COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES

This Request for Quote (RFQ) is issued in accordance with FAR Part 12 in conjunction with

Simplified Acquisition Procedures at FAR 13.5.

Eligibility: In order for a quote to be eligible for this SDVOSB Set-Aside award, the offerors submitting a quote must have the NAICS Code 561730 – Landscaping Services or equivalent

VetCert size standard of $8.5 million and have current registrations in both the System for

Award Management (SAM): https://www.sam.gov/portal/public/SAM and Veteran Small

Business Certification (VetCert) https://veterans.certify.sba.gov/ at the time of quote submission.

E.9 52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND

COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

(1) Evaluation Factor 1 - Technical Capability: Technical capability is defined as an offeror’s ability to satisfy the solicitation’s requirements, providing the highest quality service to the specified facilities. Technical Capability will be determined from the below subsections:

(A) Technical proficiency:

Offeror must submit a proposal that verifies it is a firm that specializes in

Landscaping/Groundskeeping services.

(B) Licensing/certifications

Contractor must provide proof that it’s a licensed business to conduct landscaping and groundskeeping services.

1. NY state fertilizer license

2. NY commercial pesticide applicator license

(C) Technical Plan

Offeror must submit a proposal that explains how it intends to meet all PWS requirements with additional area specific details.

(2) Evaluation Factor 2 - Past Performance: Contractor must provide three references for contract of similar scope and magnitude to be evaluated. Relevant past performance information must include key personnel who have relevant experience, predecessor companies, and subcontractors who will perform major or critical elements of this solicitation. The contractors’ Past Performance will also be reviewed in PPIRs; Individuals with no past performance will receive a neutral rating for this evaluation factor.

(3) Evaluation Factor 3 – Price: The government will evaluate offers for award purposes based on the pricing for the total requirement. Offers for partial requirement will not be evaluated and will be deemed non-responsive upon receipt.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the

Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
