DEPARTMENT OF VETERANS AFFAIRS

JUSTIFICATION RESTRICTING COMPETITION FOR COMMERCIAL PRODUCTS AND SERVICES – ACQUISITIONS VALUED AT OR BELOW THE SIMPLIFIED ACQUSITION THRESHOLD (SAT) IN ACCORDANCE WITH RFO 12.102(a)

Acquisition Plan Action ID: 36C241-26-AP-2981

1. Contracting Activity: Department of Veterans Affairs, Network/Program Contracting Office 1, located at West Haven, CT, in support of the Providence VA Medical Center.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

This justification is for a new Firm-Fixed Price contract in accordance with RFO Part 12 Acquisition for Commercial Products and Commercial Services and specifically RFO 12.102 Restricting Competition, where acquisitions conducted under Simplified Acquisition Procedures valued at or below the Simplified Acquisition Threshold (SAT) require a justification that only one source is available and the basis for the decision.

The Department of Veterans Affairs Health Care System seeks procurement of a Prime Zoom Electric Stretcher for the Providence VA Medical Center. The VA Center requires four (4) Prime zoom Stretchers that include alarm, siderails, foot end controls, Stage IV Poles, Integrated Pump rack and ISOFLEX SE Fire Barrier mattress. The required Items are necessary to continue the standardization of all stretchers found at the VA Medical Center.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The Stryker brand Prime with Zoom Motorized Drive Stretcher provides an innovative Zoom Motorized Drive System with advanced technology design that virtually reduces strenuous pushing, pulling and steering which can often result in threatening back injuries. These features not only increases efficiency, but more importantly, contribute to long-term back health. It is equipped with a Recovery Chair Position. This unique position helps eliminate the need for unnecessary transfers by providing a comfortable position for patients to recover. This innovative feature makes daily patient handling easier and supports both patient and hospital staff safety. The Stretcher is equipped with Zero-gap Glideaway Siderails. With ONE fluid motion, these Glideway side rails provide maximum patient security when raised and zero transfer gap when lowered. It is the only stretcher on the market with six wheels. The primary steering mechanism functions on two wheels not one eliminating any sliding across the floor when turning or cornering.

4. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A SBS search for NAICS 339113 and keyword “Prime Zoom Electric Stretchers” returned 150 results. Additionally, an ADDSUP search with the keyword “Prime Zoom Electric Stretchers” found 5 capable vendors; STRYKER SALES, LLC, TRILLAMED LLC, VETERANS HEALTHCARE SUPPLY SOLUTIONS, INC, BEACON POINT ASSOCIATES LLC, and FOUR POINTS TECHNOLOGY, L.L.C. Correspondence with the Manchester VAMC resulted in a need for the Stryker brand Prime Zoom Electric Stretchers to continue standardization of the Providence VA Medical Center. An initial market research survey with Stryker Sales found that Stryker brand stretchers are proprietary to Stryker which is the Original Equipment Manufacturer (OEM). Stryker provided an authorized reseller letter stating that only Trillamed and Beacon Point Associates are authorized to distribute their products. Both vendors are SDVOSB distributors. Querying the Government-wide database of contracts and other procurement instruments resulted in SAC contract# 36C10G22D0032 found to be awarded to Trillamed LLC and GSA contract# 36F79721D0021 was found to be awarded to Stryker Sales LLC. There is no NMR waiver for NAICS 339113. Without the NMR Waiver, per VAAR 819.7003(d), there cannot be a SDVOSB set-aside. With the SBA NMR Exception, per FAR 19.502-2(a), the requirement is eligible for a Straight SB Set-Aside.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR 12.102(a). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
