2. Description of Action:

The procurement method will be for other than full and open competition for the purchase of Draeger Anesthesia workstations to add to our existing fleet of Draeger Anesthesia workstations.

3. Description of Supplies or Services:

The estimated value of the proposed action is $ 202,829.30

The Salem Veterans Affairs Medical Center wishes to purchase two (2) Draeger Atlan anesthesia workstations to increase the number of Draeger anesthesia machines in our existing fleet. It is the intention of the Anesthesia department to standardize on the same anesthesia machine (in this case, Draeger) and to have the same standard of care throughout the operating rooms and all remote anesthetizing locations. This is to assure standardization of user interface for patient safety purposes.

The Atlan A350 has been selected both because is part of the Draeger family of anesthesia machines and because it is the latest and most technologically advanced anesthesia machine on the market. The Atlan A350 is the newest member of the Draeger anesthesia family and like all Draeger anesthesia machines, has the same user interface and uses the same parts and supplies.

4. Authority:

Order Against FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception:

5. Rationale/explanation to support cited authority:

The Draeger integrated anesthesia workstation is the anesthesia system currently in use at VAMC Salem. A Draeger integrated anesthesia workstation is composed of anesthesia machine, anesthesia monitor and ARK.

Brand name Draeger is required for each component of the integrated system to ensure ongoing interoperability. Software releases for all these Draeger anesthesia components are synchronized and tested prior to general market release, therefore assuring compatibility and interoperability.

Interoperability of the existing systems is a critical element that ensures the reliable delivery of health care services to our Veterans. In addition, VAMC Salem anesthesia personnel are already proficient at using the Draeger anesthesia systems. The existing fleet of Draeger integrated anesthesia workstations will be retained, making standardization of anesthesia systems at VAMC Salem important for the following reasons:

Clinical utilization and supplies: VAMC Salem clinical staff are already trained on how to properly utilize Draeger anesthesia workstation systems. All models of Draeger anesthesia machines use the same user interface. Changing brands of manufacturer would require clinical staff throughout the hospital to learn how to use two different brands of Anesthesia units, which is a patient safety risk.

Maintenance: By procuring another manufacturer’s brand of anesthesia system, the VAMC Salem Biomedical Engineering department would need to train biomedical support specialists on how to maintain/repair another manufacturer’s anesthesia system. In addition, Biomedical Engineering would need to keep a second set of maintenance parts and supplies on inventory. This would increase financial costs to support anesthesia systems as a whole and would be an unnecessary burden.

Draeger is the only manufacturer of the Draeger Anesthesia System. Draeger is the only company that has manufacturing rights and access to the software code. It is proprietary and available only through Draeger Inc

6. Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
