DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For

Other Than Full and Open Competition (>SAT)

Acquisition Plan Action ID: VA-19-00094544; 2237: 632-20-1-2314-0001

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 02, Northport VA

Medical Center, 79 Middleville Road, Northport, NY 11768. Network Contracting Office (NCO2).

2. Nature and/or Description of the Action Being Processed: Network Contracting Office (NCO) 02 proposes to negotiate sole source award with Valor Construction Corp to deliver and install the Door Top/Bottom Alarm System for two locked psychiatric units, Unit 21 and Unit 22, located at the Northport VA Medical Center. This acquisition will be conducted using sole source procedures, based on only one vendor being certified to procure and install the Door Top/Bottom Alarm System manufactured by Door Control Services. In addition, any vendor that is not qualified or intimately familiar with the Door Top/Bottom Alarm System for psychiatric units could adversely impact the patients and staff members of these two units. This system serves critical behavioral healthcare services located in Unit 21 and Unit 22.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: As per VA Directive, a Door Top/Bottom Alarm System is required to be operational by 1/1/2020 and Network Directors are required to certify that Door Top/Bottom Alarm Systems have been installed and inspected by 2/1/2020. This Door Top/Bottom Alarm System is the same system that is currently purchased by the Albany VAMC and in use at the Charles George VAMC located in North Carolina. This is the only system that covers both top and bottom alarms. This system prevents a patient from hanging oneself from the top of the door and it prevents an alligator roll suicide attempt. Procurement, delivery, and installation of the Door Top/Bottom Alarm System. The patient room doors represent a vulnerability to the patients located in Unit 21 and Unit 22 because the patient room doors are ligature points. This system is required to mitigate suicide. On Unit 21 there are twelve (12) patient rooms doors with one (1) central station. On Unit 22, there are thirteen (13) patient room doors with one (1) central station.

4. Statutory Authority Permitting Other than Full and Open Competition:

( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1;

( ) (2) Unusual and Compelling Urgency per FAR 6.302-2;

( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3;

( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5;

( ) (6) National Security per FAR 6.302-6;

( ) (7) Public Interest per FAR 6.302-7;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Door Top/Bottom Alarm System is manufactured by Door Control Services. Door Control Services is the sole provider of the Door Top/Bottom System. Valor Construction is an authorized and trained installer of this system.

This vendor has proprietary rights of the Door Top/Bottom Alarm System and this system satisfies agency requirements. Improper procurement or installation could cost the medical center significantly more over time due to inferior parts, equipment, and labor. In addition, a vendor that is not intimately familiar with the Door Top/Bottom Alarm System could adversely impact the patients and staff members located in Unit 21 and Unit 22. As mentioned, Valor Construction Corp, is an authorized installer of this equipment by the manufacturer. This vendor is capable of providing the procurement, delivery, and installation of the Door Top/Bottom Alarm System without the Northport VA Medical Center experiencing substantial duplication of cost that could not be expected to be recovered through competion and unacceptable delays in fulfilling its requirements.

Door Control Services is the only authorized retailer in New York State.

6. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated cost of the government will be fair and reasonable based on the comparison to the independent government cost estimate and historical pricing date in accordance with FAR 15.404-1(b)(2)(v) and FAR 15.404-1(b)(2)(ii).

7. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted: Valor Construction is a Certified Service-Disabled Veteran Owned Business and is certified by the manufacturer Door Control Services (DCS) of the door top / bottom alarm to install their systems. DCS is the only manufacturer to produce a top and bottom (infrared beams) of door alarm system. The DCS system was purchased by the Albany NY Stratton VAMC and is currently used at the Charles George VA Medical Center Asheville, N.C. Dormakaba USA is a supplier of a competing top door alarm system (SEDA Stanley Emergency Door Alarm) which uses a pressure switch on the top of the door, but does not cover the bottom of the door.

8. Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A

9. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Valor Construction

Corporation.

10. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: NCO2 will post a notice of intent to sole source in accordance with FAR 5.201 which will include the statement of work.

11. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
