ANSWERS TO SUBMITTED QUESTIONS
Question 1. What is the purpose of having only a 3-Month Base Year?
Answer: To align with fiscal year funding.
Question 2. How is the government complying with Section B.2 (SOW), 6, b and c?
Answer:
The SOW requires that the prime contractor have all applicable licenses in order to perform.
The government can ask for copies of those licenses at any time during the performance of the contract.
Question 3. What is the GOV’s rationale for evaluating by Lowest Price Technically
Acceptable?
Answer:
The agency believes that quotes will require little subjective judgement by the Evaluation Team as to the desirability of one quote over another. Therefore, we do not believe that quoters could provide added value or benefit that would justify a best value/tradeoff solicitation.
Question 4. Will the GOV confirm that the SDVOB Prime Contractor must be licensed to distribute medical grade liquid oxygen (a prescription drug) as well as provide a copy of their licensures in both their home state as well as for New York at time of bid submission?
Answer:
While the contractor must obtain all applicable federal, state, and local licenses, the solicitation does not require the prime contractor to provide copies of their licenses at the time quotes are due.
Question 5. Are there any Liability Insurance requirements?
Answer: Yes, see Amended Solicitation and added clauses below.
Question 6. Can the GOV explain why FAR 15 does not apply?
Answer: Removing sentence: “All instances of FAR 15 procedures in FAR 52.212-1 shall not apply to this RFQ and is hereby substituted with FAR 13 procedures”.
Question 7. Explain Evaluation Factors.
Answer: Changes to Evaluation Factors see Section E.2 Addendum to FAR 52.212-1 of
Amended Solicitation and below.
Question 8. Explain Basis of Award.
Answer: See Section E.3 (a, 1) and (a, 2).
CHANGES TO SOLICIATION:
1. Adding contract maximum price ceiling to SOW (1, b).
2. Adding FAR referenced clause to Section C.15:
52.228-5 Insurance – Work on a Government Installation (JAN 1997)
3. Adding Supplemental Insurance Requirements C.16:
In accordance with FAR 28.307-2 and FAR 52.228-5, the following minimum coverage shall apply to this contract:
(a) Workers' compensation and employers’ liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.
(b) General Liability: $500,000.00 per occurrences.
(c) Automobile liability: $200,000.00 per person; $500,000.00 per occurrence and $20,000.00 property damage.
(d) The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage.
(End of Clause)
4. Removing sentence: “All instances of FAR 15 procedures in FAR 52.212-1 shall not apply to this RFQ and is hereby substituted with FAR 13 procedures”.
5. Change to Section E.2 ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS –
COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES
b. EVALUATION FACTORS SUPPORTING DOCUMENTS:
**ALL QUOTATION PREPARATION COSTS WILL BE THE SOLE RESPONSIBILITY OF THE
QUOTER. THE GOVERNMENT WILL NOT REIMBURSE ANY FIRM FOR ITS QUOTE
PREPARATION COSTS.**
This section provides general guidance for preparing quotations as well as specific instructions on format and content of the quotation. The Quoters’ quotation must include all data and information requested herein and must be submitted in accordance with these instructions.
Nonconformance with the instructions provided herein will result in the quotation being found incomplete. Incomplete quotes will not be further considered for award. Quotations must be clear, concise, and must include sufficient detail for effective evaluation and for substantiating the validity of the claims stated in the quotations.
The quotation should not simply rephrase or restate the Government’s requirements but instead must address how the Quoter intends to meet the requirements described in this solicitation.
The Quoter should assume that the Government has no prior knowledge of its abilities and experience and will base its evaluation entirely on the information presented in the quotation.
Elaborate brochures or documentation, binding, detailed artwork, or other embellishments are unnecessary and are not desired.
***Quoters are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements.
The Quote shall consist of two (2) Evaluation Factors:
Factor One (1): Technical
Factor Two (2): Price
Evaluation Factor 1 – TECHNICAL
a. The Quoter shall provide technical information that demonstrates how it intends to successfully meet all the requirements of the Statement of Work in the areas listed below. Failure to adequately address these specific areas in the statement will result in the quote being found incomplete or technically unacceptable.
1. Describe Quoter’s approach to switching out bulk oxygen systems, where necessary, without interruption to supply. Include a preliminary schedule for the transition that demonstrates when each facility will be transitioned and that demonstrates that all transition activities will be accomplished within the timeframe established the
Statement of Work.
2. Describe Quoter’s telemetry system, its process for monitoring the telemetry readings, and its process for scheduling orders as referenced in the Statement of
Work.
b. In the event that the Quoter is not the manufacturer, the Quoter must identify the medical grade bulk liquid oxygen manufacturer(s) that will be used as sub-contractors and provide verification of the manufacturer’s licensing, permits or registrations as required by New York State.
c. The Quoter must provide a draft agreement (in the event that the quoter is not the manufacturer) between the Quoter and the manufacturer of the medical grade bulk liquid oxygen that will be supplied under the contract affirmatively demonstrating that the
Quoter will be authorized by the manufacturer to resell the manufacturer’s medical grade bulk liquid oxygen. Failure to provide this documentation will be render the quote incomplete and will not be further evaluated for award.
Evaluation Factor 2 - PRICE
Must contain one (1) complete copy of B.3 PRICE/COST SCHEDULE
