DESCRIPTION: This is a Special Notice for the establishment of an Architect-Engineering (A-E) contract with services to be performed at the Fayetteville VA Medical Center at 2300 Ramsey St., Fayetteville, NC 28301. This requirement is being executed under a 100% Set-Aside to Service-Disabled Veteran Owned Small Business (SDVOSB) firms. THIS ANNOUNCEMENT IS NOT A REQUEST FOR PROPOSAL; NO SOLICITATION PACKAGE WILL BE ISSUED UNTIL AFTER AN EVALUATION HAS BEEN MADE ON THE PROVIDED SF-330s. The SF-330 can be downloaded through the GSA Forms Library at: Forms | GSA (Form name or number: enter SF330, click on the hyperlink titled, “Architect-Engineer Qualifications.”) Interested firms should submit their current SF-330, Parts I and II, to Angelo.Harris@va.gov . The SF-330s are due no later than 10:00 AM, EST, November 2, 2023.
SCOPE OF WORK: This project requires the services of an architectural engineering firm (AE) having special knowledge of hospital design. This project will engage an Architectural Engineering (A/E) firm to provide a Memorandum of Agreement, Conceptual Drawings, Contract Drawings, Functional Layouts, Specifications, Construction Cost Estimates, Template Construction Schedule, draft submittal register, Engineering Calculations, and subsequent Construction Period Services during refurbishing of Elevators. The Design team is responsible for coordinating with the Contracting Officer’s Representative (COR) and appropriate VA personnel to determine a plan for the new building(s).
INTENT: The Department of Veterans Affairs, Fayetteville Veterans Administration Medical Center (VAMC), is seeking Service-Disabled Veteran Owned Small Business sources and intends to award a firm fixed-price contract for Architect/Engineering (A/E) firm to provide services for Project # 565-24-105, “Refurbish D-wing Elevators” located at 2300 Ramsey St., Fayetteville 28301.
REQUIREMENTS: See Attached Statement of Work for Full Details
OFFERORS WILL BE EVALUATED ON THE FOLLOWING CRITERIA:
The submitted SF-330s will be evaluated on the following criteria:
The selection criteria are listed in order of importance.
This acquisition will be in accordance with FAR Part 36.602-1 and VAAM Part M836.602-1.
The A/E must demonstrate its qualifications with respect to the published evaluation criteria for all services.
The Department of Veterans Affairs shall evaluate each potential contractor in terms of the following as “M” firm meeting the synopsized selection criterion and "NM" means that the firm did not meet the synopsized selection criterion.
(1) Professional qualifications necessary for satisfactory performance of required services;
(2) Specialized experience and technical competence in the type of work required, specifically elevator maintenance and renovations.
(3) Capacity to accomplish the work in the required time for both the prime and subconsultants.
(4) Past performance on contracts with Government agencies and private industry in terms of cost control, quality of work, and compliance with performance schedules in a hospital setting.
(5) Construction Period Services
(6) Record of significant claims against the firm
(7) Utilization of SDVOSB firms.
(8) Location (tiebreaker) Google Maps Criterion 1 - Professional qualifications necessary for satisfactory performance of required services showing recent experience of the project team with comparable hospital projects within the past five years in which the construction has been completed. Offerors will be evaluated in terms of the qualifications, competence and experience of the key personnel and technical team proposed to accomplish this work. Key personnel are individuals who will have major contract or project management responsibilities and/or will provide a balanced, licensed, and or certified workforce in the following disciplines – Architectural, Electrical, Mechanical, and Structural.
Submission requirements: Provide resumes for all proposed key personnel. Resumes are limited to one page each and should cite project specific experience and indicate proposed role in this contract. Provide professional registration, certification, licensure and/or accreditation. Indicate participation of key personnel in example projects in the SF-330 Part 1 Section G. Each resume shall include a minimum of two (2) specific completed projects through construction. Firm shall provide a table of a minimum of 5 comparable projects comparing their estimate with the bid/award amount during construction.
Criterion 2 - Specialized experience and technical competence in the type of work required, including, where appropriate, experience specifically elevator maintenance and renovations. Offerors will be evaluated on specialized experience and technical competence in the performance of services like those anticipated under this contract about:
• Special knowledge of elevator maintenance and renovation.
• Experience working in and around an operational Hospital.
• Specific experience and qualifications of personnel proposed for assignment to the project and their record of working together as a team.
Submission requirements: Provide a minimum of three (3) not to exceed five (5) projects completed through construction within the past five (5) years that best illustrate specialized experience of the proposed team in the areas outlined above. Example projects shall note project’s square footage. All projects provided in the SF-330 must be completed by the office/branch/regional office/individual team member proposed to manage and/or perform work under this contract. To enable verification, firms should include the Unique Entity ID number along with each firm name in the SF-330 Part 1, Section F Item 25 “Firms from Section C Involved in this Project,” block (1). Include a contract number or project identification number in block 21. Include an e-mail address and phone number for the point of contact in block 23(c). Include in the project description, the contract period of performance, award contract value, current contract value, and summary of the work performed that demonstrates relevance to specialized experience as outlined above. If the contractor served as a subcontractor on a project, indicate the value of the work they provided towards the performance of the overall project. If a project was performed by a joint venture, and not all joint venture partners are on the team proposed for this contract, the offeror/team should specifically address the work performed by the joint venture partner offering/teaming on this contract. Likewise, if the offeror/team member worked as a subcontractor on a project, the description should clearly describe the work performed by the offeror/team member and the roles and responsibilities of each on the project, rather than the work performed on the project as a whole. If the project description does not clearly delineate the work performed by the entity/entities offering/teaming on this contract, the project could be eliminated from consideration. Additionally, Firms are required to return and submit the Attachment B titled Criterion 2 Format, which will clearly demonstrate specific experiences and qualifications of personnel proposed for assignment to the project and their record of working together as a team. Specifically list similar scoped projects covering the previous 5 years and clearly show participation. (See SF330 Part I Section G (Matrix), but not excluding other information provided on the SF330 and supporting documentation.)
NOTE: If the Offeror is a joint venture, information should be submitted as a joint venture; however, if there is no information for the joint venture, information should be submitted for either joint venture partner, not to exceed a total of five (5) projects for this criterion. Projects shall be submitted on the SF330. For submittal purposes, a task order on an IDIQ contract is considered a project, as is a stand-alone contract award. Do not list an IDIQ contract as an example of a completed project. Instead, list relevant completed task orders or stand-alone contract awards that fit within the definition above. Examples of project work submitted that do not conform to this requirement will not be evaluated.
Failure to provide requested data, accessible points of contact, or valid phone numbers could result in a firm being rated lower.
All information for Criterion 2 should be submitted in Part 1, Section F of the SF-330. The Government WILL NOT consider information submitted in addition to Part 1, Section F in evaluating Criterion 2.
Criterion 3 - Capacity to accomplish the work in the required time for both the prime and subconsultants. This factor evaluates the ability of the firm, given their current projected workload (percentage) and the availability of their key personnel, to accomplish the possible myriad of design projects in the required time. The general workload and staffing capacity of the design office will be evaluated.
Submission requirements:
I. List current projects with a design fee of greater than $200,000 being designed in the firms’ office.
II. II. Indicate the firms’ present workload and the availability of the project team (including sub-consultants) for the specified contract performance period.
III. III. Describe experience in successfully delivering projects per performance schedule, providing timely construction support, and successfully completing multiple projects with similar delivery dates.
IV. IV. Volume of VA contract awards in the last 12 months.
Criterion 4 – Past Performance – Offerors will be evaluated on past performance with Government agencies and private industry in terms of work quality, compliance with schedules, cost control, and stakeholder/customer satisfaction. Evaluating past performance and experience will include information provided in Past Performance Questionnaires (PPQs) or CPARS/ACASS for Criterion 2 projects and may include other information provided by the firm, customer inquiries, Government databases, and other information available to the Government including contacts with points of contact in other criteria. Failure to provide requested data, accessible points of contact, or valid phone numbers could result in a firm being rated lower. NOTE: Past performance information for projects listed under Criterion 2.
Project Recency: A project will be considered recent only if performance was completed within five (5) years of the date of issuance of this public announcement. Ongoing projects will not be considered as no accurate performance record can exist for work not yet completed.
Relevancy is defined as performance of work on projects that are similar in scope to the types of projects anticipated under the resultant contracts.
Submission requirements: SUBMIT A COMPLETED AND CURRENT (MOST RECENT) CPARS/ACASS EVALUATION FOR EACH PROJECT UNDER CRITERION 2. IF THERE IS NOT A COMPLETED CPARS/ACASS EVALUATION, the Past Performance Questionnaire (PPQ) included in this notice is provided for the offeror or its team members to submit to the client for each project the offeror includes under Criterion 2. AN OFFEROR SHALL NOT SUBMIT A PPQ WHEN A COMPLETED CPARS/ACASS IS AVAILABLE. IF A CPARS/ACASS EVALUATION IS NOT AVAILABLE, ensure correct phone numbers and email addresses are provided for the client point of contact. Submit no less than three (3) and no more than five (5) past performance references for recent and relevant projects identified on SF330 Part I Section F. Completed PPQs should be submitted with your SF-330. If the offeror is unable to obtain a completed PPQ from a client for a project(s) before the response date set forth in this notice, offerors should complete and submit with their responses the first page of the PPQ (Attachment C), which will provide contract and client information for the respective project(s). Offerors may submit a PPQ previously submitted under a different Notice/RFP (legible copies are acceptable) if it is on the same form as posted with this Synopsis. Offerors should follow up with clients/references to ensure timely submittal of questionnaires. If requested by the client, questionnaires may be submitted directly to the Government's point of contact, Network Contracting Office 6, Attn: Angelo Harris via email at angelo.harris@va.gov prior to the response date. Offerors shall not incorporate by reference into their response PPQs or CPARS previously submitted in response to other A/E services procurements. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.
Criterion 5 – Construction Period Services. Offerors will be evaluated on the quality of the construction period services provided. Construction period services include but are not limited to (See Statement of Work) professional field inspections, review of construction submittals, support in answering requests for information, and support of construction contract changes.
Submission Requirements: Provide up to three (3) completed projects in the past ten (10) years that best illustrates the construction period services performed by the team. Describe construction period services provided and whether the project was completed within schedule and budget. Include a contract number or project identification, include name, telephone number, and email of the completed project stakeholder.
Criterion 6 - Record of significant claims against the firm because of improper or incomplete architectural and engineering services.
Submission Requirements: Indicate any claims against the firm because of improper or incomplete architectural and engineering services within the past five (5) years. Firm may indicate no records on file to address this criterion.
Criterion 7 – Utilization of SDVOSB firms. Offerors will be evaluated on the extent to which potential contractors identify and commit to the use of service-disabled Veteran-owned small businesses, Veteran owned small businesses, and other types of small businesses as subcontractors.
Submission Requirements: Provide a list of subcontractors and their socioeconomic categories (SDVOSB, VOSB, and Multiple categories of small businesses).
Criterion 8 – Location. If evaluations of SF330’s result in the same rating, proximity to the facility will be used as a tiebreaker. The distance will be determined according to http://maps.google.com/. For firms that have multiple/regional offices, the location of the primary project team will be used to calculate the distance and should be provided in the SF330.
Submission requirements: Indicate firms/teams’ location, including main offices, branch offices and any sub consultants’ offices and demonstrate how this will be advantageous to the Government.
SELECTION PROCESS: The agency has convened an evaluation board for the evaluation of responses to this notice. Responses will be evaluated in accordance with the Selection of Architects and Engineers Statute (Public Law 92-582), formerly known as the Brooks Act, and implemented in Federal Acquisition Regulation (FAR) 36.6. Specifically, SF 330 submissions will be evaluated to identify the most highly qualified firms, using the selection criteria identified above. Discussions will be held with at least three (3) of the most highly qualified firms. Interviews may be conducted. The processes at FAR 36.602-4 and FAR 36.606 will then be followed.
SELECTION INTERVIEW:
Interviews shall be scheduled with firms slated as the most highly qualified. Firms slated for interviews will be asked a series of established questions. Elaborate presentations are not desired.
GENERAL INFORMATION:
The estimated magnitude of construction is between $1,000,000 and $2,000,000. The A-E will provide an initial estimate of cost to perform the above work and will design only those items that can be provided within the cost limitation. The Estimated Cost of Construction (ECC) shall only be provided to the Contractor in which a formal proposal is sought for the purposes of providing a proposal.
The A-E will provide documents at each submission as indicated in the statement of work. The NAICS code for this procurement will be 541310, Architectural Services. The current small business size standard for 541310 is $12.5 Million.
DESIGN COSTS: All offerors are advised that in accordance with VAAR 836.606-71 the total cost of the architect or engineer services contracted for the production and delivery of designs, plans, and specifications shall not exceed six percent (6%) of the estimated cost of the construction project plus any fees for related services and activities. Additionally, FAR 52.236-22 Design Within Funding Limitations, will be applicable to this procurement action. Design limitation costs will be provided to the most highly rated A-E firm(s) selected in accordance with the outlined process.
LIMITATIONS ON SUBCONTRACTING: In accordance with VAAR 852.219-73, VA Notice of Total Set-Aside for Certified Service-Disabled Veteran-Owned Small Businesses. In the case of a contract for services (except construction), the SDVOSB prime contractor will not pay more than 50% of the amount paid by the government to the prime for contract performance to firms that are not certified SDVOSBs listed in the SBA certification database (excluding direct costs to the extent they are not the principal purpose of the acquisition and the SDVOSB/VOSB does not provide the service, such as airline travel, cloud computing services, or mass media purchases). When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract.
Requirement for Electronic Submission Unless paper offers are specifically authorized, all responses to this special notice must be submitted electronically as described below. The only acceptable paper form for this requirement is the receipt of past performance questionnaires. Failure to comply with this requirement may jeopardize the possibility of receiving an award for the contract due to non-compliance with the terms of the solicitation. You must submit your electronic offer, and any supplemental information (such as spreadsheets, backup data, technical information), using any of the electronic formats and media described below.
In addition, contractors are notified of the award via an electronic Notice of Award e-mail. The award document will be attached to the Notice of Award e-mail.
Acceptable Electronic Formats (Software) for Submission of Offers
1. Files readable using the current Microsoft* Office version Products: Word, Excel, PowerPoint, or Access. Spreadsheet documents must be sent in a format that includes all formulas, macro, and format information. Print or scan images of spreadsheets are not acceptable. Please see security note below for caution regarding use of macros. When submitting construction drawings contractors are required to submit one set in AutoCAD and one set in Adobe PDF. (Purpose: contracting can open the PDF version and engineering can open AutoCAD files)
2. Files in Adobe* PDF (Portable Document Format) Files: When scanning documents scanner resolution should be set to 200 dots per inch, or greater.
3. Another electronic format. If you wish to submit an offer using another format than those described in these instructions, e-mail the Contracting Officer/Specialist who issued the solicitation. Please submit your request at least five (5) calendar days before the scheduled closing date of the solicitation. Request a decision as to the format acceptability and make sure you receive approval of the alternate format before using it to send your offer.
4. Please note that we can no longer accept .zip files due to increasing security concerns.
E-mail Submission Procedures: For simplicity in this guidance, all submissions in response to a solicitation will be referred to as offers.
a. Subject Line: Include the solicitation number, name of company, and closing date of solicitation.
b. Size: Maximum size of the e-mail message shall not exceed ten (10) megabytes. The SF330, in its entirety, shall not exceed one email of 5MB. The SF330 (not including past performance questionnaires) are limited to 45 pages. If the page limits are exceeded, the pages in excess of the limit will not be read nor considered. Only one email is permitted unless otherwise stated in this paragraph or in writing by the Contract Officer submitting the solicitation. Due to VA IT Security protocols, email submissions are limited to 10Mb per email. Furthermore, it is the sole responsibility of the prospective firms to confirm receipt of their submission in its entirety prior to the closing date & time of their submission in response to this synopsis.
The Microsoft Outlook © Email time/date stamp will be used to date and time stamp offers for the official record of receipt for the submission. The date and time stamp in recipient’s “inbox” is the official record of receipt.
Security Issues, Late Proposals, Unreadable Offers
1. Late submission of offers is outlined at FAR Parts 52.212-1(f), 52.214-7, and 52.215-1(c)(3). Attention is warranted to the portion of the provision that relates to the timing of submission.
2. Please see FAR 15.207(c) for a description of the steps the Government shall take regarding unreadable offers.
3. To avoid rejection of an offer, vendors must make every effort to ensure their electronic submission is virus-free. Submissions or portions thereof submitted and which the automatic system detects the presence of a virus or which are otherwise unreadable will be treated as “unreadable” pursuant to FAR Parts 14.406 and FAR 15.207(c ).
4. The virus scanning software used by our e-mail systems cannot always distinguish a macro from a virus. Therefore, sending a macro embedded in an e-mail message or an e-mail attachment may cause the e-mail offer to be quarantined. You may send both the spreadsheet and the spreadsheet saved in PDF format to ensure that your proposal is readable.
5. Password protecting your submission is not permitted. The Contracting Officer will file the offer electronically which will allow access only by designated individuals.
Important Notice: Apparent successful offerors must apply for and receive verification from the Small Business Administration (SBA) in accordance with 38 CFR Part 74 and VAAR 819.70 by submission of documentation of Veteran status, ownership and control enough to establish appropriate status, offerors must be both VISIBLE and VERIFIED by the Small Business Administration (SBA) at the time of submission of offers and at the time of award. Failure to be both VERIFIED by SBA and VISIBLE on VetCert at the time of submission of offers and at the time of award. will result in the offeror’s proposal being deemed non-compliant. All offerors are urged to contact the SBA and submit the required documents to obtain SBA verification of their SDVOSB status if they have not already done so.
Important addendum to 852.219-73 VA NOTICE OF SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESS SET ASIDE: VA’s Vendor Information Pages (VIP) database is no longer active. Small Business Administration will now verify SDVOSB Status. Offerors must be listed on SBA’s Veteran Small Business Certification (VetCert) database at https://veterans.certify.sba.gov/.
852.219-73 VA Notice of Total Set-Aside for Certified Service-Disabled Veteran-Owned Small Businesses.
As prescribed in 819.7011, insert the following clause:
VA NOTICE OF TOTAL SET-ASIDE FOR CERTIFIED SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESSES (JAN 2023) (DEVIATION)
(a) Definition. For the Department of Veterans Affairs, “Service-disabled Veteran-owned small business concern or SDVOSB”:
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled Veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled Veterans or eligible surviving spouses (see VAAR 802.101, Surviving Spouse definition);
(ii) The management and daily business operations of which are controlled by one or more service-disabled Veterans (or eligible surviving spouses) or, in the case of a service-disabled Veteran with permanent and severe disability, the spouse or permanent caregiver of such Veteran;
(iii) The business meets Federal small business size standards for the applicable North American Industry Classification System (NAICS) code identified in the solicitation document;
(iv) The business has been certified for ownership and control pursuant to 38 U.S.C. 8127, 13 CFR 128, and is listed as certified in the SBA certification database at https://veterans.certify.sba.gov/; and
(v) The business agrees to comply with VAAR subpart 819.70 and Small Business Administration (SBA) regulations regarding small business size, government contracting, and the Veteran Small Business Certification Program at 13 CFR parts 121, 125, and 128.
(2) The term “Service-disabled Veteran” means a Veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
(3) The term “small business concern” has the meaning given that term under section 3 of the Small Business Act (15 U.S.C. 632).
(4) The term “small business concern owned and controlled by Veterans with service-connected disabilities” has the meaning given the term “small business concern owned and controlled by service-disabled veterans” under section 3(q)(2) of the Small Business Act (15 U.S.C. 632(q)(2)).
(5) The term "SDVOSB participant” or certified SDVOSB means a small business that has been certified in the SBA Veteran Small Business Certification Program and listed in the SBA certification database (see 13 CFR 128.102).
(b) General. In order for a concern to submit an offer and be eligible for the award of an SDVOSB set-aside or sole source contract, the concern must qualify as a small business concern under the size standard corresponding to the NAICS code assigned to the contract and be listed as an SDVOSB participant in the SBA certification database as set forth in 13 CFR 128.
(1) Offers received from entities that are not certified SDVOSBs and listed in the SBA certification database at the time of offer shall not be considered.
(2) Any award resulting from this solicitation shall be made to a certified SDVOSB listed in the SBA certification database who is eligible at the time of submission of offer(s) and at the time of award.
(3) The requirements in this clause apply to any contract, order or subcontract where the firm receives a benefit or preference from its designation as an SDVOSB, including set-asides, sole source awards, and evaluation preferences.
(c) Representation. Pursuant to 38 U.S.C. 8127(e), only certified SDVOSBs listed in the SBA certification database are considered eligible to receive award of a resulting contract. By submitting an offer, the prospective contractor represents that it is an eligible and certified SDVOSB as defined in this clause, 13 CFR 121, 125, and 128, and VAAR subpart 819.70.
(d) Agreement/LOS certification. When awarded a contract action, including orders under multiple-award contracts, an SDVOSB agrees that in the performance of the contract, the SDVOSB shall comply with requirements in VAAR subpart 819.70 and SBA regulations on small business size, and government contracting programs at 13 CFR part 121 and part 125, including the non-manufacturer rule and limitations on subcontracting (LOS) requirements in 13 CFR 121.406(b) and 13 CFR 125.6. For the purpose of limitations on subcontracting, only certified SDVOSBs listed in the SBA certification database (including independent contractors) shall be considered eligible and/or “similarly situated” (i.e., a firm that has the same small business program status as the prime contractor). An otherwise eligible firm further agrees to comply with the required (LOS) certification requirements in this solicitation (see 852.219-75 or 852.219-76 as applicable). These requirements are summarized as follows:
(1) Services. In the case of a contract for services (except construction), the SDVOSB prime contractor will not pay more than 50% of the amount paid by the government to the prime for contract performance to firms that are not certified SDVOSBs listed in the SBA certification database (excluding direct costs to the extent they are not the principal purpose of the acquisition and the SDVOSB/VOSB does not provide the service, such as airline travel, cloud computing services, or mass media purchases). When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract.
(2) Supplies/products. (i) In the case of a contract for supplies or products (other than from a non-manufacturer of such supplies), the SDVOSB prime contractor will not pay more than 50% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, to firms that are not certified SDVOSBs listed in the SBA certification database. When a contract includes both supply and services, the 50 percent limitation shall apply only to the supply portion of the contract.
(ii) In the case of a contract for supplies from a non-manufacturer, the SDVOSB prime contractor will supply the product of a domestic small business manufacturer or processor, unless a waiver as described in 13 CFR 121.406(b)(5) has been granted. Refer to 13 CFR 125.6(a)(2)(ii) for guidance pertaining to multiple item procurements.
(3) General construction. In the case of a contract for general construction, the SDVOSB prime contractor will not pay more than 85% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, to firms that are not certified SDVOSBs listed in the SBA certification database.
(4) Special trade construction contractors. In the case of a contract for special trade contractors, no more than 75% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, may be paid to firms that are not certified SDVOSBs listed in the SBA certification database.
(5) Subcontracting. An SDVOSB subcontractor must meet the NAICS size standard assigned by the prime contractor and be certified and listed in the SBA certification database to count as similarly situated. Any work that a first tier VIP-listed SDVOSB subcontractor further subcontracts will count towards the percent of subcontract amount that cannot be exceeded. For supply or construction contracts, the cost of materials is excluded and not considered to be subcontracted. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the portion of the contract with the preponderance of the expenditure upon which the assigned NAICS is based. For information and more specific requirements, refer to 13 CFR 125.6.
(e) Required limitations on subcontracting compliance measurement period. An SDVOSB shall comply with the limitations on subcontracting as follows:
[Contracting Officer check as appropriate.] __X__ By the end of the base term of the contract or order, and then by the end of each subsequent option period; or ____ By the end of the performance period for each order issued under the contract.
(f) Joint ventures. A joint venture may be considered eligible as an SDVOSB if the joint venture 13 CFR 128.402 and the managing joint venture partner makes the representations under paragraph (c) of this clause. A joint venture agrees that, in the performance of the contract, the applicable percentage specified in paragraph (d) of this clause will be performed by the aggregate of the joint venture participants.
(g) Precedence. The VA Veterans First Contracting Program, as defined in VAAR 802.101, subpart 819.70, and this clause, takes precedence over any inconsistencies between the requirements of the SBA Veteran Small Business Certification Program, and the VA Veterans First Contracting Program.
(h) Misrepresentation. Pursuant to 38 USC 8127(g), any business concern, including all its principals, that is determined by VA to have willfully and intentionally misrepresented a company’s SDVOSB status is subject to debarment from contracting with the Department for a period of not less than five years (see VAAR 809.406-2 Causes for Debarment).

I. GENERAL INTENT:
Provide professional engineering services to perform planning, investigations, surveys, reports, consultations, site visits, design work, preparation of contract drawings and specifications, preparation of construction cost estimates, construction schedule and provision of construction period services as necessary for all demolition, modification, construction, inspection, testing and certification for all construction components for project 565-24-105, Refurbish D-wing Elevators. The construction budget is $1,600,000.
The intent of this project is to work under review authority of the VAMC Staff to accomplish specified tasks, design and prepare a set of complete construction documents for all engineering and construction disciplines and applicable components of this project.
II. SCOPE OF WORK:
This project will engage an Architectural Engineering (A/E) firm to provide a Memorandum of Agreement, Conceptual Drawings, Contract Drawings, Functional Layouts, Specifications, Construction Cost Estimates, Template Construction Schedule, draft submittal register, Engineering Calculations, and subsequent Construction Period Services. The Design team is responsible for coordinating with the Contracting Officer’s Representative (COR) and appropriate VA personnel to determine a plan for the new building(s).
The A/E firm shall hire a third-party Commissioning Agent (CxA) to be involved from Conceptual through Final Design and throughout construction. A/E to coordinate for the CxA to develop the commissioning plan and be involved throughout the design and construction, i.e. electrical, communications (DDC), fire detection and suppression systems.
A. DEMOLITION/SITE WORK: Demolition of utilities, walls, etc. as needed. Clearing vegetation and grading as required.
B. NEW WORK: This project will refurbish the two elevators that service the emergency room, imaging, laboratory, intensive care unit (ICU), and Operating rooms; these elevators are original to the 1980’s expansion project. The elevator project requires installing a temporary, exterior elevator prior to renovating the two elevators. This temporary elevator must be adequately sized to fit a hospital bed or stretcher. Designer to ensure the machine room meets all life safety requirements and has emergency power to at least one elevator.
The Concept phase of the contract will involve the A/E Designer first meeting with VA staff to include Facilities Management Service and Director/Administration Service to go over basic plans and expectations for the new space and gather information and ideas to create three concepts. The Concept phase of the contract will involve the A/E Designer providing three separate concept plans for the temporary elevator and the appearance of the elevators. The concepts will take into consideration all impacts to surrounding areas. Once a concept is selected, construction documents for all applicable components will be developed. Energy reviews will be conducted at the 65% design review stage by a VA Energy Engineer. Fire/Life Safety Code Review will be conducted at the 65% design review stage by a VA contracted firm. All provided comments must be addressed to the satisfaction of the VA COR.
The project shall include perimeter fence/wall to separate this area from parking/drives/streets to create the exterior respites.
III. MATERIALS PROVIDED TO AE AFTER AWARD:
A. PLANS:
Facility record drawings and AutoCAD files that are available will be provided for the A/E’s use. NOTE: Not all record drawings exist. The accuracy of facility conditions, records or as-built drawings will need to be completely field verified by the A/E.
B. SPECIFICATIONS, STANDARDS, ETC:
The project design shall be completed in accordance with this A/E scope and all appropriate Department of Veterans Affairs (VA) standards, specifications, and other criteria otherwise required by the VA. The AE shall retrieve all VA design information and standards from the VA Facilities Web Site (http://www.cfm.va.gov/til/index.asp). Station level modified specifications for certain specification sections will be provided by the VA after the notice to proceed as been issued. These documents and all national, state and local codes adopted and used by the VA shall be incorporated in the design of this project and reflected in the construction cost estimate. IV. PROJECT AND DESIGN REQUIREMENTS:
A. GENERAL: Ensure all wire/cabling for all work is completely installed in conduit. No open wiring shall be acceptable at any device. These descriptions are to give a general scope and scale of efforts required and do not necessarily cover all VA design guide requirements.
1. The project requires the A/E to design so that elevator availability in D-wing remains operational during construction; that by means of a temporary, exterior elevator.
2. The project shall be designed with viable deductive alternates equal to or greater than 10 percent of the construction funding limitation to ensure construction award within program budget limitations. The number of deductive alternates shall be between three and seven (or as approved by the VA Contracting Officer).
3. Construction Cost Estimate: Construction cost estimate shall be organized using the fifty (50) division format developed by the Construction Specifications Institute (C.S.I.). The Engineer shall use MICROSOFT EXCEL in preparation of the cost estimates. The cost estimate shall include various categories of work involved, quantities, and unit cost. The estimate shall also be based on the anticipated start date for construction, plus an inflation allowance for the Fayetteville, NC area for the anticipated time of bidding. This must meet current VA cost estimate guidelines and is subject to VA COR final approval/acceptance at each submission.
4. Construction Schedule outlining all major projects tasks and estimated durations for each. This shall include notice to proceed date, submittal process, mobilization, major tasks and/or discipline work events, phasing, significant inspections/commissioning events, closeout, turn-over and de-mobilization. Provide an Excel type project schedule chart outlining a generic construction schedule for this project. The expectation is to include major events/features/disciplines with estimated duration. This will include a fictitious future NTP date and have pre-mobilization, mobilization and closeout steps. Final schedule to be approved by VA COR.
5. Meeting Minutes: The A/E shall take minutes of all meetings, conferences, site visits, etc. A copy of the minutes for each meeting or site visit shall be provided to the VA COR for acceptance. The VA COR must approve the memorandum format.
6. Contract Drawings: Provide fully developed Contract Drawings in BIM/3D Revit to level 500 (current version accessible by the VA) and provide Revit/AutoCAD and PDF drawings electronically and in hard copy. Hard copy drawings shall be plotted at 1/8" or 1/4" scale, minimum. A larger, more appropriate scale shall be used for sections and details. The final contract drawings (as-builts) shall be black ink on E size (30" x 42") paper. (See also CADD requirements Section V.).
7. Specifications: Provide fully developed and edited specifications in a MICROSOFT WORD and PDF format accessible by the VA. Specifications shall be printed on 8 ½" x 11" bond paper, font type Times New Roman, 12 pt.
8. Statement of Work: Provide fully developed executive summary of the construction work required with an estimated construction period MICROSOFT WORD and PDF format accessible by the VA. Specifications shall be printed on 8 ½" x 11" bond paper, font type Times New Roman, 12 pt.
9. Draft Submittal Register: Provide a draft submittal register in an approved formatted Excel spreadsheet with all A/E required submittals per final plans and specifications for this project. This is intended to be provided to a construction contractor to use and complete with the expectation that the A/E has reviewed and considers complete with maybe minor omissions needing addressed by a General Contractor (GC).
B. ELECTRICAL
1. On the plans indicate all new communications and electrical systems and components. Power, lighting, and data/telephone shall each have a separate drawing sheet(s) for clarity.
2. On the plans indicate all new connections to the existing electrical system (s) both normal and emergency.
3. Show on the plans all new fire alarm devices. Include input/output matrix.
4. On plans indicate the locations and sizes of all new HVAC control systems components and connections to the existing Energy Management and Control System.
C. CIVIL & SITE WORK:
1. Show any existing conditions and significant area features identified for pre-work reference.
2. Show on the plans all components to be demolished and/or altered.
3. Show demolition of any abandon utilities in the construction area.
4. Provide any necessary details to show utility cut-off or capping etc.
5. Provide excavation, site, and grading plans. Include any during construction erosion control work.
D. ARCHITECTURAL:
1. Show structures, doors, windows, equipment, and mechanical shafts. Show exterior spaces impacted by the project. Label each room or space with a room title and room number. Room titles on drawings shall be the same as those used in the Space Planning Criteria.
2. Provide all necessary plan, detail, and section views as necessary to convey necessary construction work involved.
3. Include complete finish schedules with all products, materials and colors identified per item.
4. Include complete hardware schedules with all products, functions, materials, and colors identified.
E. PLUMBING, SANITARY, MEDICAL GASES:
1. Show on the plans the locations and sizes of all new supply and return lines.
2. Show on the plans the locations and sizes of all new roof, storm, and sanitary sewer lines.
3. Show on the plans the locations and sizes of all new fire sprinkler lines.
4. Provide all necessary schedules (fixtures, valves, pumps etc.) and details.
5. Provide DDC schematic and sequences of operations for all systems.
6. Show on the plans the medical gases and fixtures.
F. MECHANICAL:
1. Show on the plans the locations of all new HVAC equipment including air handler units, heaters, exhaust/ventilation.
2. Show on the plans the locations and sizes of all new ductwork, dampers, and vents.
3. Show on the plans the locations and sizing of all new piping and ductwork insulation.
4. Provide all necessary schedules (fixtures, valves, pumps etc.) and details.
5. Provide DDC schematic and sequences of operations for all systems.
G. COMMUNICATIONS:
1. On the plans indicate all new communications and electrical systems and components. Power, lighting, and data/telephone shall each have a separate drawing sheet(s) for clarity.
2. On the plans indicate all new connections to the existing electrical system (s) both normal and emergency.

V. REVIEW REQUIREMENTS
A. CONCEPTUAL DESIGN REVIEW
1. One full size Arch E plotted drawing set for each concept plus electronic PDF format copies of everything required. This shall be all three concepts and must include a construction cost estimate per concept. Estimate is understood to be a rough ballpark only for each major discipline with allowable escalations.
2. Each should depict an area layout with ancillary features as described in the scope for outside areas.
3. Each concept shall include a color elevation rendering of the front elevation.
4. Design checklist review with VA COR to cover concept submittal and verify all follow on submittal stages and requirements for Design Development and Construction Drawing package submittals.
5. Provide VA Staff a Virtual Tour of each concept for exterior and interior. This can be via video clips that can be viewed at VA discretion or in a live presentation on site.
B. 35% REVIEW: Schematic Design SD-1
1. This shall expand upon all requirements the VA approved at the concept design stage and indicate layout of rooms with sizes and purposes, door swings, window locations, exterior elevations. Provide 35% level of efforts for all disciplines required per checklist.
2. One (1) Arch E (30”x42”) copy of work completed to date.
3. One electronic copy of proposed specification sections to date. Index shall show which VA specifications are included and which VA specifications are not (lined through) for ease of review and ensuring all required specifications are included to move forward.
4. Provide electronically transferred copy of drawings, specifications, construction cost estimate and any other draft documents ready for review at this level.
C. 65% REVIEW: Design Development DD-1
1. This shall further expand upon the SD-1 35% design and address all previously provided VA comments. Provide 65% level of efforts for all disciplines required.
2. One (1) Arch E (30”x42”) copy of work completed to date.
3. One electronic copy of proposed specification sections to date. These shall have been updated to reflect this project and its requirements. Index shall show which VA specifications are included and which VA specifications are not (lined through) for ease of review and ensuring all required specifications are included to move forward.
4. Provide electronically transferred copy of 35% VA Design Comments with A/E responses, drawings, specifications, construction cost estimate and any other draft documents ready for review at this level.
5. This submittal shall require an onsite virtual tour for VA staff. A/E shall provide 3D goggles and equipment. The VA will provide a television for the A/E to use for others to view what the individual is looking at inside the virtual reality.
D. 95% REVIEW: Design Development DD-2
1. This shall represent a complete design with little or no remaining issues or missing data. This submittal should have all required number of drawings to clearly indicate to bidders all requirements.
2. One (1) Arch E (30”x42”) copy.
3. One electronic copy of proposed specification sections to date. Index shall show which VA specifications are included and which VA specifications are not (lined through) for ease of review and ensuring all required specifications are included to move forward.
4. Provide electronically transferred copy of 35% VA Design Comments with A/E responses and the 65% VA Design Comments with A/E responses, drawings, specifications, construction cost estimate, template construction schedule and all required documents for a complete design package.
This submission shall include 3D renderings of interior and exterior significant features and views of this future elevator. One or more of these will be intended to be used by the construction contractor for construction signs.
E. FINAL SUBMISSION: Construction Documents (CD):
1. All drawings and documents shall indicate “Issued For Construction”
2. VA COR shall review electronic copies prior to giving approval to print/plot this package as a final check for significant errors.
