About this file

This document is a justification for other than full and open competition for a federal contract opportunity. The Department of Veterans Affairs Veterans Health Administration Veterans Integrated Service Network 4 is seeking to procure eight Burlodge Meal Delivery Carts, model BLS6S.700, including accessories and disposable dishware, from a single responsible source. The requirement also includes installation services. The justification cites that the Burlodge system is the only one that can meet the medical center's needs in terms of compatibility with existing electrical and utility systems, as well as fitting in the available space. Market research found no other equipment options that meet these requirements. The contracting officer has determined the anticipated costs will be fair and reasonable based on obtaining competitive quotes.

4. Statutory Authority Permitting Other than Full and Open Competition:

(X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;

( ) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2;

( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3;

( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The equipment presently in use at the medical center has exceeded it’s end life and is no longer economical to repair has begun to fail. The failure of the existing equipment poses a risk that the equipment will no longer maintain appropriate temperatures to prevent food borne illnesses. The electrical systems within the kitchen have not been updated to current electrical standards and it is infeasible for the medical center to complete a project to upgrade the system at this time to accommodate the electrical requirements for most new commercial kitchen and meal prep equipment. The Burlodge Meal Delivery System, Model BLS6S.700 is the only system available on the market that can be modified to be compatible with the medical center’s existing utility systems. The Burlodge System will also fit within the kitchen’s existing equipment footprint which will allow it to be installed into the space occupied by the current system without the need to extensively modify the kitchen. The medical center completed an extensive review of available meal delivery systems and none meet the electrical/utilities compatibility required or will fit within the existing space.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Nutrition and Foodservice Staff at the medical center completed extensive market research to identify equipment that will meet their requirements. They completed searches on Google and YouTube to identify possible models and features available on the market. They contacted vendors including Burlodge, Trimark, and Aladdin to obtain information on available equipment. Staff also contacted the manufacturer of their department’s statistical analysis system, Computrition, to determine what equipment is available on the market that will also be compatible with their system.

Sources Sought Synopsis: N/A

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: While competition for this requirement is limited due to the brand name nature of this requirement, there are multiple authorized distributors of this brand of equipment. The requirement will be competed so competitive quotes for the equipment and installation can be submitted. The award will be made to the vendor who offers the lowest price for the exact brand name equipment, accessories, and installation required.

Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: VIP was searched to identify verified capable SDVOSBs and VOSBs results attached and Indexed as P02 VIP. VIP search yeiled 67 possible SDVOSB’s vendors and 5 VOSB’s by NAICS Code 333415. GSA searched and found one (1) SDVOSB. FPDS yielded multiple purchase by other VA facilities to Service Solutions Group.

8. Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A

9. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A

10. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The current age of the medical center’s utility system within the main kitchen limits the new equipment that will function properly within that area. However, when or if the medical center undertakes a project to remodel and upgrade this area of the facility new equipment will be purchased competitively since there will not be a restriction because of the existing utility systems.

11. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
