DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition (>$150K)
Acquisition Plan Action ID: VA244‐18‐AP‐2904
1. Contracting Activity: Department of Veterans Affairs Network Contracting Office 4 in support of the
Lebanon, PA VA Medical Center, 1700 South Lincoln Ave Lebanon, PA 17042
2. Nature and/or Description of the Action Being Processed:
New, one‐year Firm Fixed Price Indefinite Delivery, Indefinite Quantity (IDIQ) for remote teleradiology interpretation services for overnights and weekends.
FAR13.5 Simplified Procedures for Certain Commercial Items: This procurement is for Remote Teleradiology Interpretation Services in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303‐2.
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
The Lebanon, PA VA Medical Center is requesting a sole source contract for remote Teleradiology Interpretation Services to maintain uninterrupted services for after regular duty hours and complete weekend coverage utilizing Radiology Imaging Institute (RII). RII is a SDVOSB contractor and is actively contracted for the same services by several other medical centers in VISN 4. Due to Privacy and Information Security policies GFE (specialized imaging equipment) was procured by the VISN and supplied to the contractor to service all of the medical centers. Annual services requested through task orders are estimated to cost approximately $399,060.00 for the term of the contract.
The requested period of performance will start 01/01/2019 and run through 12/31/2019.
4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(1), as implemented by FAR 6.302‐1.
( x ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302‐1
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
The nature of the acquisition requires the authority as cited in FAR 6.302‐1 because competition or an award to another vendor would create a substantial duplication of cost to the Government because additional specialized GFE would be required to service Lebanon’s contract with another potential contractor. The specialized GFE purchased by VISN 4 previously is to be utilized by the same contractor providing Teleradiology Services to the other VISN medical centers. Currently, several separate contracts to the same contractor exist for the different medical centers and these costs could not be recovered through competition and would be duplicated if any contractor was selected other than the current contractor currently providing services.
Accordingly, Radiology Imaging Institute a SDVOSB, is the only firm capable of providing the supplies and services described in Section III above without the Veteran’s Health Administration experiencing substantial duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: It is not practicable at this time to solicit offerors for this short‐term contract effort. Ongoing market research and discussions are being held as to how efforts will be concerted moving forward for a longer‐term contract for these particular services whether it will be at the local facility level or VISN 4 facility wide at which point in time all efforts will be made to gain potential sources if the marketplace proves available.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The firm‐fixed price for this period of performance is comparable and in line with the current cost of Teleradiology Services being provided by the same source over the same amount of time throughout VISN 4 facilities. There have been no substantial changes in the marketplace which would render the same price unreasonable now.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons
Market Research Was Not Conducted: Researched historical contracts and invoices, conducted VIP searches, verified SAM registrations, created recommended sources list, searched NAICS codes and service codes, researched VA directives, handbooks, and policies, discussed needs with internal subject matter experts and radiology supervisors, created IGCE, price worksheet, and price schedule, as well as conducted FPDS searches.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Radiology Imaging Institute LTD; SDVOSB; 1512 Remini Ct. St. Augustine, FL 32092; POC: Eric Netland, PH: 904‐236‐ 2193, eenetland@gmail.com; DUNS: 089879089.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: A VISN level contract to service all the medical centers in VISN 4 was discussed and an option moving forward. As for the Lebanon VAMC requirement to maintain uninterrupted teleradiology services now, a contract must be in place to prevent interruptions to healthcare.
