B.2 STATEMENT OF WORK

1. Contract Title: VISN 2 VA New York/New Jersey Healthcare Network Pharmacy – Controlled Substance Destruction

2. Background:

Pharmacy departments across VISN 2 (New York/New Jersey VA Health Care Network) require a service contract with a DEA licensed controlled substance destruction vendor to collect and destroy unusable controlled substance medications via incineration as per DEA requirements to include the required documentation and records. Unusable controlled substance medications are typically accumulated through expiration in original (opened or unopened) containers, unused repackaged medications, and damaged medications in non-original containers. The minimal requirement for the service is a quarterly on-site pickup, but a more frequent interval and as needed services may be required by some locations. Additionally, some locations have existing MedSafe patient return bins for unwanted or no longer needed controlled substances requiring mail in disposal services. The vendor may need to ship liners for incineration at some locations.

This is an Indefinite Quantity Indefinite Delivery Contract with a five (5) year ordering period.

3. Scope:

The scope of this procurement / project is to maintain an annual service contract with a DEA Licensed vendor who will provide destruction of unusable pharmaceuticals (DEA Schedule II – V) and provide all appropriate documentation required by federal and state laws and regulations at the time of pick-up and within 30 days provide proof of incineration. This includes products in original containers (both opened and unopened), repackaged, non-original containers, and sealed liners from patient return bins.

4.Specific Tasks: The contractor shall be required to
•Pre-schedule onsite visits at each VISN 2 pharmacy requiring service at the interval specified (and additionally if requested and funded) with a pharmacy representative at each location. See place of performance below.
•Real-time Inventory and reconcile controlled substances for destruction against the on-site destruction list in collaboration with the locations accountable officer.
•Inventory is not required for items placed in patient return bins. These liners are to be sealed in the presence of a witness, then packaged and shipped for destruction. Liners are to be replaced at the request of the facility.
•Provide a signed receipt/report of all CIII-V and execute DEA form 222 for all CII products taken at the time of transfer. The receipt/report must include medication’s name, strength, dosage form, quantity and date of transfer.
•Provide shipping containers and pre-paid shipping label for all sealed packages used during the transfer.
•Prepare all sealed packages for shipment.
•Contact the shipping company to schedule the pick up from the site.
•Supply the pharmacy service during the visit with tracking number for each box ready to be shipped.
•Supply the site with proof of incineration for each visit for destruction services within 30 days of ship-date.
•No controlled substances will be returned for credit. All products within the scope of this contract are deemed waste and non-creditable.
•Contractor shall have, and maintain throughout the life of this contract, all required licenses, certifications, permits, etc. required to perform these services in accordance with all local, state and federal rules and regulations.
•Ability to add additional sites within VISN 2, if needed at a later time (i.e. Hudson Valley)
5.Performance Monitoring: The following factors will be used to rate the successful performance of this contract:
•Visits are pre-scheduled a minimum of 4 weeks in advance.
•Vendor representatives are on-time as scheduled and/or contact the site within 24 hours of a need to re-schedule, the latter should be not be a routine occurrence but for emergency related circumstances.
•Complete documentation is provided at the time of the visit.
•Proof of incineration is provided for each destruction upon completion, no later than 30 days after ship date and delivered to the pharmacy representative electronically.
•Company representatives are courteous and professional when on site.

6. Security Requirements:

The offering vendor shall comply with pharmacy rules concerning entering and working within the Pharmacy environment. The offering vendor shall work with local pharmacy contacts to assure compliance.

7. Procedures A local pharmacy contact will provide a destruction report upon the arrival of the vendor representative for the visit to ensure that all accumulated items are accounted for. This report may be requested up to 1 week in advance to assist vendor with planning. This report will be checked and signed by the vendor representative, Accountable officer and pharmacy representative and retained by the pharmacy

8. Packaging, Packing and Shipping Instructions Once packaged and sealed, a pre-paid shipping label with tracking number will be affixed to all shipping containers and the containers will be kept in the Pharmacy vault until the Vendor’s chosen mail carrier picks them up.

9. Place of performance and estimated needs:

All Pharmacies within VHA VISN 2 fall within the scope of this contract. The current VISN 2 Pharmacy locations that will immediately begin placing orders, and their respective needs, are:

CONTRACT TERMS AND CONDITIONS—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES
NOV 2021

ADDENDUM to FAR 52.212-4 CONTRACT TERMS AND CONDITIONS—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES Clauses that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available.

The following clauses are incorporated into 52.212-4 as an addendum to this contract:

C.1 52.216-18 ORDERING (AUG 2020)

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from award date through 08/31/2027.

(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.

(c) A delivery order or task order is considered "issued" when—

(1) If sent by mail (includes transmittal by U.S. mail or private delivery service), the Government deposits the order in the mail;

(2) If sent by fax, the Government transmits the order to the Contractor’s fax number; or

(3) If sent electronically, the Government either—

(i) Posts a copy of the delivery order or task order to a Government document access system, and notice is sent to the Contractor; or

(ii) Distributes the delivery order or task order via email to the Contractor’s email address.

(d) Orders may be issued by methods other than those enumerated in this clause only if authorized in the contract.

(End of Clause)

C.2 52.216-19 ORDER LIMITATIONS (OCT 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $50, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor—

(1) Any order for a single item in excess of the IDIQ Maximum;

(2) Any order for a combination of items in excess of the IDIQ Maximum; or

(3) A series of orders from the same ordering office within days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.

(End of Clause)

C.3 52.216-22 INDEFINITE QUANTITY (OCT 1995)

(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.

(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum." The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum."

(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after 08/31/2027.

(End of Clause)

C.4 SUPPLEMENTAL INSURANCE REQUIREMENTS

In accordance with FAR 28.307-2 and FAR 52.228-5, the following minimum coverage shall apply to this contract:

(a) Workers' compensation and employers liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.

(b) General Liability: $500,000.00 per occurrences.

(c) Automobile liability: $200,000.00 per person; $500,000.00 per occurrence and $20,000.00 property damage.

(d) The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage.

(End of Clause) C.5 VAAR 852.212-70 PROVISIONS AND CLAUSES APPLICABLE TO VA ACQUISITION OF COMMERCIAL ITEMS (APR 2020)

(a) The Contractor agrees to comply with any provision or clause that is incorporated herein by reference to implement agency policy applicable to acquisition of commercial items or components.
