VHAPM Part 813.106 Page 1 of 1 Original Date: 08/30/17 Revision 02 Eff Date: 03/31/2020

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID:36C245-21-AP-2740

1. Contracting Activity:

Department of Veterans Affairs, VISN 5, Baltimore Medical Center.

Network Contracting Office (NCO) 5.

Funding document: 512-21-4-090-0162

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

Electroencephalography (EEG) equipment for monitoring of patients with epilepsy. Equipment will be used in the Epilepsy Monitoring Unit, critical care environments, and outpatient settings; both fixed and mobile use as needed.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

Brand Name Only justification- NATUS NATUS equipment has been identified as the only equipment available to fulfil the need. The newly procured equipment is being utilized to expand the capability of the Epilepsy Monitoring Unit (EMU) at the Baltimore VA. The EMU currently has NATUS equipment in use, this additional equipment will increase support capability. Therefore, the new equipment must be able to be fully integrated into the current system in-use to include software, analyzer, and study integration. The EMU determined that only NATUS equipment can be fully integrated into the current system.

4. Description of market research conducted and results or statement why it was not conducted:

Market research was conducted by the program office and the contracting office. The program office applied personal knowledge of equipment as well as obtaining information from other VA epilepsy centers. The contracting office queried government contract databases, GSA, and issued a RFI. Through market research the contracting officer determined that the brand name equipment is required, but it is available from several vendors. Therefore, this is a brand-name justification rather than a sole source vendor justification.

5. Contracting Officer's Certification:

Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief. Contracting Officer will determine of whether price is reasonable prior to award IAW FAR 13-106-3 and document the determination.
