DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C241-26-AP-1429
1. Contracting Activity: Department of Veterans Affairs, VISN 1, Knowledge Information Service,
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The Department of Veterans Affairs (VA) Veterans Integrated Service Network 1 (VISN 1) requires a Base-Plus-Two-Year Micromedex/Redbook Pharmaceutical Library Journal Subscription offering a selection of 105 electronic journal titles from various publishers and medical, nursing and specialty associations.
3. Unique characteristics that limit availability to only one source, for the reason that no other supplies or services can be used: VISN 1 Knowledge Information Library has standardized to the Micromedex/Redbook pharmaceutical information resource. The VISN 1 library staff has standardized to the Micromedex/Redbook Pharmaceutical Knowledge Information Library Journal due to its continuing and longtime use across the pharmacy departments in VISN1. The library staff selected the Micromedex/Redbook combo due to its consistency in providing easily searchable and accessible pharmaceutical knowledge and pricing data within the VA, across the Government and throughout the medical industry.
The Micromedex/Redbook knowledge platform integrates special databases on drug and pharmaceutical information that focus on interactive drug interactions, drug identification, IV compatibility, and drug pricing.
The VISN1 Knowledge Information Service subscribes annually to Micromedex/Redbook online pharmaceutical journals to assist staff conducting pharmaceutical library searches via annual Micromedex/Redbook Journal subscriptions The library staff have standardized to Micromedex/Redbook, due to its high-quality pharmaceutical library, due to its ease of access for pharmaceutical research, and due to the speed and expediency of accessing drug information and cost data.
The Micromedex/Redbook journal configuration is the preferred Pharmaceutical Knowledge platform in the VISN 1, across the Government, and throughout private-sector medical facilities. This is indicated by the high journal subscription rated for Micromedex/Redbook and by the high monthly usage rates. The Micromedex/Redbook journal configuration is peculiar in its ability to compare topical literature and give an informed synopsis of relevant trials for indications. Micromedex/Redbook excels in producing results for drug cost research: drug availability, available drug formulations, ordering availability and NDC (National Drug Code) numbers for ordering. Micromedex is also peculiar in its ability to compare topical literature and give an informed synopsis of relevant trials for indications.
The VISN 1 library staff organized trial comparisons between the Micromedex/Redbook and for Lexicomp/Redbook configurations to evaluate capabilities such drug monograph content, drug interactions, IV drugs, and drug costs. Most review team members found that Micromedex and Lexicomp comparable in basic knowledge library functions. However, the pricing database performance of the Redbook/Micromedex combination outperformed the Redbook/Lexicomp journal configuration.
· The Micromedex/Redbook Platform was faster and more comprehensive regarding drug monograph content, regarding drug interactions with food/ethanol/tobacco, lab test scenarios, and for pregnancy/lactation conditions.
· The Lexicomp/Redbook configuration offered comprehensive data but required more effort.
· The Micromedex/Redbook platform was superior in researching drug costs and availability.
· Micromedex/Redbook also outperformed Lexicomp/Redbook in producing results for available drug formulations, drug availability and NDC numbers for drug ordering.
· Pharmacists who had used both the Micromedex Platform and the Lexicomp Platform stated that the Lexicomp tool was not as capable when paired with the Redbook drug pricing tool.
· Micromedex is also accessible via mobile device. This capability is essential for staff working at the Veteran patient “Point of Care.”
VISN 1 has subscribed to the Micromedex/Redbook Journal for many years and has been deemed by the VISN 1 Knowledge Information Library staff as the pharmaceutical database /pricing information platform offering the best value to VISN 1 clinical providers to provide competent patient care.
4. Description of market research conducted and results or statement why it was not conducted: An SBS search for NAICS 513210 returned (61) results for SBs. The results were sorted for keyword “Micromedex”. There were zero results. Merative US L.P., the software manufacturer is a Large Business (LB). Correspondence with Merative resulted in Merative stating the Micromedex Information Resource Subscription is unique and proprietary to Merative. Merative also provided a list of authorized resellers; J.E. Federal Enterprises, LLC and Cox Subscriptions, Inc. Per the SBS Profile sheet for Cox Subscriptions; Cox is not an SB for NAICS 513210.
Market research comparison and analysis were conducted by the Knowledge Information Services Library Team to determine which Pharmaceutical Platforms in the Market could satisfy the requirements for a Reference and Education Platform for the VISN1 VA Pharmaceutical Services. The Micromedex Subscription was determined to best satisfy the needs of the Government. Redbook was added to provide pricing information to coordinate with Micromedex data.
A team of subject matter experts, primarily comprised of VISN 1 Librarians and Pharmacists, initially surveyed pharmacy databases comparable with the Micromedex package currently on contract and accessed by VISN 1 clinical staff. The other pharmacy databases examined were Lexicomp (published by Wolters Kluwer), and Clinical Solutions (published by Elsevier).
Clinical Solutions came closest to the journal content required. The analysis of Clinical Solutions and Lexicomp found Lexicomp, the more comparable of the two platforms, to be a less robust pharmacy resource regarding VA knowledge base requirements
There is no NMR waiver for NAICS 513210. Without the NMR Waiver, per VAAR 819.7003(d), there cannot be a SDVOSB set-aside. The NMR is not satisfied; LOS will apply. With the SBA NMR Exception, per FAR 19.502-2(a), the requirement is eligible for a Straight SB Set-Aside. However, there is only (1) SB class distributor.
Additional market research was performed by Contracting. The required Pharmaceutical Reference and Education Platform is not available from any mandatory source. GSA Advantage, GSA E-Library, and FPDS websites were searched for Micromedex Subscription. GSA Advantage was searched using the keyword “Micromedex Redbook,” and produced one (1) FSS contract, GS-35F-0312U is for an IBM direct database.
This FSS contract is attached to BPA 47QTCA21A000C. This BPA is held by Four LLC. I is not the same Micromedex Redbook bundle required by VISN1. An FPDS search for “Micromedex Redbook” identified (2) VA distributors: One contract was awarded to J.E Federal Enterprises, LLC in 2020. The Merative Micromedex Redbook Pharmaceutical Knowledge/Pricing database has been used by VISN 1 for over eight (8) years.
Nonmanufacturer Rule (NMR) Findings: There is no NMR waiver for NAICS 513210. Without the NMR Waiver, per VAAR 819.7003(d), there cannot be a SDVOSB set-aside. LOS (Limitations on Subcontracting) apply. With the SBA NMR Exception, per FAR 19.502-2(a), the requirement would be eligible for a Straight SB Set-Aside, however, there is currently only (1) authorized SB class distributor; the SB Rule of (2) cannot be met.
Recommendation: The recommendation is for “fair and open competition other (FAOCO)” between the two (2) Merative-authorized distributors, JE Federal Enterprises LLC. and Cox Subscriptions Inc. Without an individual waiver from the SBA, we cannot technically pursue a FAR 12.102(a) single source; there is more than (1) reasonably available distributor. With (2) Merative-authorized distributors reasonably available to compete, and to maximize competition to the maximum extent practicable, the recommendation is to compete as a brand requirement between the (2) Merative-authorized distributors IAW FAR 6.302-1(c). Competition is expected to provide the best value to the Government.
Per VAAR 819.7003(d), VFCP cannot be leveraged without an NMR Waiver; the LOS applies. To apply VFCP for competition or for an SD/VOSB single source, VAAR 819.7003(d) requires that both the NMR and the LOS are satisfied. To award as an SD/VOSB set-aside to the sole SDVOSB, we would need an NMR Waiver or an individual Waiver from the SBA. The NMR Tree supports an SB Set-Aside. However, with one SB distributor available, the SB Rule of (2) is not met. The SBA NMR Exception cannot be leveraged. There are no mandatory sources or contracts nor any non-mandatory NAC/FSS contracts, SEWP, or other National Contracts that carry the required software licenses. FAOCO competition between the two (2) Merative-authorized distributors, offers competition to the maximum extent practicable. Procuring the required Merative Micromedex Redbook Online Journal Subscription provides the best value to the Government; it is anticipated that competition will afford a fair and reasonable price.
Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
