIONS: Offerors shall submit all technical questions regarding this solicitation to the Contracting Officer in writing on or before 05:30PM Eastern Time on Wednesday, July 30, 2025. Questions may be sent via e-mail to daniel.spaulding@va.gov. Telephonic (verbal) questions Will Not be addressed. All responses to questions, which may affect quotes, will be incorporated into a written amendment to the Request for QUOTES. All QUOTES shall be submitted by the date listed in Block 8 of SF 1449 via email to daniel.spaulding@va.gov.

E.2 52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021) The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it ‘‘does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument’’ in paragraph (c)(1) in the provision at 52.204–26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212–3, Offeror Representations and Certifications–Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it ‘‘does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services’’ in paragraph (c)(2) of the provision at 52.204–26, or in paragraph (v)(2)(ii) of the provision at 52.212–3.

(a) Definitions. As used in this provision— Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204–25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
