Special Notice

The Veterans Health Administration, Network Contracting Office 02 intends to solicit from a single source IAW FAR 13.106(b) to obtain a contract for: It’s Five-Year Review, Evaluation, and Update of the Spill Prevention, Control, and Countermeasure (SPCC) Plan for the VA Hudson Valley Health Care System (VAHVHCS) at Castle Point Campus (CPC) and Montrose Campus (MC). The SPCC program is a regulatory framework designed to prevent oil discharges into U.S. navigable waters and adjoining shorelines by requiring facilities to implement prevention, control, and response measures. The VA Hudson Valley Health Care System is mandated by 40 CFR 112.5(b) to review and evaluate its SPCC Plans for Castle Point Campus and Montrose Campus every five years. The last update to the SPCC Plan was completed in 2021.

Period of Performance (POP) (estimated): 10/22/2026 through 09/30/2027 with provision of (0) option years. All work to begin immediately upon receipt of a contract.

Requirement Description:

The Spill Prevention, Control, and Countermeasure (SPCC) Plan must be a written, management-approved document detailing procedures, control measures, and countermeasures to prevent and respond to oil discharges. The core requirement of such plan includes but is not limited to and must follow good engineering practices and comply with 40 CFR Part 112 regulations, or provide equivalent environmental protection if deviations are necessary (40 CFR 112.7, 112.3)

Certification: Plans must be certified by a licensed Professional Engineer (PE) unless the facility qualifies for self-certification under the “qualified facility” criteria. Certification ensures that the plan meets regulatory and engineering standards (40 CFR 112.3, 112.7)

Plan Content: SPCC Plans must address three main areas:

1. Operating Procedures: Procedures to prevent oil spills during normal facility operations, including handling, storage, and transfer of oil

2. Control Measures: Physical containment systems such as dikes, berms, retaining walls, curbing, drip pans, sumps, collection systems, drainage systems, weirs, booms, spill diversion ponds, retention ponds, or sorbent materials to prevent oil from reaching navigable waters or shorelines

3. Countermeasures: Procedures to detect, contain, clean up, and mitigate oil discharges, including manpower, equipment, and materials needed for rapid response Inspections, Testing, and Records: Facilities must conduct regular inspections and tests of oil storage containers, valves, and piping. Records of inspections, tests, and maintenance must be kept for at least three years. Personnel must be trained in SPCC procedures, discharge prevention, and applicable environmental regulations Security Measures: The plan must describe how the facility secures oil handling areas, master flow and drain valves, starter controls, and loading/unloading connections to prevent unauthorized access and vandalism.

Loading/Unloading Racks: For tank car or tank truck operations, containment systems must hold at least the maximum capacity of a single compartment, and drainage systems must prevent uncontrolled discharges.

Amendments and Updates: SPCC Plans must be reviewed and amended as necessary to reflect changes in facility operations, equipment, or regulatory requirements. New facilities must prepare and implement a plan before beginning operations, while existing facilities must maintain and update their plans to ensure compliance.
