Combined Synopsis Solicitation – Togus, ME – Elevator Service Contract

(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

(ii) The solicitation number is 36C24123Q1072 and the solicitation is issued as a request for quotation (RFQ).

(iii) A statement that the solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2020-04.

(iv) This requirement is being issued as an open market; veteran owned small business set-aside. The associated NAICS code is 238290 – Other Building Equipment Contractors - small business size standard is $22 million.

(v) The Government intends to award a firm-fixed price award for Elevator Maintenance & Service at the Togus Maine VAMC. Please see the attached Statement of Work for full requirement details.

(vi) The Contractor shall perform inspection, repair, preventative maintenance, and emergency repair response on all elevators located at VAMC IAW the attached Statement of Work (SOW). Please see the attached SOW for full requirement details.

(vii) The Place of Performance is Togus VA Medical Center as described per the SOW.

(viii) Provision at 52.212-1, Instructions to Offerors -- Commercial, applies to this acquisition in addition to the following addenda to the provision: 52.252-1 Solicitation Provisions Incorporated by Reference (FEB 1998); 52.204-7 System for Award Management (OCT 2018); 52.204-16 Commercial and Government Entity Code Reporting (JUL 2016); 852.252-70 Solicitation Provisions or Clauses Incorporated by Reference (JAN 2008)

(ix) Provision at 52.212-2, Evaluation -- Commercial Items, applies to this requirement.

Submission of Quotes:

(1) Quotes shall be received on or before the date and time specified in Section (xv) of this solicitation. Note: Offers received after the due date and time shall not be considered.

(2) Offerors shall submit their quotes electronically via email to kenya.mitchell1@va.gov and joshua.davis5@va.gov.

(3) Questions: A site visit is scheduled for 14, September 2023 @ 10:00 AM* Questions shall be submitted to the Contracting Officer in writing via e-mail. Oral questions are not acceptable due to the possibility of misunderstanding or misinterpretation. The cut-off date and time for receipt of questions is 15 September 2023 at 12:00 AM EST. Questions received after this date and time may not be answered. Questions shall be answered in a formal amendment to the solicitation so all interested parties can see the answers..

(4) Quote Format: The submission should be clearly indexed and logically assembled in order of the evaluation criteria below. All pages of the quote shall be appropriately numbered and identified by the complete company name, date and solicitation number in the header and/or footer.

Evaluation Process:

Award shall be made to the best value, as determined to be the most beneficial to the Government. Please read each section below carefully for the submittals and information required as part of the evaluation. Failure to provide the requested information below shall be considered non-compliant and your quote could be removed from the evaluation process.

Offeror quotes shall be evaluated under FAR Part 13.106-2(b) -- Evaluation of Quotations or Offers. Therefore, the Government is not obligated to determine a competitive range, conduct discussions with all contractors, solicit final revised quotes, and use other techniques associated with FAR Part 15. The contracting techniques associated with FAR Part 15 are not mandatory.

The Government shall award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation shall be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. Price (Follow these instructions):

a. Offeror shall complete the attached Price Schedule, with offerors proposed contract line item prices inserted in appropriate spaces.

b. Ensure your representations and certifications are complete in the System for Award Management (SAM)(https://www.sam.gov). Otherwise, you will need to fill out solicitation Clause 52.212-3 "Offeror Representation and Certifications -Commercial Items” and submit with the quote. Federal Acquisition Regulations require that federal contractors register in the SAM database at http://www.sam.gov and enter all mandatory information into the system. Award cannot be made until the contractor has registered. Offerors are encouraged to ensure that they are registered in SAM prior to submitting their quotation.

2. Past Performance:

a. Provide one (1) but not more than three (3) references of work, similar in scope and size with the requirement detailed in the SOW. References must include contact information; brief description of the work completed, and contract # (if relevant). Please utilize– Past Performance Worksheet for your references and please submit as part of your quote submission. References may be checked by the Contracting Officer to ensure your company is capable of performing the Statement of Work. The Government also reserves the right to obtain information for use in the evaluation of past performance from any and all sources.

3. Technical: The offeror’s quote shall be evaluated to determine if the organization has the experience and capabilities to provide the requested services IAW the SOW in a timely efficient manner.

a. Contractor shall demonstrate their corporate experience and approach to meet all requirements stated in the SOW.

b. Contractor shall demonstrate that their technicians meet the qualification standards stated in the SOW.

c. If you are planning to sub-contract some or all of this work, please provide the name and address(s) of all subcontractor(s) (if applicable) and a description of their planned subcontracting effort.

(x) Please include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications -- Commercial Items, with your offer via the SAM.gov website or a written copy.

(xi) Clause 52.212-4, Contract Terms and Conditions -- Commercial Items (OCT 2018), applies to this acquisition in addition to the following addenda to the clause: 52.204-16 Commercial and Government Entity Code Maintenance (JUL 2016); 52.219-6 Notice of Total Small Business Set-Aside; 52.232-40 Providing Accelerated Payments to Small Business Subcontractors (DEC 2013); 852.203-70 Commercial Advertising (MAY 2008); 852.232-72 Electronic Submission of Payment Requests (NOV 2018) Subcontracting Commitments - Monitoring and Compliance This solicitation includes VAAR 852.215-70, Service-Disabled Veteran-Owned and Veteran-Owned Small Business Evaluation Factors, and VAAR 852.215-71, Evaluation Factor Commitments. Accordingly, any contract resulting from this solicitation will include these clauses. The contractor is advised in performing contract administration functions, the CO may use the services of a support contractor(s) to assist in assessing contractor compliance with the subcontracting commitments incorporated into the “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the contractor's business records or other proprietary data reviewed or obtained in the course of assisting the CO in assessing the contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs. Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The contractor is required to cooperate fully and make available any records as may be required to enable the CO to assess the contractor compliance with the subcontracting commitments.

STATEMENT OF WORK (SOW)

1. REQUIREMENTS

The VA Maine Healthcare System (VAMC) has a requirement for a Contractor to furnish all labor, parts, tools, and equipment to perform inspection, repair, preventative maintenance, and emergency repair response on all elevators located at VAMC. There are currently 29 elevators at VAMC. That number fluctuates consistently due to upgrades and elevators being put in and taken out of service on a daily basis. The equipment is listed individually in the last section #18 of this SOW. Period of performance shall begin from date of award for base year plus 4 years. During the inspection visits, the Contractor shall clean adjust, and lubricate the equipment as specified below, determine the nature and extent of any trouble/problems, and the maintenance required to restore the elevators to safe and satisfactory service, and if conditions warrant, furnish and install parts listed below. All equipment, materials, and installations shall conform to the following codes:

· ASME A17.1 Safety Code for Elevators and Escalators, latest edition

· ASME A17.2 Inspectors’ Manual for Elevators and Escalators, latest edition

· ASME A17.3 Safety Code for Existing Elevators and Escalators, and Dumbwaiters, latest edition

· NEIT Vertical Transportation Standards for Elevators, Escalators, and Dumbwaiters, latest edition

· ANSI/NFPA 70 and 70E National Electric Code, latest edition

· Manufacturer’s requirements and specifications on inspection, maintenance, and operation of each elevator model Period of Performance: based year plus 4 options years.

2. QUALIFICATIONS OF RESPONSIVE OFFERORS

a) The contractor shall be a firm regularly engaged in the repair, maintenance, and servicing of vertical transportation systems, hereinafter referred to as elevators. Their expertise, experience, and regular business shall include the repair, maintenance, and servicing of both traction type machines and hydraulic machines of the passenger, freight, and hospital type elevators. Their expertise shall be of such extent so as to provide them the knowledge of conditions of elevators and the scope of repairs, maintenance, and servicing of elevators generally found in hospital use. They shall possess all the manpower, equipment, tools, and ready sources of parts as necessary to promptly, skillfully, and expertly carry out the conditions of the contract.

b) Contractor shall have an established quality control plan (QAP) to ensure the requirements of the contract are provided as specified below. The plan shall be furnished at any point during the contract upon request from the CO/COR. The plan should contain the following, but not be limited to:

· An inspection system covering all services described in the contract. A checklist used for inspection contract performance during regularly scheduled or unscheduled inspections and the name(s) of the individual(s) who will perform the inspection.

· The checklist shall include every area of the Contractor’s operation as well as every task required to performed.

· A system for identifying and correcting deficiencies in the quality of services before the level of performance becomes unacceptable and/or the Medical Center inspectors point out the deficiencies.

· A file of all inspections conducted by the Contractor and the corrective action taken. This documentation shall be made available to the VAMC upon request, at any time during the term of the contract.

3. QUALIFICATION OF PERSONNEL PERFORMING WORK

All work shall be performed by mechanics and helpers certified by the International Union of Elevator Constructors. A certified mechanic will be with a helper at all times when helper is performing maintenance.

4. INSPECTIONS

a) All passenger and service type elevators shall be inspected weekly; Inspections shall be made to ensure full functionality of each elevator. If a holiday falls on the scheduled day of inspections, the required inspection will be performed on the following workday. Records of inspection shall be submitted to Contracting Officer’s Representative (COR) on the date performed.

b) All freight type elevators and dumbwaiters shall be inspected twice monthly; Inspections will be two weeks apart or sooner if deemed necessary by the government or the contractor. Records of inspections shall be submitted to the COR on the date performed.

c) Annual elevator inspections shall be commissioned by the VA Medical Center as required by VA policy and A17.1, Nation American Standard Safety Code for Elevators and Escalators latest edition. Contractor shall be present for such inspections and shall assist inspector as needed. Inspector/COR will furnish an inspection report listing deficiencies. Items marked emergency shall be corrected immediately. Contractor shall submit a report containing timelines and plan to correct to the CO/COR within 2 days, or items appropriate under this contract shall be corrected within 30 days. Under no circumstances, will the Contractor allow reported deficiencies to go uncorrected beyond the contract period. Any items believed to be outside this contract shall be brought to the attention of the COR.

d) The Contractor shall provide all labor and material to perform work in accordance with ASME A17.1, ASME A17.2, ASME A17.3, NEIT and ANSI/NFPA 70 and ?OE standards for periodic, 6 months, annual and Five-Year tests. The Contractor shall perform tests at the date and time recommended in A17/1 and shall coordinate with the annual VA inspection. Witness of the Five-Year Load Test may be conducted by an independent inspector contracted by the VAMC. Maintenance contractor shall perform actual tests.

5. TESTING

The following services will be performed at intervals specified in the American National Standard Safety Code for Elevators and Dumbwaiters. The maintenance Contractor will furnish personnel to perform the 1 (one) year, 3 (three) year, and the 5 (five) year safety load test, (including weights), at no additional cost to the VAMC. Scheduling of all tests will be handled through the COR. A VAMC’s employee shall be given the opportunity to witness all tests. An outside contractor may witness testing. The Contractor shall make available the uninterrupted services of at least one employee to accompany the inspector during the course of any inspection.

The contractor shall identify the date of the last Five-Year Load Test on each elevator tag and schedule the next Five-Year Load Test accordingly.

6. CLEANING, LUBRICATION AND ADJUSTMENT SERVICES

Cleaning, lubrication, and adjustment services shall be accomplished in accordance with (or exceed) Preventive maintenance Check List (Exhibit #1); and/or when in excess of VA Standards and not contrary to them, as specified by the equipment manufacturer; and/or as required by the state of repair of a particular equipment component or end item.

The work shall include, but not be limited to, the following: main machine, brakes, motors, generators, controllers, relay panels, selectors, operating devices, interlocks and contacts, guide shoes, roller guides in hoistway and car door sills, hangers for all doors and car doors, signal system, car safety devices, governors, tension frames, and sheaves. In addition, the requirement of paragraphs 7, 8, and 9 below shall also apply. Cleaning and refinishing of the interior of cars and exterior of hoistway doors and frames are excluded. The Contractor shall notify the COR, or his designee of any extended downtime (over two hours) due to delay in obtaining service, replacement parts, or other repair functions. Successful offerors may submit to the Contracting Officer for approval an alternate inspection, cleaning, lubrication, and adjustment checklist using Preventive Maintenance Checklist (Exhibit #1) as a guide. The contractor shall document on repair tickets/inspection tickets the nature of work performed and the parts used.

7. CLEANING SERVICE

Guide rails, overhead sheaves and beams, counterweight frames, top of cars, bottom of platforms, pits, and machine room floors shall be brushed, broomed, and mopped clean as specified. All accumulated rubbish shall be removed and deposited in the station provided trash compactor and dumpster. Chemicals, oil rags or other fire hazardous material shall be properly protected in Contractor-furnished VA-approved containers or removed from the station daily after the completion of the cleaning activity.

8. LUBRICATION

All sheave bearings and hoisting ropes shall be lubricated; machine stuffing boxes and bearings on motor operated brakes shall be replaced, and gear cases and guide lubricators shall be refilled when required. Hydraulic fluid sufficient to maintain required operating levels shall be furnished on all hydraulic elevators.

9. ADJUSTMENT SERVICES

All hoisting ropes shall be examined, and the tension equalized and, whenever necessary to insure maintenance of adequate safety factors, all hoisting ropes and governor ropes shall be renewed. If replacement ropes are necessary, the contractor shall submit a proposal to the Contracting Officer for replacement. The proposal shall include a cost breakdown which will show the cost of the ropes and the cost of labor to install. The contractor will not commence with replacement until specifically authorized by the Contracting Officer. The exterior of the machinery and any other parts of the equipment, subject to rust, shall be kept properly painted and presentable at all times. The motor windings shall be kept free of rust where roller guides are used and properly lubricated where sliding guides are used. Guide shoe rollers and gibs shall be renewed as required to insure smooth and satisfactory operation. All electrical wiring and conductors extending to elevators and dumbwaiters from circuit breakers or main line switches in machine rooms and from outlets in the hoistways shall be repaired and/or replaced when required. Circuit breakers or main line switches, together with fuses for same, are excluded.

10. HOURS OF WORK

Work required in the performance of this contract shall be conducted during the hours as outlined below:

a) Maintenance not requiring elevator operational “shut-down” will be performed during the hospital’s regular administrative working hours, 7:00 AM – 3:30 PM except the contractor shall provide emergency call-back service at any hour of any day of the week as specified under Paragraph 13 of this section. Service providers who wish to work other than “normal working hours” for work to be done during those hours must submit a written request to the CO and COR for approval. The request must state that the Service provider is requesting to work other than normal working hours at no additional expense to the Government. Such requests shall be coordinated with the COR and must be submitted to the COR two (2) weeks in advance of planned work.

b) Maintenance requiring elevator operational “shut-down” will be performed during non-standard administrative working hours, weekends and holidays unless otherwise authorized in writing by the Contracting Officer.

c) Prior to commencement and after completion of any work, including INSPECTIONS as required in Paragraph 4 above, during both standard and non-standard business hours, the contractor shall report to a specific office to be designated by the Contracting Officer.

11. MATERIALS TO BE FURNISHED

The Contractor shall furnish all lubricants, cleaning supplies, tools, and equipment necessary to perform the work described above at no additional cost to the government. All lubricants shall be as recommended by manufacturer of the equipment or VA-approved equal thereto.

12. PARTS TO BE FURNISHED AND INSTALLED OR REPAIRED

In accordance with standard elevator industry practice, this is a full maintenance contract. The Contractor will accept these elevators “as is”. Except as listed below, no components are excluded from the requirements of this contract.

a) The Contractor shall furnish and install or repair when and as necessary, machine hydraulic pumps, motor generators, controllers, selectors, worms, gears, thrusts, windings, commutators, hydraulic pump “VEE” belts and pulleys, hydraulic valve components and coils, circuits, magnet frames, relays, contractors, control fuses, cams, car door and hoistway door hangers, tracks and governors, push buttons, annunciators, hail lanterns and indicators, lamp replacements in signa systems and all other elevator signa and accessory equipment complete. All parts shall be the original manufacture’s design and specification or equal thereto.

b) The Contractor shall not supply incandescent or fluorescent lamps for car light fixtures and shaft lights, floor covering on elevator car platform, make renewals, or repairs necessitated by reason of negligence or misuse of the equipment by person other than the Contractor, his representatives and employees or by reason of any other cause beyond control of the Contractor, except normal wear and tear, any new attachments as may be recommended or directed by inspection firms or by Federal, State, Municipal, or other Government authorities. Incandescent and fluorescent lamps excluded above will be furnished to contractor by the Government and Contractor will be responsible for installation.

c) This contract shall also cover those parts not listed in paragraph 11a above which cost less than $1,000.00. The Contractor will be required to replace any part which cost less than the above amount at no additional charge to the Government. The monthly maintenance charge is understood to include the cost of such parts. If it is necessary to replace any part which costs more than the above listed amount the Contractor shall immediately notify the Contracting Officer and provider a cost proposal for the part. The cost proposal shall be for the cost of the part only. The cost of the labor to install the part is understood to be included in the monthly maintenance charge. The Contracting Officer will either provide the Contractor with the part or authorized the contractor to install the part and include the cost of the part on their monthly invoice or by purchase card order. If contractor furnishes the part, a quote from their supplier must be furnished with their invoice for verification of cost by the COR and will be paid by Government Credit Card or by contract modification.

13. EMERGENCY CALL BACK SERVICE

The Contractor must respond to emergency call back service, within two hours or less, (one hour or less if in patient care or patient quarters building and one elevator is already out of service in that particular building), and will be provided in response to requests by telephone or otherwise from the (1) Contracting Officer, (2) COR, or (3) their designees in case of a malfunction or if emergency trouble should develop between regularly scheduled maintenance. This call back service shall be rendered at any hour of any day of the week as requested at no extra charge to the Government. There shall be no more then 9 call backs per month per station when averaged over a six-month period, which is the acceptable rate of callbacks. Failure to maintain an acceptable rate of callbacks will be grounds for canceling the FSS BPA.

14. REPORTS OF SERVICES

Upon completion of the services, the Contractor shall report to the COR or designee, and a written report of services performed shall be furnished to the COR of designee. Such reports shall advise of any repairs or repair parts not required to be furnished under the contract that are necessary to maintain the equipment in perfect operating condition.

Please supply a sample report and explain the method your company uses for reporting. Attach a sample report and the explanation to your offer and submit it with your quote.

15. RECORDS

The Contractor shall maintain a complete orderly and chronological file including drawings which are provided by the VA, complete parts list, and copies of all reports as required by these specifications. A record of all callbacks and repairs shall be kept by the Contractor indicating any difficulty experiences and the corrective measures taken to eliminate these difficulties. The Contractor shall store all information in a computer database. The Data shall be configured so that all entries relate to one another, (i.e., “parts” to “work” using that part). Record of testing. A “Record of Elevator Testing” logbook shall be kept in each machine room. The Contractor shall record all service and tests conducted, by who and the results of the tests including any deficiencies found. This is in addition to recording this information in the Data Base.

At a minimum the data base shall keep track of:

· All service ticket information

· An inventory of all significant parts used during maintenance, what vertical lifting device each part was used on

· Each technician visit, name, time of arrival, time of departure, and nature of the visit

· All parts used, all work performed, all tests performed, lists of deficiencies found during maintenance, and inspections shall be maintained int eh database for each vertical lifting device

· All Preventative Maintenance records shall be maintained on database

· The Record of Firefighter’s Service Test log, for monthly and yearly log, staring October to September shall be maintained on the database

· At the end of the annual contract period the Contractor shall turn over a full report of the contents of the Data Base to the COR

16. CORRECTION OF DEFICIENCIES FOUND DURING ELEVATOR INSPECTIONS AND TESTS

The Offeror will be furnished a list of a deficiencies that were found during the semi- or annual inspection performed by an independent inspection contractor. The Offeror will correct deficiencies noted within 30 days after receipt of the reports.

17. SUPERVISION

Supervision: The Contractor shall provide a Contract manager who shall be responsible for the performance of the work. The name of this person and alternate shall be designated in writing to the Contracting Officer and COR prior to the contract start date. Changes to personnel shall be submitted to the Government within five (5) workdays of the changes. The Contract Manager or alternate shall have full authority to act on all contract matters relating to the daily operation of the contract. The Contract Manager or alternate shall be available to speak/meet with the CO or COR within 24 hours of request during normal operating hours, and or within the next business day after Friday or during a Federal Holiday.

19. Other Per VA Directive 1085, smoking, vaping and smokeless tobacco are prohibited on the grounds of VA facilities, including in vehicles. This Directive applies to all Service provider and their employees.

Service provider’s employees shall not enter the facilities without appropriate badge. They may also be subject to inspection of their personal effects when entering or leaving the facilities.

All employees of the service provider shall comply with VA security management program and obtain permission of the VA police, be identified by service and employer, and restricted from unauthorized access.

Service providers are required to have a badge request form filled out for all personnel (employees, sub-service providers, consultants, inspectors, etc.) Who will be on-station. Service provider will bring completed request forms to the project COR for signature. Service provider will then take signed badge requests to the VAMC police department for processing at least one (1) week prior to arrival of personnel on station. Service provider shall arrange with the police department for a time to return to pick up temporary badges. Any employee who will perform work on station for longer than six months is required to be issued a flash badge. For any employee requiring a flash badge, the Service provider will need to bring the badge request form (with police department approval) back to the COR. The COR will arrange to have employee sponsored in the system. Employee will be notified via e-mail once they are in the system. Employee will then need to arrange a time to complete finger printing and visit the VAMC PIV office to be issued their flash badge. No personnel are allowed to perform any work on station before being issued a badge. No personnel are allowed to perform work on station if their badge is expired.

No photography of VA premises is allowed without written permission of the contracting officer. Patients and staff are not to be photographed at any time.

VA reserves the right to close down or shut down the facilities and order Service provider’s employees off the premises in the event of a national emergency. The Service provider may return to the site only with the written approval of the contracting officer.

Prior to commencing work onsite, and each year thereafter, all Service providers and their provider personnel shall provide proof of receipt of seasonal influenza vaccination in compliance with VHA Direction 1013.

Prior to commencing work onsite, all Service providers and provider personnel shall provide proof of receipt of required COVID vaccinations and boosters in compliance with current VHA Directives.

Prior to commencing work onsite, all Service providers and provider personal shall provide proof of receipt of required Tuberculosis testing in compliance with VHA Directive 1131(5), dated June 4th, 2021.

Parking for Service provider and its employees shall be in designated areas only. Service provider to coordinate with Contracting Officer’s Representative. Parking shall be first-come first-serve.

The Service provider shall confine all operations (including storage of materials) on government premises to areas authorized or approved by the contracting officer. The Service provider shall hold and save the government, its officers, and agents, free and harmless from liability of any nature occasioned by the Service provider's performance.

Working space and space available for storing materials shall be as determined by the COR.

Workers are subject to rules of Medical Center applicable to their conduct. Execute work in such a manner as to interfere as little as possible with work being done by others.

Provide COR with a report or statement of work completed monthly and include statements with requests for payment. Statement should include service completed and the date each service items was completed.

All service providers will sign in and out at engineering upon arrival and departure from station daily. Logbook can be found at B202, 2nd floor engineering.
