Acquisition Plan Action ID: 36C242-21-AP-0907 Contracting Activity:
Department of Veterans Affairs, VISN 02, Buffalo, NY VA Medical Center. Purchase Request: 528-21- 2-4192-0022 Nature and/or Description of the Action Being Processed:

Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
This requirement is a result of the ongoing COVID-19 pandemic. It was not known how long this pandamic would last and whether the hospital would allow workers and visitors access. Therefore, it became apparent initial screening and measures to dictate social distance and traffic flow is required. An urgent request from the facility was initiated to award a contract as quickly as possible in the interest of patient care and support of ongoing facility operations/projects. All four SDVOSBs who will received a RFQ are qualified and have done similar work for the VA in Network 2.
Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
The Contracting Officer contacted four (4) contractors by email to determine interest in the project and if they would offer a bid. All four answered affirmatively and have done considerable work in VISN 2. This approach satisfies the requirement in FAR 6.302-2(c)(2). All are SDVOSB.
Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
The Engineering Department presented an IGCE based on RS Means calculation methodology. This is considered a reliable industry standard for pricing projects. All of these contractors have performed many jobs in VISN 2 where fair and reasonable pricing could be determined.
Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
Market research relied on an examination of the acquisition history and experience of the contractors contacted in this market for the same or similar items.
Any Other Facts Supporting the Use of Other than Full and Open Competition:
None.
Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
DMyles Construction, Inc.
U. S. Innovative Construction, LLC Northern Dreams Construction, Inc.
Welch Construction, Inc.
A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
There were no barriers to competition other than the urgency to support COVID-19 related requirements.
