About this file

This is a Special Notice of Intent to Sole Source a contract for BD FACSLyric flow cytometry systems to Becton, Dickinson and Company (BD). The Department of Veterans Affairs, Network Contracting Office 1 (NCO 1) in Boston, Massachusetts intends to award a firm-fixed price sole-source contract to procure two BD FACSLyric 3L12C Instrument USIVD units (model 663518) for the VA Boston Healthcare System, Pathology & Laboratory Medicine Service, located at 1400 VFW Parkway, West Roxbury, Massachusetts. The procurement includes comprehensive supporting equipment and supplies: two computer bundles, printers, 27-inch monitors, barcode scanners, extended use tanks, universal loader options, tube racks, flow cytometry beads in multiple fluorescent colors, cleaning solutions, sheath fluid, counting tubes, analysis software (FACSuite Multitest assays, FACS Workflow Manager v1.2), and one-year software renewal licenses. The product service code is 6515, and the NAICS code is 339112.

Interested parties may submit responses by June 12, 2026, at 1:00 PM Eastern Time demonstrating clear and convincing evidence that competition would be advantageous to the Government and that alternative sources can meet the agency's specific requirements. The rationale for sole-source procurement is that the BD FACSLyric systems are fully compatible with the VA's existing BD instruments, software, and antibodies, ensuring operational continuity, preventing costly reagent replacement, and avoiding the need to revalidate established testing protocols. Transitioning to a different manufacturer would require extensive staff retraining and significantly disrupt critical patient diagnostic services. The contracting office is located in Augusta, Maine (ZIP 04330), with Contract Specialist Dewan Britton serving as the point of contact (Dewan.Britton@va.gov; 910-341-5300). No reimbursement will be provided for costs incurred in preparing responses. The notice will be archived 30 days after the response date.

2. Rationale for Sole Source

The new BD FACSLyric systems are fully compatible with the VA’s existing BD instruments, software, and antibodies currently in use, ensuring operational continuity and preventing the need to replace existing reagents or revalidate established testing protocols. Transitioning to a different manufacturer would require extensive staff retraining, significantly disrupt testing throughput, and delay critical patient reporting. By maintaining alignment with current system interfaces, workflows, and staff proficiency, BD equipment avoids these operational disruptions and supports uninterrupted delivery of diagnostic services.
