STATEMENT OF WORK

SCOPE OF WORK:

This project will re-route a segment of 10-inch water main that passes under the new reinforced concrete Bus Stop pad located in front of Building 2. The water main is damaged in at least one place, with water coming to the surface in at least two places. The intent is to restore the loop by installing a new line around the pad, isolating the damaged segment (which will remain in place), and return the two fire hydrants located along the road at each end of Bldg 2 to service. The selected general contractor (GC) will provide all administration, supervision, labor, materials, tools and equipment, and perform all operations necessary to accomplish the above. Work will be performed according to project specifications, all applicable codes, and in accordance with current VA and Salisbury VAMC construction policies, procedures and best practices.

1.0 ADMINISTRATIVE and COORDINATION:

Period of Performance. The contractor will have 90 days from the Notice to Proceed date which includes the time required for all submittals, material & equipment procurement, planning and mobilization, construction activities, and inspections. Disapproved submittals are not reason for additional time/delay cost to the contract.

Smoke-free Campus. As of Oct 2019, all VA campuses are designated as No Smoking, indoors and outside. Violations are subject to ticketing by VA Police.

COVID-19 Restrictions: Currently, masks are required for all personnel working within the VAMC and certain buildings are restricted or off limits. Although changes are unforeseeable, the GC must ensure all personnel under their direction comply with all applicable COVID-19 requirements during the project. The latest requirements will be provided to the GC prior to start of actual work.

POCs. The Contracting Officer’s Representative (COR) will be the primary Point of Contact for communication and coordination on site throughout the period of performance. The Contracting Officer (CO) retains authority for matters pertaining to the contract, as well as all financial authority on behalf of the Government.

Supervision by Contractor. The GC will provide a Site Superintendent as “Competent Person” who will be on-site whenever work is being performed. The Site Superintendent must be OSHA-30 qualified and will be separate from any sub-contractor(s) and directly employed by the general contractor. Responsibilities of the Site Superintendent include but are not limited to: a) Oversight of the project, b) Preliminary approval of all material submittals and change order requests, and c) Supervision of any subcontractors. Site Superintendent will be present during active work and holds responsibility for Safety matters on behalf off the GC and any subcontractors.

Contractor Badging. Badges must be worn by all contractors and subcontractors while on campus. The Salisbury VAMC requirements for access badges will be provided. Generally, the documentation for badges include two forms of ID, proof of OSHA construction safety certification and proof of negative TB testing and Flu vaccination. All workers must be legally authorized to work in the US.

Site Survey. The GC and CO/COR will conduct a Pre-Construction meeting and walk-through before mobilizing, to be coordinated with the PM/COR.

Schedule. Daily schedule TBD. It is anticipated that some work may take place on weekends or outside of ordinary work hours (defined as 7:30am to 5:00pm).

Trafficability and Closures. Due to Covid-19 the municipal bus is temporarily (with uncertain duration) operating at Bldg 13, however the Bldg 2 circle entrance remains a high-traffic intersection that cannot be shut down for extended periods. Contractor will provide traffic control as needed throughout the project. Any road closures must be coordinated with advance notice through the PM/COR.

Phased Construction Plan. The contractor is required to provide the Contracting Officer a phased construction plan to perform the work. The GC will update this plan on a regular basis and submit to the Contracting Officer and COR.

Inspections, Reports and Progress Meetings. The COR will inspect the worksite daily. A schedule of progress meetings will be determined, however once weekly is anticipated. The GC will report construction progress daily to the COR in writing (email is acceptable). Report and meeting formats will be discussed in the Pre-Construction meeting. The presence or absence of a Government inspector or other official does not relieve the contractor of any contract requirements, nor is the inspector/official authorized to change any term or condition of the contract without written authorization from the Contracting Officer.

Removal of Unacceptable and Unauthorized Work. All work which does not conform to the requirements of the contract will be considered unacceptable. Unacceptable work, whether the result of poor workmanship, use of defective materials, damage through carelessness or any other cause, found to exist prior to the final acceptance of the work, will be remedied or removed immediately and replaced in an acceptable manner unless in the public interest the Government consents to accept the work with an appropriate adjustment in contract price.

Site Clean-Up and Restoration. The contractor shall ensure the work site and areas around the work site are free of any portable tools, loose debris and materials upon completion of work each day, as well as at the completion of the job. Contractor shall remove and properly dispose of all materials and equipment upon completion of the job. Site restoration expectations will be discussed at Pre-Bid meeting and coordinated with VA Grounds supervisor. Generally, this is expected to include leveling, re-seeding and strawing of grassy areas, and replacement of shrubbery as needed.

2.0 TECHNICAL REQUIREMENTS:

Location. Bldg 2 Traffic circle and bus stop pad. Ref: map below.

Existing Conditions.

All existing conditions must be field verified by the GC prior to commencement of work.

Water main: 10-inch PVC; exact type or manufacturer uncertain.

Depth: The line beneath the bus stop concrete pad where originally damaged was at approx. 3 ft depth.

Test digs in the grass strip along the road may be required to confirm depth at each side of the traffic circle, as well as exact composition of the pipe. New line will be installed at the depth of the existing line.

Storm drains exist on either end of the bus stop.

Roadways in the area were recently resurfaced (i.e., less than one year old).

Project Requirements.

Contractor will field verify all requirements for accuracy prior to bid and construction.

Contractor will consider and provide cost comparisons for the following Bid Alternates:

A. Trenching an entire new line segment, thereby cutting and restoring any pavement or concrete areas necessary to ensure the new line is clear of the bus stop. Re-route path should also, as far as practical, be clear of the arc of the bus turn-in.

B. A combination of boring and trenching: boring from the grass areas outside the circular drive, and underneath all pavement and concrete, then trenching the remainder in the traffic circle.

Water line will be embedded in material free of rocks or other debris that may damage the line.

Compaction. Trenched areas will be compacted so as to a) support road re-surfacing and restoration of all concrete to original condition, supporting vehicular and foot traffic, and b) prevent erosion, sinkholes, future visible trench lines, and the like – the intent is to prevent future trip hazards as well as unsightliness.

All disturbed or cut asphalt will be restored. Sidewalk sections will be cut and removed along expansion or control joint lines and re-poured to fit existing undisturbed sections.

3.0 Safety, Infection Control and Construction Waste:

Authority. The VA Safety Department is the final authority regarding worksite safety and matters pertaining to safety of the public and staff. The Construction Safety References document will be provided. The Infection Control Practitioner is the final authority for all IC matters. Safety and IC will be discussed at the Pre-Bid meeting and site walk.

Inspections. Currently, one formal Construction Safety Inspection of all campus projects is performed weekly, but all sites are subject to inspection by the Government at any time and without notice.

Site Security. Holes, trenches and the like must be securely covered when not under construction and/or whenever left unattended. Ample warning must be posted and approved by VA Safety. At a minimum, fencing will be staked orange mesh to a height of four (4) feet and surround areas under construction (this will be discussed at Pre-Bid).

Ingress/Egress and Parking. Construction personnel will use designated entry and exit points for access and material movement. Parking areas will be coordinated. Only authorized personnel should be allowed to enter the immediate construction area.

PPE. Personal protective equipment (PPE), such as eye protection, hearing protection, face masks or shields, knee pads, and the like will be worn when appropriate. All construction sites at VAMC Salisbury are considered Hard Hat Areas. Appropriate warning signage and/or barriers will be emplaced, to be discussed at the pre-construction meeting.

Debris Removal and Daily Clean-up. Superintendent will walk the site at the end of each shift to ensure tools, material and debris are satisfactorily removed. The GC will provide their own dumpster for construction waste, to be located at a site designated by the VA and enclosed to prevent access by the public. Construction waste will be removed daily, along approved routes. Areas contiguous to the immediate work site, and the route approved for removal purposes must be kept free of debris, material and tools. VA assumes no responsibility or liability for lost, misplaced or stolen tools or material.

(End of Clause)

I.6 52.225-9 BUY AMERICAN—CONSTRUCTION MATERIALS (MAY 2014)

(a) Definitions. As used in this clause— "Commercially available off-the-shelf (COTS) item"—

(1) Means any item of supply (including construction material) that is—

(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);

(ii) Sold in substantial quantities in the commercial marketplace; and

(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and

(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4), such as agricultural products and petroleum products.

"Component" means any article, material, or supply incorporated directly into construction material.

"Construction material" means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.

"Cost of components" means—

(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the end product (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or

(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.

"Domestic construction material" means—

(1) An unmanufactured construction material mined or produced in the United States;

(2) A construction material manufactured in the United States, if—

(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic; or

(ii) The construction material is a COTS item.

"Foreign construction material" means a construction material other than a domestic construction material.

"United States" means the 50 States, the District of Columbia, and outlying areas.

(b) Domestic preference.

(1) This clause implements 41 U.S.C. chapter 83, Buy American, by providing a preference for domestic construction material. In accordance with 41 U.S.C. 1907, the component test of the Buy American statute is waived for construction material that is a COTS item. (See FAR 12.505(a)(2)). The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.

(2) This requirement does not apply to information technology that is a commercial item or to the construction materials or components listed by the Government as follows:

(3) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(2) of this clause if the Government determines that—

(i) The cost of domestic construction material would be unreasonable. The cost of a particular domestic construction material subject to the requirements of the Buy American statute is unreasonable when the cost of such material exceeds the cost of foreign material by more than 6 percent;

(ii) The application of the restriction of the Buy American statute to a particular construction material would be impracticable or inconsistent with the public interest; or

(iii) The construction material is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.

(c) Request for determination of inapplicability of the Buy American statute.

(1)(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(3) of this clause shall include adequate information for Government evaluation of the request, including—

(A) A description of the foreign and domestic construction materials;

(B) Unit of measure;

(C) Quantity;

(D) Price;

(E) Time of delivery or availability;

(F) Location of the construction project;

(G) Name and address of the proposed supplier; and

(H) A detailed justification of the reason for use of foreign construction materials cited in accordance with paragraph (b)(3) of this clause.

(ii) A request based on unreasonable cost shall include a reasonable survey of the market and a completed price comparison table in the format in paragraph (d) of this clause.

(iii) The price of construction material shall include all delivery costs to the construction site and any applicable duty (whether or not a duty-free certificate may be issued).

(iv) Any Contractor request for a determination submitted after contract award shall explain why the Contractor could not reasonably foresee the need for such determination and could not have requested the determination before contract award. If the Contractor does not submit a satisfactory explanation, the Contracting Officer need not make a determination.

(2) If the Government determines after contract award that an exception to the Buy American statute applies and the Contracting Officer and the Contractor negotiate adequate consideration, the Contracting Officer will modify the contract to allow use of the foreign construction material. However, when the basis for the exception is the unreasonable price of a domestic construction material, adequate consideration is not less than the differential established in paragraph (b)(3)(i) of this clause.

(3) Unless the Government determines that an exception to the Buy American statute applies, use of foreign construction material is noncompliant with the Buy American statute.

(d) Data. To permit evaluation of requests under paragraph (c) of this clause based on unreasonable cost, the Contractor shall include the following information and any applicable supporting data based on the survey of suppliers:

FOREIGN AND DOMESTIC CONSTRUCTION MATERIALS PRICE COMPARISON

Construction Material Description
Unit of Measure
Quantity
Price (Dollars)*

Item 1:

Foreign Construction Material

Domestic Construction Material

Item 2:

Foreign Construction Material

Domestic Construction Material

[List name, address, telephone number, and contact for suppliers surveyed Attach copy of response; if oral, attach summary.] [Include other applicable supporting information.] [*Include all delivery costs to the construction site and any applicable duty (whether or not a duty-free entry certificate is issued).] (End of Clause)

I.7 52.228-13 ALTERNATIVE PAYMENT PROTECTIONS (JULY 2000)

(a) The Contractor shall submit one of the following payment protections:

Payment Bond; Irrevocable Letter of Credit (ILC)

(b) The amount of the payment protection shall be 100 percent of the contract price.

(c) The submission of the payment protection is required within days of contract award.

(d) The payment protection shall provide protection for the full contract performance period plus a one-year period.

(e) Except for escrow agreements and payment bonds, which provide their own protection procedures, the Contracting Officer is authorized to access funds under the payment protection when it has been alleged in writing by a supplier of labor or material that a nonpayment has occurred, and to withhold such funds pending resolution by administrative or judicial proceedings or mutual agreement of the parties.

(f) When a tripartite escrow agreement is used, the Contractor shall utilize only suppliers of labor and material that signed the escrow agreement.
