The scope of work consists of providing all labor, materials, and equipment to perform the tasks outlined in the Statement of Work for Replace Campus Fire Alarm System at the Wilmington, DE VAMC.
The contractor shall abide by all federal state, and local code/regulations/standards.
Magnitude of Construction: Between $5,000,000 and $10,000,000 Project: 460-20-003 Replace Campus Fire Alarm System NAICS: 238210 - Electrical Contractors and Other Wiring Installation Contractors Size Standards: $19 Million This procurement is a 100% Service Disabled Veteran Owned Small Business (SDVOSB) set-aside acquisition.
Award will be made to the responsive, responsible entity whose proposal in conformance with the solicitation, results in the Lowest Price.
This solicitation will result in a firm-fixed price contract. Only one award will be made.

Evaluation Factors
Proposals will be evaluated in accordance with the Evaluation Factors identified below.
Evaluation Factor 1 – Technical Capability
Evaluation Factor 2 – Experience and Past Performance
Evaluation Factor 3 – Price
Technical Capability and Past Performance are equal and when combined are significantly more important than Price. The subfactors within Technical Capability are of equal importance and all elements within each subfactor are of equal importance.
As demonstrated in their proposals, Offerors shall be evaluated in terms of the Offeror’s ability to meet or exceed the project’s requirements as identified in the SOW, and those proposals demonstrating an ability to exceed specified requirements may be rated higher in those areas than proposals demonstrating only the ability to meet requirements. Offerors are reminded to include their best technical and price terms in their initial offer and not automatically assume that they will have an opportunity to participate in discussions or be asked to submit a revised offer. The Government intends to make award to a responsible Offeror submitting a conforming proposal without discussions, if deemed to be in the best interest of the Government. The Government may use corporate knowledge on past and present projects, when evaluating proposals.
1. Technical Capability
1.1. Submission Requirements:
1.1.1. Provide a clear, concise narrative not to exceed 10 pages (front and back side use of a single page will count as 2 pages). Company advertising literature shall not be included. The narrative shall address two subfactors, Subfactor A, System Requirements, Subfactor B, Construction Approach. The contractor is advised to note in each of these subfactors any elements or aspects exceeding the RFP requirements or betterments provided, including an explanation of how each element or aspect improves upon the basic requirements and how it would benefit the VA. The Government may use knowledge on past and present projects, when evaluating proposals.
1.2. Subfactor A: System Requirements
1.2.1. Offerors shall be evaluated in terms of the Offeror’s ability to meet or exceed the project’s requirements as identified in the SOW, and those proposals demonstrating an ability to exceed specified requirements may be rated higher in those areas than proposals demonstrating only the ability to meet requirements. Provide an outline demonstrating ability to meet or exceed the SOW with respect to the major functional categories identified below.

1.3. Subfactor B: Construction Approach
1.3.1. Provide a narrative identifying the construction approach anticipated including phasing to maintain continuity of operations. Address the major functional categories identified above. The purpose of the narrative is to show the contractor’s ability to plan through the work and successfully complete the project.
1.3.2. Identify potential pitfalls and unintended negative impacts associated with the work and provide a plan to avoid such outcomes.
1.3.3. Identify critical path elements of the project and identify measures to maintain schedule.
1.3.4. Identify the means of maintaining quality control
2. Past Performance
2.1. The COR will evaluate the degree of successful completion of the recent and relevant past performance identified in the proposal, Prime Contractor past performance along with the designated team of subcontractors. Documentation of satisfactory performance of projects similar in size, scope, and dollar value will be considered to have met the minimum requirements of the RFP. Conversely, offers which do not achieve satisfactory performance of projects similar in size, scope and dollar value will not be considered to have met the minimum requirements of the RFP. Projects that are not determined similar in size, scope and dollar value may not be considered. The Government reserves the right to check any or all cited references to verify supplied information and to assess owner satisfaction as to quality, schedule, cost and management. The Government may use knowledge on past and present projects, when evaluating proposals.
2.2. Past performance is either relevant or non-relevant to the Project. Evaluations may include past performance information regarding predecessor companies, key personnel who have relevant experience or subcontractors that will perform major or critical aspects of the requirement.
Offerors without a record of relevant past performance or for whom information on past performance is not available may not be evaluated favorably or unfavorably on past performance and shall receive a neutral rating for Past Performance. Offerors may provide information on problems encountered on the identified contracts and the corrective action taken, if desired.
2.3. Provide at least three (3) but no more than five (5) construction projects that best illustrate the contractor’s prime and subcontractor teams’ qualifications. The document should be written to show the teams’ construction experience with respect to the major functional categories listed.
2.3.1. Provide a project description. At a minimum, the description should include scope, size and cost of the project and can include photographs.
2.3.2. Show the participation of key personnel (identified previously with resume) in the listed projects. The offeror can also include the subcontractors by company name. Including subcontractors may be beneficial to show the experience of the company in addition to the key personnel.
2.3.3. The Government may also use other tools including but not limited to CPARS/PPIRS Vet Biz, Dunn & Bradstreet, and Federal Awardee Performance and Integrity Information System (FAPIIS) to gather documentation on past performance.
2.3.4. Include customer’s point of contact (name, title, and phone number).
2.3.5. The Government may use corporate knowledge on present and past projects, when evaluating this factor.
3. Price
3.1. The offeror shall complete and submit Standard Form 1442 and Attachment 1.

CONSTRUCTION SCOPE OF WORK
For
Replace Campus Fire Alarm System (460-20-003)

Provide:
1. Professional construction services to include but not limited to:
a. Professional construction services to completely replace and upgrade existing Campus Fire Alarm System
b. Construction period services- Install all items per plan and specification as shown in construction documents.
-- Project Scope --
GENERAL:
The Wilmington, Delaware VA Medical Center intends to issue a construction contract to completely replace and upgrade the campus fire alarm system.
SPECIFICS:
1. The contractor will furnish all materials, equipment, supervision, and personnel necessary to accomplish the project as indicated on the drawings and specifications. Work includes but is not limited to trades required for the complete replacement of the campus fire alarm system, including but not limited to: demolition, general construction, new construction of interior partitions, alterations, renovations, asbestos and lead abatement, interior finishes, doors and hardware, mechanical, electrical, plumbing, fire protection, and security systems. Refer to the construction drawings and specifications as accompanied herewith for details of the scope of work for this contract.
2. Demolition of the existing system includes, but is not limited to, the removal of all finishes, fixtures, electrical distribution, fire/alarm systems.
3. Tthe project Architect/Engineer, have prepared drawings and specifications which are part of this SOW and are to be used for the completion of this project.
4. The work will require phasing so as to minimize disruption to daily functions of the VA campus.
Construction activity shall involve all disciplines listed in Item 1 above. Infection control and safety measures shall be provided per the contract drawings and specifications throughout the construction period to minimize risks. All work shall be completed in accordance with the latest ANSI, VA, UFAS, local, state and federal regulations.
5. Contractor must submit a detailed Infection Control Risk Assessment Plan, to include Lead Paint and Asbestos removal certification. Testing has been performed for lead paint and asbestos and the results of this third party testing are included in the project specifications prepared by project Architect/Engineer. The contractor is to follow all OSHA approved safety guidelines for all necessary abatements of these materials.
6. All employees of the general contractor and subcontractors shall comply with the VA security management program and obtain permission of the VA police, be identified by project and employer, and restricted from unauthorized access.
7. Prior to commencing work, the general contractor shall provide proof that an OSHA certified “competent person” (CP) (29 CFR 1926.20(b)(2) will maintain a presence at the work site whenever the general or subcontractors are present.
8. The general contractor shall establish and maintain a fire protection program in accordance with 29 CFR 1926. Prior to start of work, a protection plan detailing project-specific fire safety measures, including periodic status reports, and submit to COR for review for compliance with contract requirements in accordance with Section 01 33 23, SHOP DRAWINGS, PRODUCT DATA AND
SAMPLES.
9. The general contractor shall implement the requirements of the VA Infection Control Risk Assessment (ICRA) team, including the establishment and maintenance of a dust control program. Prior to the start of work, the general contractor must prepare a plan detailing project-specific dust protection measure, including periodic status reports, and submit to the COR and Facility ICRA team for review.
10. Submission of a bid is a representation that the bidder has thoroughly investigated general and local site conditions and is satisfied as to the conditions to be encountered, while accomplishing work at the site.

Expectation: All projects and project designs shall contain language that addresses all applicable EOSH requirements.

Performance Location:
1. Wilmington VAMC, Delaware located at 1601 Kirkwood HWY, Wilmington, DE 19805.
Hours:
1. Work is to be performed on Monday to Friday at 7:00AM -4:00PM, Saturday at 08:00AM-4:00PM and Sunday 08:00AM-4:00PM. Contractor access will be provided during this time, except special federal holidays.
2. The contractor will not have any personnel on site any other day without the proper approval from the COR.
Deliverables:
1. The Contractor must have deliverables sent to a project field office offsite and NOT to use the Warehouse building onsite as a means of materials handling/delivery.

Contractor Personnel:
1. The Contractor shall be responsible for employing qualified personnel to perform the work specified in this SOW. The Contractor shall make sure that subcontractor and employees have proper documentation to authorize personnel to work in the United States of America. The Contractor shall maintain the personnel, organization and administrative control necessary to ensure that the work delivered meets the contract specifications and requirements.
2. The Contractor is required that all subcontractor or employees have been screen by the VAMC Wilmington Healthcare System. All personnel are required to wear a VA government furnished badge. All contractor and subcontractor are required to wear a government and company furnish badge while performing services under this contract. The badge will contain a personal picture, name of employee, and Contractor's name. Badges shall be worn on the outer garment attached to the outer shirt or jacket pocket by a button or clip or worn around the neck secured by an appropriate identification card lanyard.
3. Government issued identification badge remains the property of the Government and shall be returned to the issuing office or other designated Government personnel upon transfer of Contractor employees from the contract.
4. The contractor shall insure that employee or subcontractor have valid driver license when driving a vehicle on property.
Management:
1. All information generated in performance of this contract becomes property of the Government and must be surrendered upon request and/or completion of the contract. The Contractor must protect against the destruction and/or misplacement of all information produced under this contract, unless directed under local policy to destroy. This includes both hard and soft copies of data.
2. The Contractor shall not release any information (including photographs, files, public announcements, statements, denials, or confirmations) on any part of the subject matter of this contract or any phase of any program hereunder without the prior written approval of the COR.
3. Contractor personnel or subcontractor shall conduct themselves in a professional manner (i.e.
timeliness, communication; spoken and written etc.). The Contracting Officer may require the Contractor to remove from the job site any employee working under this contract for reasons of suspected misconduct, a suspected security breach, or suspected to be under the influence of alcohol, drugs, or any other incapacitating agent. Contractor employees shall be subject to dismissal from the premises upon determination by the Contracting Officer that such action is necessary in the interests of the Government. The hospital director or designated representative has the authority to bar individuals from the Government facility. The removal from the job site or dismissal from the premises shall not relieve the Contractor of the requirement to provide sufficient personnel to perform the services as required by this performance work statement. The Government shall not reimburse the Contractor for travel and other expenses associated with the removal of personnel.
4. Contractor personnel are not authorized to carry or possess personal weapons to include, but not limited to, firearms and knives with a blade length in excess of three inches, while assigned under this contract.
Safety/Security Requirements:
1. The Contractor shall comply with all applicable federal, state and local laws and ensure performance is secure while protecting material, equipment, and supplies from damage and loss.
The Contractor shall ensure that employees or subcontractor have the proper PPE for the job.
Government security personnel shall have the express right to inspect for security violations at any time during the term of the contract.
Work Attire and Appearance:
1. Contractor personnel shall present a professional appearance commensurate with standards delineated for Government civilian personnel acting in similar capacities.
Personnel Qualification:
1. The Contractor shall be responsible for employing technically qualified personnel to perform the work specified in this SOW and authorized to work in the United States. The Contractor shall maintain the personnel, organization, and administrative control necessary to ensure that the work delivered meets the contract specifications and requirements. The work history of each contractor employee must contain experience directly related to the task and functions he/she is intended to perform under this contract. The Government reserves the right, during the life of the resulting contract, to request work histories on any contractor employee for the purposes of verifying compliance with the above requirements; additionally, the Government reserves the right to review resumes of contractor personnel proposed to be assigned. Personnel assigned to, or utilized by, the Contractor in performance of work shall be fully capable of performing the requirements contained in the SOW in an efficient, reliable, and professional manner.
2. Contractor shall provide a supervisor who speaks English on site at all time.
3. Personnel should be properly trained for safety and performance of their respective duties.
4. Appropriate safety equipment shall be furnished by the Contractor to contractor personnel or subcontractor and shall be used as prescribed by OSHA Standards.
5. The Government reserves the right to review Contractor personnel qualifications. Upon request, resume shall be provided to the Contracting Office prior to clearance approval, for review and acceptance by the COR. The intent is verification purpose and not for the Government to become the hiring authority.
-- Damages/Insurance --
Damages:
1. The Contractor is liable for all damages to Government equipment, property; utilities, etc., located at the site (e.g. sprinkler heads, ceiling tiles, manholes, fire hydrants, vehicles, windows, etc.)
caused by the Contractor, its employees or it subcontractors. The Contractor shall immediately report all damages to the COR and shall provide the Contracting Officer (CO) and COR, a written report, within 24 hrs. The report shall include: What occurred, who was involved, when it occurred (Time/Date), where did it occurred, why it occurred, how it occurred, and the proposed means to repair or replace.
2. Contractor is to maintain free and unobstructed access to facility emergency services and for fire, police and other emergency response forces in accordance with NFPA 241.
INFORMATION REGARDING BIDDING MATERIAL, BID GUARANTEE
AND BONDS
A. TRAINING:
Effective July 31, 2005, all employees of the general contractor and subcontractors shall have the 10-hour OSHA certified construction safety course. The General Contractor’s competent person shall have completed the 30-hour OSHA certified construction safety course. Documentation of training shall be submitted to the Contracting Officer for review and approval prior to any work being performed.
Failure to present the proper training documentation will result in the individual being removed from the job; the individual may only return after the proper documentation has been provided.
There shall be no exceptions to this requirement.
It is the responsibility of the Contractor to provide TB training annually and a PPD test annually for any employees providing services at the VA Medical Center, Wilmington, DE. The government reserves the right to review the contractor’s records. Failure to present the proper training documentation upon the Contracting Officer’s request will result in the individual being removed from the job; the individual may only return after the proper documentation has been provided. There shall be no exceptions to this requirement.
B. PRIVACY AND CONFIDENTIALITY:
Contractors to the Department of Veterans Affairs may be unintentionally exposed to sensitive information. Information maybe overheard, seen on documents or electronic devices, or observed that could potentially violate the privacy and confidentiality of our veterans, employees, volunteers, and their families. Regulations such as, but not limited to the Health Insurance Portability and Accountability Act of 1996 (HIPAA), Freedom of Information Act (FOIA) and Privacy Act of 1974 have been enacted to protect sensitive information from being improperly disclosed. Information should not be divulged or released to anyone unless specifically authorized in accordance with the contracted services. Failure to comply with applicable statutes and regulation can result in the termination of this contract and civil and criminal penalties, including fines and imprisonment. All suspected or actual breaches of the privacy and confidential should be reported immediately to the Contracting Officer, COR or the Facility Privacy Officer.
C. KEYS:
All keys provided the Contractor or any subcontractor for use during the project shall be returned to the COR at completion of the work or upon request. No keys shall be reproduced by the Contractor or any subcontractor. There shall be a charge for each key that is lost or not returned to the COR.
D. CONTRACTOR NORMAL WORK HOURS:
The contractor work hours are from 7:00AM to 4:30PM, Monday through Friday, excluding federal holidays. Federal holidays that fall on a non-workday –Saturday or Sunday—the holiday usually is observed on Monday if the holiday is on Sunday or on Friday if the holiday is on Saturday. The contractor may request authorization from the Contracting Officer to work an alternative schedule or on holidays. However, the Contracting Officer reserves the right to deny or authorize the contractor’s request at his or her discretion considering the best interests of the Government. All federal holidays are observed as non-workdays. Federal holidays can be found on the following web site:
http://www.opm.gov/policy-data-oversight/snow-dismissal-procedures/federal-holidays. These days will be identified during the pre-construction meeting. This contract may require work to be performed off-hours, and any increased costs related to this work will be the responsibility of the contractor.
E. SAFETY/ENVIRONMENTAL VIOLATIONS AND EXPERIENCE MODIFICATION RATE
All offerors shall submit information pertaining to their past safety and environmental record. The information shall contain, at a minimum, a certification that the offeror has no more than three (3) serious, or one (1) repeat or one (1) willful OSHA or any Environmental Protection Agency (EPA) violation(s) in the past three years. All offerors shall submit information regarding their current Experience Modification Rate (EMR) equal to or less than 1.0. This information shall be obtained from the offeror’s insurance company and be furnished on the insurance carrier’s letterhead.
Self-insured contractors or other contractors that cannot provide their EMR rating on insurance letterhead must obtain a rating from the National Council on Compensation Insurance, Inc. (NCCI) by completing/submitting form ERM-6 and providing the rating on letterhead from NCCI. Self-insured contractors or other contractors that cannot provide EMR rating on insurance letterhead from the states or territories of CA, DE, MI, NJ, ND, OH, PA, WA, WY, and PR shall obtain their EMR rating from their state run worker’s compensation insurance rating bureau.
A determination of responsibility will be accomplished for the apparent awardee prior to processing the award. The above information, along with other information obtained from Government systems, such as the System for Award Management (SAM.gov), Veteran Small Business Certification (VetCert), DUN and Bradstreet, Federal Awardee Performance and Integrity Information System (FAPIIS) accessed through the Past Performance Information Retrieval System (PPIRS), Small Business Administration (SBA), Office of Inspector General-Health and Human Services (OIG-HHS), OSHA, Veterans’ Employment & Training Services (VETS 4214) reporting database, and EPA online inspection history databases will be used to make the Determination of Responsibility. Any information received by the Government that would cause for a negative Determination of Responsibility may make the offeror ineligible for award. This requirement is applicable to all subcontracting tiers, and prospective prime contractors are responsible for determining the responsibility of their prospective subcontractors.
As required by the statutory requirement pertaining to the Veterans Benefits Act of 2003 (15 U.S.C. 657f) and in accordance with FAR 6.206, this procurement will be set-aside for Service-Disabled Veteran Owned Small Business (SDVOSB) concerns. Only SDVOSB concerns who are verified in the Veteran Small Business Certification (VetCert) and registered in System for Award Management (SAM.gov) will be eligible to submit proposals.
F. CONTRACTING OFFICER’S REPRESENTATIVE (COR):
In accordance with VAAR 1.604 and 1.602-2 the COR assists in the technical monitoring or administration of a contract. Limited authority is given in writing by the Contracting Officer’s letter of designation describing the COR’s duties and responsibilities. The COR has no authority to make any commitments or changes that affect price, quality, quantity, delivery, or other terms and conditions of the contract (or provisions of the solicitation). The COR’s authority is limited to contract administration functions delegated in writing by the Contracting Officer. In this solicitation and in the specifications, COR may be used interchangeably with Contracting Officer’s Technical Representative (COTR), Resident Engineer, Project Engineer and Engineer/Engineering.
G. POINT OF CONTACT:
All questions are to be directed to the Contract Specialist at the Wilmington VAMC. Do not contact any A/E firm that may be identified herein. The A/E firm does not have the authority to share information with others or bind the government.
H. WAGE AND HOUR LAWS:
The Contractor shall be responsible for the correct title classification of workers and compliance with all applicable wage and hour laws.

INSTRUCTIONS, CONDITIONS AND OTHER STATEMENTS TO

2.1 52.209-7 INFORMATION REGARDING RESPONSIBILITY MATTERS (OCT
2018)
(a) Definitions. As used in this provision—
"Administrative proceeding" means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.
"Federal contracts and grants with total value greater than $10,000,000" means—
(1) The total value of all current, active contracts and grants, including all priced options; and
(2) The total value of all current, active orders including all priced options under indefinite-delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple-award Schedules).
"Principal" means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager;
head of a division or business segment; and similar positions).
(b) The offeror [ ] has [ ] does not have current active Federal contracts and grants with total value greater than $10,000,000.
(c) If the offeror checked "has" in paragraph (b) of this provision, the offeror represents, by submission of this offer, that the information it has entered in the Federal Awardee Performance and Integrity Information System (FAPIIS) is current, accurate, and complete as of the date of submission of this offer with regard to the following information:
(1) Whether the offeror, and/or any of its principals, has or has not, within the last five years, in connection with the award to or performance by the offeror of a Federal contract or grant, been the subject of a proceeding, at the Federal or State level that resulted in any of the following dispositions:
(i) In a criminal proceeding, a conviction.
(ii) In a civil proceeding, a finding of fault and liability that results in the payment of a monetary fine, penalty, reimbursement, restitution, or damages of $5,000 or more.
(iii) In an administrative proceeding, a finding of fault and liability that results in—

(d) The offeror shall post the information in paragraphs (c)(1)(i) through (c)(1)(iv) of this provision in FAPIIS as required through maintaining an active registration in the System for Award Management, which can be accessed via https://www.sam.gov (see 52.204-7).

2.2 52.209-12 CERTIFICATION REGARDING TAX MATTERS (OCT 2025)
(a) This provision implements section 523 of Division B of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts.
(b) If the Offeror is proposing a total contract price that will exceed $7 million (including options), the Offeror shall certify that, to the best of its knowledge and belief, it—
(1) Has [ ] filed all Federal tax returns required during the three years preceding the certification;
(2) Has not [ ] been convicted of a criminal offense under the Internal Revenue Code of 1986;
and
(3) Has not [ ], more than 90 days prior to certification, been notified of any unpaid Federal tax assessment for which the liability remains unsatisfied, unless the assessment is the subject of an installment agreement or offer in compromise that has been approved by the Internal Revenue Service and is not in default, or the assessment is the subject of a non-frivolous administrative or judicial proceeding.

(a) This provision does not apply to acquisitions at or below the simplified acquisition threshold or to acquisitions of commercial products and commercial services as defined in Federal Acquisition Regulation 2.101.

The determinations are described in the most recent unclassified annual report provided to Congress pursuant to section 403 of the Arms Control and Disarmament Act (22 U.S.C.

(ii) No entity owned or controlled by the Offeror has engaged in any activity that contributed to or was a significant factor in the President’s or Secretary of State’s determination that a foreign country is in violation of its obligations undertaken in any arms control, nonproliferation, or disarmament agreement to which the United States is a party, or is not adhering to its arms control, nonproliferation, or disarmament commitments in which the United States is a participating state. For clarity, references to the report in this section refer to the entirety of the annual unclassified report, including any separate reports that are incorporated by reference into the annual unclassified report.
(1) Check the table of contents of the annual unclassified report and the country section headings of the reports incorporated by reference to identify the foreign countries listed there.
Determine whether the Offeror or any person owned or controlled by the Offeror may have engaged in any activity related to one or more of such foreign countries.
(2) If there may have been such activity, review all findings in the report associated with those foreign countries to determine whether or not each such foreign country was determined to be in violation of its obligations undertaken in an arms control, nonproliferation, or disarmament agreement to which the United States is a party, or to be not adhering to its arms control, nonproliferation, or disarmament commitments in which the United States is a participating state. For clarity, in the annual report an explicit certification of noncompliance is equivalent to a determination of violation. However, the following statements in the annual report are not equivalent to a determination of violation:
(i) An inability to certify compliance.
(ii) An inability to conclude compliance.
(iii) A statement about compliance concerns.
(3) If so, determine whether the Offeror or any person owned or controlled by the Offeror has engaged in any activity that contributed to or is a significant factor in the determination in the report that one or more of these foreign countries is in violation of its obligations undertaken in an arms control, nonproliferation, or disarmament agreement to which the United States is a party, or is not adhering to its arms control, nonproliferation, or disarmament commitments in which the United States is a participating state. Review the narrative for any such findings reflecting a determination of violation or non-adherence related to those foreign countries in the report, including the finding itself, and to the extent necessary, the conduct giving rise to the compliance or adherence concerns, the analysis of compliance or adherence concerns, and efforts to resolve compliance or adherence concerns.
(4) The Offeror may submit any questions with regard to this report by email to NDAA1290Cert@state.gov. To the extent feasible, the Department of State will respond to such email inquiries within 3 business days.
(d) Do not submit an offer unless—
(1) A certification is provided in paragraph (b)(1) of this provision and submitted with the offer;
or
(2) In accordance with paragraph (b)(2) of this provision, the Offeror provides with its offer information that the President of the United States has—
(i) Waived application under U.S.C. 2593e(d) or (e); or
(ii) Determined under 22 U.S.C. 2593e(g)(2) that the entity has ceased all activities for which measures were imposed under 22 U.S.C.2593e(b).
(e) Remedies. The certification in paragraph (b)(1) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly submitted a false certification, in addition to other remedies available to the Government, such as suspension or debarment, the Contracting Officer may terminate any contract resulting from the false certification.

REPRESENTATIONS AND CERTIFICATIONS (NOV 2025) (DEVIATION)
(a) Definitions. As used in this provision—
Backhaul, covered article, covered telecommunications equipment or services, critical technology, FASCSA order, Intelligence community, interconnection arrangements, national security system, roaming, sensitive compartmented information, sensitive compartmented information system, source, and substantial or essential component have the meanings provided in the clause 52.240-91, Security Prohibitions and Exclusions.
Business operations means engaging in commerce in any form, including by acquiring, developing, maintaining, owning, selling, possessing, leasing, or operating equipment, facilities, personnel, products, services, personal property, real property, or any other apparatus of business or commerce.
Marginalized populations of Sudan means—
(1) Adversely affected groups in regions authorized to receive assistance under section 8(c) of the Darfur Peace and Accountability Act (Pub. L. 109-344) (50 U.S.C. 1701 note); and
(2) Marginalized areas in Northern Sudan described in section 4(9) of such Act.
