VHAPM Part 806.3 Other Than Full and Open Competition (OFOC) SOP Attachment 2: Request for Sole Source Justification Format >SAT

OFOC SOP Revision 08 Page 1 of 4 Original Date: 03/22/11 Revision 08 Date: 04/18/2018

DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For

Other Than Full and Open Competition (>SAT)

Acquisition Plan Action ID: 36C246-19-AP-3888

1. Contracting Activity: Department of Veterans Affairs, VISN 06 Durham VA Medical Center plans to contract by means other than full and open competition in response to procurement request 558- 19-3-122-0253, 558-19-3-122-0268, 558-19-3-122-0269, 558-19-3-122-0272.

2. Nature and/or Description of the Action Being Processed: The purpose of this justification is to brand name this procurement using a firm-fixed-price contract. This is a follow on procurement of Howard Carts. These carts will be used for the following Durham VAMC wards: Behavioral Health, Nursing, Pulmonary and Anesthesia.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: In FY 2012, VISN 6 competed and awarded a contract to Howard Medical to standardize point of care carts, medication carts and large medication carts for Community Living Center for Durham Medical Centers based on individual needs identified. This requirement is a refresh initiative of Howard Medical Carts. The initiative will address the projected carts needed for Behavioral Clinic, Nursing, Pulmonary, and Anesthesia. This procurement is for (15) Howard HI-Paradigm E, (16) Howard HI-Care E, (10) HI-Core laptops for replacing outdated PCs and old carts. The goal is to maintain consistency in medication drawer size and utility, software compatibility, interchangeable battery/power systems for ease of service, and limit time/funds spent on staff re-training. There are no option periods within this procurement and the total estimated cost of this acquisition is $380,000.19.

4. Statutory Authority Permitting Other than Full and Open Competition:

( X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1;

( ) (2) Unusual and Compelling Urgency per FAR 6.302-2;

( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3;

( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5;

( ) (6) National Security per FAR 6.302-6;

( ) (7) Public Interest per FAR 6.302-7;

FAR13.5 Simplified Procedures for Certain Commercial Items: This procurement is for Howard Carts and Laptops in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under

Revision 08 Date: 04/18/2018

Simplified Acquisition Procedures are exempt from the requirement of FAR Part 6, but still require a justification using the format of FAR 6.302-1.

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Under the authority of FAR 6.302-1 (a) (2) (ii) supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of highly specialized equipment, including major components. Since 2012, Durham VAMC has been using Howard carts, PCs and laptops. The goal of using Howard Medical Carts was to maintain consistency in medication drawer size and utility, software compatibility, interchangeable batter/power systems for ease of service, and limit time/funds spend on staff re-training. Howard Carts are currently in use in all in-patient wards and are compatible with the current systems and software Durham VAMC have in place. Changing systems now would cause systantial duplication cost to the government.

Furthermore, the alternative would be a different vendor selection. A different brand would lower staff competency, add complexity to the Pharmacy with loading medication draws, and increase the cost of ownership by maintaining multiple vendor medication carts.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: This procurement is for information technology and therefore will be solicited through SEWP.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable: Items are on schedule.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted: Correspondence was issued to SDVOSB’s and VOSB’s that were found on VIP, referencing sources sought posted on FBO. Sources sought issued on FBO and SEWP yielded an interested vendor, Minburn an SDVOSB. It has been determined that it is in the best interested of the Government to compete this procurement through SEWP – SDVOSB set-aside utilizing Firm Fixed Price Contract vehicle.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: No other supporting facts.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Minburn Technologies

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to

Competition before Making subsequent acquisitions for the supplies or services required: No actions are planned as this is a standardized product for Durham VAMC. Any change in brand would increase the cost of ownership by maintaining multiple vendor medication carts.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona

Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
