(2) Hold Harmless and Indemnification Agreement. The contractor shall save and hold harmless and indemnify the government against any and all liability. This includes claims and costs of whatsoever kind and nature for injury to, or death of any person or persons and for loss or damage to any property occurring in connection with or in any way incident to or arising out of the occupancy, use service, operations or performance of work under the terms of this contract, resulting in whole or in part form the negligent acts or omissions of the contractor, any subcontractor or any employee, agent or representative of contractor or subcontractor.

d. BULK OXYGEN:
Container is VA-owned 107 cf (800 gallons) capacity. Access is limited requiring use of smaller trucks (5500 GVW, single axle, dual wheel). Contractor should visit the site to ascertain accessibility by his/her delivery vehicles.
e. Inspection (Measurement and Computation, Liquid Gases): Measurement of the quantity of liquid gases delivered will be based on the calibrated liquid flow meter or liquid level gauge on the contractor’s delivery equipment or on the liquid level gauge on the storage container. The contractor will assume all vaporization losses.
f. Measurement and conversion computations: Density data and volume measurement equivalents published in Compressed Gas Association Pamphlet No. P-6, titled “Standard Density Data, Atmospheric Gases and Hydrogen,” shall be used when necessary to convert measurement of gases from one form to another, for example, from cubic feet to gallons.
3. Background: Beckley VAMC has a special requirement for dual wheel, single axle delivery truck, not to exceed 5500 GVW, due to crossing over underground gas lines. Our current vendor, Beckley Welding, has been the only local supplier capable of satisfying this requirement.
