Question & Answers
Question #1: Grey Market material is prevalent in the mobile imaging industry as a means to provide cheap services. The most common practice is when a company removes a scanner from a fix site, then installs the scanner in an old used trailer often needing major repairs. At this point, OEM’s will not service the system and often the system is not built to be installed in a mobile platform (FDA violation).
Parts are old and often untested. Image quality suffers, scanner limitations are constant, and downtime is through the roof. I respectfully request that Grey Market language be added to the contract language as an addendum. That being said the language on page 10 section 3, “Equipment shall include but not be limited to a Contractor furnished fully equipped OEM approved PET/CT Mobile” (confusing). Can you require OEM documentation for the mobile scanner is OEM approved?
Answer #1: The verbiage “but not be limited too” found on page 10 section 3 has been removed to eliminate confusion. VAAR Clause 852.212-71 Gray Market & Counterfeit Items (FEB 2023) below was unintentionally left off and has been added.
VAAR 852.212-71 GRAY MARKET AND COUNTERFEIT ITEMS (FEB 2023)
(a) No used, refurbished, or remanufactured supplies or equipment/parts shall be provided. This procurement is for new Original Equipment Manufacturer (OEM) items only. No gray market items shall be provided. Gray market items are OEM goods intentionally or unintentionally sold outside an authorized sales territory or sold by non-authorized dealers in an authorized sales territory.
(b) No counterfeit supplies or equipment/ parts shall be provided. Counterfeit items include unlawful or unauthorized reproductions, substitutions, or alterations that have been mismarked, misidentified, or otherwise misrepresented to be an authentic, unmodified item from the original manufacturer, or a source with the express written authority of the original manufacturer or current design activity, including an authorized aftermarket manufacturer. Unlawful or unauthorized substitutions include used items represented as new, or the false identification of grade, serial number, lot number, date code, or performance characteristics.
(c) Vendor shall be an OEM, authorized dealer, authorized distributor, or authorized reseller for the proposed equipment/system, verified by an authorization letter or other documents from the OEM. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions.
End of Clause
Question #2: Does the VA require OEM maintenance/support for PET/CT scanner? If not what does the
VA require to show the scanner is properly maintained and most importantly is upgraded with the latest software releases?
Answer #2: Yes, VA does require OEM maintenance/support for PET/CT scanners.
Question #3: When referencing the bid, the term technologist is used. Can we assume that the spec is a minimum of two certified PET/CT technologists are always required on the van?
Answer #3: Yes, under section 12 sub-paragraph a. of the PWS states: “Contractor shall be responsible for providing the two qualified PET/CT Scanning Technologist(s) to perform services defined herein”.
Solicitation has been updated replace the word “qualified PET/CT technologists” with “certified
PET/CT technologist”.
