INSPECTION QUESTIONS:

1. These elevators will need Cat-5, 5-year full load rupture valve (overspeed Valve Tests). in order to properly quote the CAT 5's, what year will these inspections take place? I see that the 5-year tests were performed in 2022. The next date will be 2027.

· Yes, the next CAT-5 elevator inspections will be performed in 2027. This will also be reflected in the revised list of line items.

TRAINING QUESTIONS:

1. Is this referring to training designated personnel on how to release passengers who are entrapped inside the elevator?

· Please refer to SOW.

2. If so, I will required all designated personnel to sign a hold-harmless agreement before any training documents or educational information is provided.

· No agreement will be signed.

(FAR 52.212-4(u) Unauthorized Obligations. (1) Except as stated in paragraph (u)(2) of this clause, when any supply or service acquired under this contract is subject to any End User License Agreement (EULA), Terms of Service (TOS), or similar legal instrument or agreement, that includes any clause requiring the Government to indemnify the Contractor or any person or entity for damages, costs, fees, or any other loss or liability that would create an Anti-Deficiency Act violation (31 U.S.C. 1341), the following shall govern: (i) Any such clause is unenforceable against the Government. (ii) Neither the Government nor any Government authorized end user shall be deemed to have agreed to such clause by virtue of it appearing in the EULA, TOS, or similar legal instrument or agreement. If the EULA, TOS, or similar legal instrument or agreement is invoked through an “I agree” click box or other comparable mechanism (e.g., “click-wrap” or “browse wrap” agreements), execution does not bind the Government or any Government authorized end user to such clause. (iii) Any such clause is deemed to be stricken from the EULA, TOS, or similar legal instrument or agreement. (2) Paragraph (u)(1) of this clause does not apply to indemnification by the Government that is expressly authorized by statute and specifically authorized under applicable agency regulations and procedures.)

3. Will I need to include the price of time/material/training into each item number total for the price schedule of this RFQ or will there be a separate price schedule specifically for the time/material/training? How would you like for me to submit this specific pricing?

- See and complete the updated Price/Cost Schedule.

4. Will the training sessions need to take place while I'm onsite during the inspections? Or, can I conduct training at later dates as long as I conduct training twice a year?

· Yes, the training will need to be conducted at a later date (separate date from the inspection dates).

5. Are vendors required to be accredited or hold a specific company-level training certification to facilitate training activities?

· Yes, the person performing the training will need to demonstrate that they are experienced in providing elevator training, and be part of an entity that is actively providing elevator training services.

6. If the company is not accredited or certified for training, can we propose Key Personnel who hold individual-level training certifications, qualifications, and experience?

· The instructor shall be part of an entity that is actively providing elevator training services.
