B.2 STATEMENT OF WORK

The Department of Veterans Affairs currently needs to procure and install an exhaust fan with associated materials to increase negative air exchange to 10 Air Changes per Hour (ACH) in the Sterile Processing Department (SPD) room D2010E in Building 1 at the Durham Veterans Affairs Health Care System (VAHCS), 508 Fulton St, Durham, NC 27705, in accordance with the terms and conditions herein.

PERIOD OF PERFORMANCE: The expected period of performance is 45 calendar days.

1. STATEMENT OF WORK: The Contractor shall provide all transportation, materials, parts, tools, specialized equipment, HEPA carts, labor, supervision, quality control, and technical expertise to procure and install an exhaust fan with associated materials that serve SPD room D2010 to increase negative air exchange to 10ACH. The window will need to be removed in D2010F to install a louver and panel for the exhaust. This is a turn-key request, with the Contractor providing all the parts and performing all the work.

a. Provide and install 1-1400CFM (Cubic Feet per Minute) exhaust fan with speed control.

b. Remove window from D2010F.

c. Provide and install a new louver and panel.

d. Provide duct to exhaust air from D2010.

e. SPD room D2010E is considered a clean space, and all maintenance activities must follow an Infection Control Risk Assessment (ICRA) evaluation. This evaluation will include the use of plastic ICRA containment barriers and a HEPA cart(s) if needed. The contractor must supply and install all barriers.

f. Run 120V power for a new fan, pulled off VA-provided breaker.

g. Start and adjust the fan to satisfy the negative 10 air exchange requirement.

h. Air exchange report showing at least 10 air changes per hour to be provided.

i. All installed parts and materials shall be new.

j. All outage requests shall be coordinated with the Contracting Office Representative (COR) and submitted four (4) weeks before approval.

k. All work and testing shall be performed according to the attached specifications.

l. Accident Hazard Analysis (AHA) and/or Accident Prevention Plan (APP) will be submitted and approved prior to work activities.

m. All welding, soldering, and braising will require a Hot Work Permit, which can be obtained from the VA Safety Department.

Hours of Operation: Work activity can be completed during normal business hours. Outages must be scheduled outside of normal business hours unless authorized by the COR during normal business hours. Our normal business hours are 0730am until 4:00 pm Monday through Friday, excluding Federal holidays and any other day expressly declared by the President of the United States. Federal holidays are available at the Federal Holiday OPM Site. For working outside the hours as defined in this contract, the vendor shall give 3-day notice to the Contracting Officer Representative so that arrangements can be provided for the employees. This notice is separate from any notices required for utility shutdown described later in this section. All work must be coordinated around an operational medical center to minimize impact on patient care.

2. COORDINATION: The contractor will coordinate with the Contracting Officer’s Representative (COR), the facility operations specialist’s supervisor, and the pipe shop supervisor, with input from the COR.

a. The Contractor shall work with the COR.

b. Outage requests shall be submitted for approval four (4) weeks before the requested date.

c. Operations personnel shall secure and formally lockout utilities as needed. The contractor shall install their lockout tagout (LOTO) on the multi-lock devices and provide documentation to the COR.

d. The Federal Government shall not provide tools, parts, materials, or equipment. This is a turn-key project, with the vendor providing all necessary tools, parts, materials, and equipment.

3. GENERAL:

a. All contract field personnel engaged in work on this project shall be trained in accordance with current regulations and enrolled in a medical monitoring program. Training shall include 40-hour and annual update training in compliance with OSHA and EPA regulations.

b. The contractor shall provide a safety plan for roof work that must be approved by the VA safety office prior to the work being performed. An Accident Hazard Analysis (AHA) and Accident Prevention Plan (APP) are also required.

c. The contractor’s employees shall not enter the work site without appropriate identification. They may also be subject to inspection of their personal effects when entering or leaving the project site.

d. The Contractor shall be responsible for ensuring that all the employees and other personnel visiting the work site have and are using the appropriate Personal Protective Equipment (PPE) that addresses the hazards found at the site. The Contractor shall be responsible for the upkeep, issue, and training for the PPE used and maintaining all required documentation.

e. Execute work to interfere as little as possible with the normal functioning of the hospital, including operations of utility services, fire protection systems, and any existing equipment, and with work being performed by others. Equipment and tools that transmit vibrations and noises through the building structure are not permitted in buildings occupied jointly by patients or medical personnel and the Contractor’s personnel, except as permitted by COR where required by limited working space. All work interfering with the medical center operation will be completed during off-tour hours (outside normal business hours).

f. No utility service such as water, gas, steam sewers or, electricity, or fire protection systems and communications systems may be interrupted without prior approval of COR. Electrical work shall be accomplished with all affected circuits or equipment de-energized. When an electrical outage cannot be accomplished, work on any energized circuits or equipment shall not commence without the Medical Center Director’s prior knowledge and written approval.

g. The Durham VAHCS reserves the right to cease or shut down any work in progress and order the vendors' employees off the premises in the event of a national emergency. The Durham VA HCS also reserves the right to cease work when required by operational necessity or a safety situation. The COR shall immediately notify the CO of any such action.

h. Site and Building Access: Maintain free and unobstructed access to facility emergency services and for fire, police, and other emergency response forces in accordance with NFPA 241.

i. Means of Egress: Do not block exiting for occupied buildings, including paths from exits to roads. Minimize disruptions and coordinate with COR.

j. Buildings shall be occupied during the performance of work. The contractor shall take all measures and provide all material necessary for protecting existing equipment and property in affected areas against dust and debris so that equipment and affected areas to be used in the Durham VAHCS operations shall not be hindered. Coordinate alteration work in areas occupied by the Department of Veterans Affairs so that Durham VAHCS operations continue during installation.

k. The contractor shall maintain neat and orderly work areas, clean the area of debris and rubbish daily, and dispose of waste materials offsite per hospital policies. The contractor shall provide a dumpster if necessary and shall work with the COR in advance for a spot-on site to establish the dumpster.

l. All work shall be performed in full accordance with applicable local and Federal regulations. All materials and installations shall conform to the recommendations of the National Fire Protection Association (NFPA), plumbing, and mechanical codes. No departures from specification requirements shall be permitted without written approval. The Supplier shall use good safety practices while working. All hardware should be installed to minimize damage and maximize patient and employee safety.

m. New work shall be installed and connected to existing work safely and professionally. Disturbed or damaged work shall be replaced or repaired to its prior conditions.

n. All items furnished shall be free from defects that would adversely affect the performance, maintainability, and appearance of individual components and overall assembly.

o. Where the Government determines that the vendor has installed equipment that is not conveniently accessible for operation and maintenance, equipment shall be removed and reinstalled, or remedial action shall be performed as directed at no additional cost to the Government.

p. Hot Work: Perform and safeguard hot work operations in accordance with NFPA 241 and NFPA 51B. Obtain daily permits from the facility Safety Manager at least 24 hours in advance.

q. Welders must also be process qualified under the American Society of Mechanical Engineers (ASME) Section IX and shall provide proof of certification.

r. Contractor and sub-contractor personnel shall be subject to the same Federal laws, regulations, standards, and VA Directives and Handbooks as VA personnel regarding information and information system security.

s. This is a federal facility and a medical center. As such, smoking is NOT allowed on Federal property. Failure to follow these regulations can result in removing the worker or Contractor from the facility and/or a US Magistrate’s ticket and fine.

t. Payment of stored materials will be in accordance with the FAR. Stored materials will not be reimbursed until materials have been installed and approved by the Contracting Officer. The Contracting Officer and Chief of Engineering Service must pre-approve all stored materials. Storage of materials at the Durham VA Medical Center is not guaranteed. Offsite storage shall be accounted for in the Contractors’ Response.

C.2 VAAR 852.203-70 COMMERCIAL ADVERTISING (MAY 2018)

The Contractor shall not make reference in its commercial advertising to Department of Veterans Affairs contracts in a manner that states or implies the Department of Veterans Affairs approves or endorses the Contractor’s products or services or considers the Contractor’s products or services superior to other products or services.

(End of Clause) C.3 VAAR 852.215-70 SERVICE-DISABLED VETERAN-OWNED AND VETERAN-OWNED SMALL BUSINESS EVALUATION FACTORS (JAN 2023) (DEVIATION)

(a) In an effort to achieve socioeconomic small business goals, VA shall evaluate offerors based on their service-disabled veteran-owned or veteran-owned small business certification status and their proposed use of eligible certified service-disabled veteran-owned small businesses (SDVOSBs) and certified veteran-owned small businesses (VOSBs) as subcontractors.

(b) Eligible and certified service-disabled veteran-owned small businesses offerors will receive full credit, and offerors qualifying as veteran-owned small businesses will receive partial credit for the certified Service-Disabled Veteran-Owned and Veteran-Owned Small Business Status evaluation factor. To receive credit, an offeror must be listed at the time of submission of offers and at time of award, as a certified SDVOSB/VOSB in the SBA certification database on the SBA Veteran Small Business Certification Program portal at https://veterans.certify.sba.gov/ (see 13 CFR 128) and be otherwise eligible in accordance with SBA size standards for the acquisition and limitations on subcontracting requirements set forth in SBA regulations (see 13 CFR 121, 125 and 128.).

(c) Non-Veteran offerors proposing to use certified SDVOSBs or VOSBs as subcontractors will receive some consideration under this evaluation factor. Offerors must state in their proposals the names of the certified SDVOSBs and VOSBs with whom they intend to subcontract and provide a brief description of the proposed subcontracts and the approximate dollar values of the proposed subcontracts. In addition, the proposed subcontractors must be listed at the time of submission of offers and at time of award, as a certified SDVOSB/VOSB in the SBA certification database.

C.4 VAAR 852.215-71 EVALUATION FACTOR COMMITMENTS (OCT 2019)

(a) The offeror agrees, if awarded a contract, to use the service-disabled veteran-owned small businesses (SDVOSBs) or veteran-owned small businesses (VOSBs) proposed as subcontractors in accordance with 852.215–70, Service-Disabled Veteran-Owned and Veteran-Owned Small Business Evaluation Factors, or to substitute one or more SDVOSBs or VOSBs for subcontract work of the same or similar value.

(b) Pursuant to 38 U.S.C. 8127(g), any business concern that is determined by VA to have willfully and intentionally misrepresented a company’s SDVOSB/VOSB status is subject to debarment for a period of not less than five years. This includes the debarment of all principals in the business.

C.5 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2018)

(a) Definitions. As used in this clause—

(1) Contract financing payment has the meaning given in FAR 32.001;

(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;

(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;

(4) Invoice payment has the meaning given in FAR 32.001; and

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI).

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for—

Material shall be packed for shipment in such a manner that will insure acceptance by common carriers and safe delivery at destination. Containers and closures shall comply with regulations of carriers as applicable to the mode of transportation.

C.8 VAAR 852.246-71 REJECTED GOODS (OCT 2018)

(a) Supplies and equipment. Rejected goods will be held subject to Contractor’s order for not more than 15 days, after which the rejected merchandise will be returned to the Contractor’s address at the Contractor’s risk and expense. Expenses incident to the examination and testing of materials or supplies that have been rejected will be charged to the Contractor.

(b) Perishable supplies. The Contractor shall remove rejected perishable supplies within 48 hours after notice of rejection. Supplies determined to be unfit for human consumption will not be removed without permission of the local health authorities. Supplies not removed within the allowed time may be destroyed. The Department of Veterans Affairs will not be responsible for, nor pay for, products rejected. The Contractor will be liable for costs incident to examination of rejected products.

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

Offer submissions shall be assembled in the following Sections: each section shall be easily identified.

Section A - Offer Form (Standard Form 1449) Signed and dated, include the North American Industry Classification System (NAICS) code and small business size standard in Block 10. The System for Award Management (SAM) Unique Entity Identification (UEI) Number shall be entered in the block with the Offeror's name and address.

Section B – Pricing Pricing shall be submitted on Attachment A, Price/Cost Schedule, and on a quote. Complete the attached Excel spreadsheet as well. The following fields require completion on the attachment. Do not change the format or add/delete any Excel spreadsheet columns.

Section C– Offerors Representations and Certifications A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically). An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically at www.sam.gov/portal/public/SAM/.

FAR 4.1102(a) mandates that offerors/quoters be registered in SAM.gov when submitting proposals/quotes in response to a solicitation; and (2) FAR 52.204-7(b)(1) further requires offerors to register in SAM.gov at the time of offer/quote submission and maintain active registration until contract award, completion of the performance, and final payment.

Failure to submit a complete proposal may result in a technically unacceptable determination.

2. AMENDMENTS

Amendments to this solicitation will be posted on https://sam.gov/. Paper copies of the amendments will NOT be individually mailed. By registering to receive notifications on https://sam.gov/, offerors will be notified by email of any new amendments that have been issued. No other notifications of amendments will be provided. Potential Offerors are advised that they are responsible for obtaining and acknowledging any amendments to the solicitation. Failure to acknowledge an amendment may result in your quote being considered unacceptable.

3. AWARD BASIS

This procurement is conducted under FAR Part 13 Simplified Acquisitions Procedures. The Government intends to award a contract resulting from this solicitation to the responsible offeror whose quote: conforms to the salient characteristics, quotes the lowest price, whose quoted price does not exceed the amount of funding available for the procurement, and whose quoted price is found to be reasonable. The basis for the award is Price ONLY.

4. TECHNICAL QUESTIONS
