Justification and Approval (J&A) For
Other Than Full and Open Competition
Acquisition Plan Action ID: 36C246-25-AP-0300
1. Contracting Activity: Department of Veterans Affairs, VISN 06, Hampton VA Medical Center, 100 Emancipation Drive, Hampton, VA 23667.
2. Nature and/or Description of the Action Being Processed: This is an Emergency Sole Source Procurement to obtain Construction Services for the construction of a temporary parking lot for the Asheville VAMC to minimize operational impacts resulting from Hurricane Helene.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: In response to Hurricane Helene, the Western North Carolina VA Healthcare System (WNCVAHCS) activated numerous emergency assets including water tanker trucks, DEMPS berthing, showers, restrooms, and laundry trailers, and Emergency Well Drilling. The space required for these assets has caused the need for a temporary gravel parking lot. WNCVAHCS is requesting the immediate approval of this project to install the temporary gravel lot in front of Bldg 9 along Riceville Road. The VAMC Asheville campus currently receives up to 12 water tankers per day staging in two different parking lots. This has resulted in the loss of the usage of approximately 250 parking spaces spread over the two separate lots involved with this work. Additional work in support of hurricane recovery involves drilling emergency water wells in several areas on campus to develop a water supply independent of outside systems. As the drill rig and its support vehicle move from one spot to the next, their collective footprint typically requires the shut down and delineation of upwards of 50 parking spaces, further limiting the parking availability of both patients requiring medical services and medical center staff ability to report to work.

4. Statutory Authority Permitting Other than Full and Open Competition:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Brie Enterprises dba.
Bigfoot Paving is a certified Women Owned Small Business that is located in the immediate area capable and able to immediately mobilize to respond to this emergent need. The Contractor was initially contacted by the Asheville VAMC due to their proximity to the Medical Center. Bigfoot Paving has already assessed the project in when they immediately reported to the site and are swiftly preparing a proposal for submission. Furthermore, the contractor has provided assurances to the Contracting Officer can immediately mobilize to begin performance and complete the project within 2 weeks.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: None. This is an emergency requirement to restore and maintain the operational status of the Asheville VA Medical Center. Any additional delay for standard acquisition practices could result in detriment to the existing patient populace, staff and the US Government.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The Contracting Officer anticipates that a fair and reasonable price that represents the overall best value to the government shall be obtained prior to any subsequent contract award.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: None. This is an emergency requirement to restore and maintain the operational status of the Asheville VA Medical Center. Any additional delay for standard acquisition practices could result in detriment to the existing patient populace, staff and the US Government.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
None
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
None. This is an emergency requirement to restore and maintain the operational status of the Asheville VA Medical Center. Any additional delay for standard acquisition practices could result in detriment to the existing patient populace, staff and the US Government.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
13. Approvals in accordance with the VHAPM Part 806.3 OFOC SOP:
