About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition (OFOC) for a contract to repair the steam line at the VA Bedford Medical Center's chapel. The repair work includes replacing steam traps, valves, pressure reducing valves, condensate pump, and insulation, as well as repairing the steam piping. The contract is being sole-sourced to Veteran's Development Corp (VDC), an SDVOSB contractor, due to the urgency of the requirement and VDC's experience with similar emergency work at the facility. The anticipated award price will not exceed $5 million, and the contracting officer has determined the price will be fair and reasonable. The related federal contract opportunity is Solicitation Number 36C24125B0002 for the Chapel Steam Line Repair, which was awarded to VDC for $480,800.00 on 11/08/2024.

( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

VDC currently has an emergency contract for this work with VA Bedford. After exhaustive bidding process in past jobs and current jobs solicited with similar requirements to this, VDC was found to be the most cost efficient and readily available to address this pressing need. As required to meet the criteria for 6.302-2, delay of award would cause financial injury to the Government. As winter approaches a delay in steam pipe repair causes a delay in the return of steam heating to the building in which they are housed. If not corrected before freezing all pipes in the building could burst causing more damage. As required to meet the criteria for 6.302-5 and 806.302-570, VDC is determined to be a responsible source with respect to performance of such contract opportunity; the anticipated award price of the contract (including options) will exceed the simplified acquisition threshold, but will not exceed $5 million; and contract award can be made at a fair and reasonable price that offers best value to the United States.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

No efforts were made to ensure that offers are solicited from as many potential sources. This would not be practical as this requirement is urgent and further delaying award of this contract would impact patient care and quality of life.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable:

To ensure that the anticipated cost will be fair and reasonable, the contracting officer will compare the proposed cost to the independent government estimate (IGE) and historical pricing for similar type work.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

Market research for this requirement was not conducted due to the urgent need to have this work completed.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

VDC currently has an emergency contract for similar types of work on our campus and has responded outstandingly to emergency issues that have occurred.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
