About this file

This document is a Limited Sources Justification (LSJ) for a lease of Olympus endoscopes and associated equipment for the Department of Veterans Affairs (VA) Stratton VA Health Care System in Albany, New York.

The VA is conducting a sole source acquisition under the Federal Supply Schedule (FSS) program to lease Olympus endoscopes, including pediatric and adult colonoscopes, esophagogastroduodenoscopes (EGDs), and a small bowel scope. The estimated value of the 1-year base period is $401,515.56, with two 1-year option periods. The VA is justifying the sole source to Olympus based on the endoscopes being unique and highly specialized, as well as the need to maintain standardization of equipment across VA facilities in the VISN 2 network. Market research confirmed that no other vendors could provide the required endoscopes for lease. The VA determined that leasing the Olympus equipment represents the best value by ensuring the standard of care, minimizing patient risk, and simplifying user training.

(1) Contracting Activity: Department of Veterans Affairs, Network/Program Contracting Office 02 , located at 2875 Union Road, Suite 3500, Cheektowaga, NY 1422, in support of VISN 02 Stratton VA Health Care System at 113 Holland Ave, Albany, NY 12208 .

(2) Description of Action: This acquisition is conducted under the authority of the Multiple-Award Schedule Program (41 U.S.C. 152(3) and 40 U.S.C. 501).

Order against: FSS Contract Number:

Name of Proposed Contractor: Olympus America Inc.

Street Address: City, State, Zip:

Phone:

3500 Corporate Pkwy.

Center Valley, PA 18034 1-800-848-9024

(3) Description of Supplies or Services:

The estimated value of the proposed action is $401,515.56. The Period of performance is 04/01/2024 to 03/31/2025 with two 1-year option periods.

The Albany VA GI Department requires a lease of endoscopes with cameras and associated equipment to do diagnostic endoscopic procedures.

Types of scopes and accessories required include:

o Pediatric colon scopes o Adult colon scopes o Adult EGD scopes o Pediatric EGD scope o Therapeutic EGD scope o Small Bowel Scope

(4) Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays:

Attachment 2: Request for Limited Sources Justification Format >SAT

FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;

VISN 2 Leadership, in conjunction with a national commodity standardization initiative (for scopes), made the decision to standardize scopes in each of the three-network tertiary care facilities (Syracuse, Albany, and WNY). The decision to standardize around the Olympus endoscopes was based on the following:

The preponderance of scopes in use at the Albany VAMC has been made with Olympus. A significant portion of those in use were within their useful life; and Continued utilization of the scopes that have been predominantly in use maintain the standard of care, minimize patient risk associated with large scale changes in clinical practices associated with those scopes, and reduce training and transition costs associated with use of the same manufacturer.

Attempting to substitute alternatives would cause issues with standardization, which could lead to significant patient risk. Clinician familiarity with a given scope dramatically influences the quality of the procedure, its outcome, and the patient experience.

(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination:

Lease of Olympus Scopes is only available directly through Olympus. A lease has been determined to be the in the VA’s best interest in order to have the flexibility to trade them in at the end of the order performance period and lease the newest model(s) on the market at that time. Leasing newer-model endoscopes ensures that the standard of care is maintained consistently, efficiently, and effectively managing lifecycle maintenance costs, and simplifying user training due to product familiarity. This lease arrangement minimizes patient risk in addition to maintaining the highest levels of scope availability and operational readiness.

(6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted. A VetCert Search using keyword NAICS “339112” did not return any potential sources.

A search of SBA’s DSBS using keyword “endoscope” and NAICS “339112” returned 9 results. The capabilities of the vendors were reviewed. None offer endoscopes for lease. The capabilities include repair/reprocessing services, ancillary supplies, or non-medical scopes.

The results of Market Research for 36C24224F0086, awarded 02-08-2024, were reviewed. 36C24224F0086 was awarded non-competitively to Olympus for the same equipment type for the Syracuse VAMC and was supported by an LSJ.

(7) Any Other Facts Supporting the Justification: The medical center has worked closely with the VISN 2 Network Office to standardize the make and model of endoscopes utilized in order to reduce training costs and lifecycle maintenance costs.

(9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
