CONTINUATION PAGE

See attached document: Supply Solicitation Template_Open Market_v1.3.

The purpose of this amendment is outlined below:

1. Provide updated quote sheet Supply Solicitation Template_Open Market_v1.3. The seven items removed from the updated quote sheet were included on the original solicitation in error.

Vendors must use Supply Solicitation Template_Open Market_v1.3 to submit pricing.

2. Answer all questions received by the 11/2/2022 4:00PM EST deadline. Questions and answers follow on pages 2 – 11.

Clarification: If OEM/Distributors see their sole source items on the quote sheet that haven’t been transferred to their BPA, they are open to bid on this solicitation for a possible sole source modification on their BPA if it applies.

Q: Will there be on ramp periods in the future for additional vendor consideration?

A: The MSPV Program will be issuing quarterly solicitations to add items to the Product List in the future.

Q: The SAM.gov website says the offers are due Friday 11/4 at 11am but the SF1449 says Monday 11/7 at 11am, which is correct?

A: The solicitation closes 11:00AM EST on Monday, 11/7/2022.

Q: All MSPV solicitations to date have had an NMR waiver in place. Would you please confirm a waiver is in place for this solicitation as well.

A: The NMR does not apply to this solicitation.

Q: Will you consider extending the due date?

A: The due date will not be extended.

Q: Are surgical/N95’s respirators needed? If so, what type of quantity on a quarterly or annual basis is typically needed or used?

A: Per the spreadsheet attachment entitled “Supply Solicitation Template_Open Market_v1.1”, Supplies available for quotation under this solicitation are provided in the “All Supplies” Tab of the spreadsheet. Only items listed on the sheet should be quoted under this solicitation. No other supplies are being considered at this time.

Q: Are earplugs/hearing protection needed? If so, what type of quantity on a quarterly or annual basis is typically needed or used?

A: Per the spreadsheet attachment entitled “Supply Solicitation Template_Open Market_v1.1”, Supplies available for quotation under this solicitation are provided in the “All Supplies” Tab of the spreadsheet. Only items listed on the sheet should be quoted under this solicitation. No other supplies are being considered at this time.

Q: Is this RFQ ONLY for Service-Disabled Veteran-Owned Small Businesses?

A: This procurement is set-aside according to the order of priority for contracting preferences as established in 38 U.S.C. § 8127 and includes a tiered evaluation approach.

Refer to page 35 of the solicitation for additional information.

Q: This solicitation is marked for only SDVOSB. Does that mean a large business cannot submit a bid? Can we have a SDVOSB submit our items on our behalf?

A: This procurement is set-aside according to the order of priority for contracting preferences as established in 38 U.S.C. § 8127 and includes a tiered evaluation approach. The government anticipates making several awards and all socio-economic levels against this solicitation. All socio-economic categories are encouraged to respond.

Refer to page 35 of the solicitation for additional information.

Q: We have (2) Bridge contracts that expire at the end of this month. I had been working with a POC with the VHA to have those items transitioned to another contract. Is that still happening?

A: Any items currently being directly negotiated with a supplier are outside the scope of this solicitation. The DAPA items on the attachment entitled “Supply Solicitation Template_Open Market_v1.1”, will be transitioned to MSPV BPAs with this solicitation. Other DAPA items will be solicited in the future through quarterly solicitations. Please reach out to your MSPV BPA Contracting Officer for questions regarding your specific BPA.

Q: It talks about Open Market items. Can those items be submitted for this solicitation?

A: Per the spreadsheet attachment entitled “Supply Solicitation Template_Open Market_v1.1”, Supplies available for quotation under this solicitation are provided in the “All Supplies” Tab of the spreadsheet. This is an open-market solicitation IAW FAR Part 13. Only items listed on the sheet should be quoted under this solicitation. No other supplies are being considered at this time.

Q: Would we be able to offer an alternate OEM within the same product?

A: No alternative items are being accepted at this time. Per the spreadsheet attachment entitled “Supply Solicitation Template_Open Market_v1.1”, Supplies available for quotation under this solicitation are provided in the “All Supplies” Tab of the spreadsheet. Only items listed on the sheet should be quoted under this solicitation. No other supplies are being considered at this time.

Q: Box 10 on the SF1449 is checked for SDVOSB. Is this set aside?

A: This is a tiered-evaluation, this procurement is set-aside according to the order of priority for contracting preferences as established in 38 U.S.C. § 8127 and includes a tiered evaluation approach.

Refer to page 35 of the solicitation for additional information.

Q: This is for the authorized prime vendors to respond to and not the manufacturers?

A: This is an open market solicitation. Any Original Equipment Manufacture (OEM) or authorized distributor with a current Authorized Distributor Letter (ADL) can respond to this solicitation.

Q: I was not able to find (specific product) under the “Quoted Supplies” Tab. We are currently a DAPA contract holder. should I complete the “Quoted Supplies” tab none-the-less; even though I am not finding us listed on the “All Supplies” tab?

A: The DAPA items on the attachment entitled “Supply Solicitation Template_Open Market_v1.1”, will be transitioned to MSPV BPAs with this solicitation. Other DAPA items will be solicited in the future through quarterly solicitations.

Q: One of our products is listed on this RFQ. We are a large business. Block 10 is marked for SDVOSB, however, is not marked as Set Aside. Are we able to quote this directly?

A: Large businesses may quote directly. This procurement is set-aside according to the order of priority for contracting preferences as established in 38 U.S.C. § 8127 and includes a tiered evaluation approach.

Refer to page 35 of the solicitation for additional information.

Q: I wanted to make sure I am reading/understanding this solicitation correctly; this means it is only for Service-Disabled Veteran-Owned Small Businesses, correct? Or, are these three, separate classifications, in which case, a small business (only) may participate?

A: This procurement is set-aside according to the order of priority for contracting preferences as established in 38 U.S.C. § 8127 and includes a tiered evaluation approach.

Refer to page 35 of the solicitation for additional information.

Q: We do plan to provide quotes for the line items listed for (Specific Company) in solicitation 36C24123Q0051 Supply Solicitation Template. We did want to confirm that if these items are accepted and awarded under this solicitation, will they be added to our current MSPV BPA?

A: Items awarded to current MSPV BPA holders will be added to the existing BPA via modification. A new BPA will not be awarded.

Q: We are a OEM. All of our existing MSPV items are currently on an IDIQ contract. Do we also need a BPA for items to be included in the MSPV program?

A: If the items are already on a VA Strategic Acquisition Center IDIQ for implantable items the IDIQ will take precedence, and the items will not be awarded on a BPA. Please submit the details to Maureen Long, Jeremy Parker, and Craig Hilliard for further action.

Q: Are we able to quote other products that fall under the categories listed in the supply category sheet? Is capital equipment also being requested? I read STERILIZERS and such.

Capital equipment is not requested.

Q: There’s already an issued BPA contract for (Specific Product Category) that does not end until January of 2026. Is this BPA replacing the current one or is this a new additional BPA for new potential contractors?

A: This RFQ contains items currently on VA DAPA vehicles. Items from this solicitation awarded to current MSPV BPA holders will be added to the existing BPA via modification. A new BPA will be awarded for any items awarded to vendors that do not hold a current MSPV BPA.

Q: Can only service disabled veteran companies bid on this contract or are Small Business eligible as well?

A: Companies from all socio-economic categories are encouraged to respond and will be evaluated. This procurement is set-aside according to the order of priority for contracting preferences as established in 38 U.S.C. § 8127 and includes a tiered evaluation approach.

Refer to page 35 of the solicitation for additional information.

Q: Can any VA in any region buy off of this contract?

A: Any VA Medical Center (VAMC) can order items from the MSPV Product List which includes all products currently covered under the MSPV Program.

Q: Is this BPA awarded to multiple vendors for each category or is it only awarded to the lowest priced bidder for each category or item?

A: Each item will be evaluated separately and awarded according to the terms of the solicitation, outlined on pages 35 and 36.

Q: Is this BPA for the MSPV going to be the only way VA’s can buy or are there other ways VA’s can still buy after this award? (I.E Credit Card Orders, GSA Contracts, etc) A: For Items that are available through the VA MSPV product list and in accordance with VHA Directive 1761, dated December 30, 2020, valid through recertification date of December 31, 2025, use of the MSPV Program is mandatory for all VAMCs.

Q: Do I need to submit a new solicitation even if our products are already on the BPA?

A: Per the spreadsheet attachment entitled “Supply Solicitation Template_Open Market_v1.1”, Supplies available for quotation under this solicitation are provided in the “All Supplies” Tab of the spreadsheet. Only items listed on the sheet should be quoted under this solicitation.

The items in the solicitation are not currently on BPAs. Please review the items listed on the spreadsheet to determine if you are interested in submitting a quote.

Q: If a company has an active MSPV Product List BPA in place, does the contract document need to be submitted? Can only the quote spreadsheet be submitted along with the MSPV Product List BPA number in the body of the email?

A: The current BPA contract document does not need to be submitted. You may note the MSPV Product List BPA number with your quote submission. Be sure to submit all required documentation IAW the solicitation instructions.

Q: Is there an error in the quote spreadsheet? When the quote spreadsheet was completed, the cell colors were all green but the error box still shows the number of errors equal to the number of items proposed.

A: Please fill in all required Information fields including Supplier Information and Additional Business Designation. If you are quoting an item, columns G-Q must be filled out. The fields in red represent an error.

Q: I am newer to the MSPV DAPA contracting process, could you please share your intention for this quotation and what you would be looking to accomplish? Specifically we noticed that the SDVOSB box was checked, but the 100% set aside box was left unchecked. Would this solicitation only be for SDVOSB’s?

A: This RFQ contains items currently on VA DAPA vehicles. These items will be awarded through MSPV BPAs.

This procurement is set-aside according to the order of priority for contracting preferences as established in 38 U.S.C. § 8127 and includes a tiered evaluation approach.

Refer to page 35 of the solicitation for additional information.

Q: None of our products are on this solicitation and we are a supplier not a distributor. Based on that I’m assuming we do not respond to this solicitation? Or are these sku’s from other suppliers/distributors that you are looking for substitute products?

A: Please review the items listed on the “Supply Solicitation Template_Open Market_v1.1” spreadsheet to determine if you are interested in submitting a quote. Only items listed on the “All Supplies” Tab of the spreadsheet should be quoted under this solicitation.

Q: I am confirming that RFQ 36C24123Q0051 only pertains to vendors holding a VA MSPV DAPA and would like to transition the DAPA to a MSPV BPA.

A: This is an open market solicitation. Any Original Equipment Manufacture (OEM) or authorized distributor of the requested products, with a current Authorized Distributor Letter (ADL), can respond to this solicitation.

Q: What is this solicitation for and how does it affect the DAPA contract that we have?

A: The current MSPV DAPAs expire November 30, 2022. This is an open market solicitation to establish MSPV BPAs to replace the items currently on VA DAPA vehicles. The DAPA items on the attachment entitled “Supply Solicitation Template_Open Market_v1.1”, will be transitioned to MSPV BPAs with this solicitation. Other DAPA items will be solicited in the future through quarterly solicitations.

Q: (Specific Vendor) is currently holding VA DAPA (X) and BPA (X). One of the items in the solicitation 36C24123Q0051, the manufacturer listed is not the correct manufacturer.

(Specific Vendor) appears to be the manufacturer for item (X). However, (Specific Vendor) is the manufacturer. My question is, since I am the manufacturer, I don't have to provide the Authorized Distributor Letter, correct? I still need to clarify the data, what would be the process? As the manufacturer, is there anything else I need to provide instead the Authorized Distributor Letter?

A: As the Original Equipment Manufacture (OEM), you may:

1) submit documentation stating your company is the sole source provider for the MSPV Program for any items quoted or

2) Provide a quote to compete with your authorized distributors who may be responding as well. Please provide any clarification data with your quotation.

Q: On solicitation 36C24123Q0051, Will all product offerings be considered or just the ones listed on the "ALL SUPPLIES" tab of the excel sheet titled" Supply Solicitation Template_Open Marketv1.1?

The reason I ask is because there is conflicting verbiage between the solicitation and the excel sheet.

Solicitation: In the Scope section, Page 5, section B.2 "...Offerors may propose supplies from their respective catalogs they wish to provide to the government that fit within the scope of the respective product category..."

Open Marketv1.1 excel sheet: "...ALL SUPPLIES - Supplies available for quotation under this solicitation are provided here. Only items listed on the sheet should be quoted under this solicitation. No other supplies are being considered at this time.

A: Thank you for pointing out the discrepancy. The language in the solicitation is incorrect. The language on the spreadsheet titled “Supply Solicitation Template_Open Market_v1.1” is correct as follows: Supplies available for quotation under this solicitation are provided here (All Supplies Tab). Only items listed on the sheet should be quoted under this solicitation. No other supplies are being considered at this time.

Q: Would I be able to quote these item but under a different OEM? We currently sell some of these products to the VA’s but a different manufacturer.

A: Only items listed on the sheet should be quoted under this solicitation. No other supplies are being considered at this time.

Q: In regards to the new solicitation 36C24123Q0051 and specifically the VAAR 852.219-78 VA NOTICE OF LIMITATIONS ON SUBCONTRACTING—CERTIFICATE OF COMPLIANCE FOR SUPPLIES AND PRODUCTS (SEP 2021) (DEVIATION) page 21. It is my understanding that the nonmanufacturer rule exemption applies only to small business set-asides beneath the simplified acquisition threshold. It does not apply to socioeconomic set-aside or sole-source contracts. Is there a waiver? How would I be able to certify?

A: The NMR does not apply to this solicitation.

Q: I want to make sure that (Specific Vendor) as the manufacturer does not need to work with a SDVOSB and have them submit a bid. That the items that are on our DAPA will transfer to a BPA. There are 6 items on this solicitation that are our products. We want to just make sure by not submitting a bid through a SDVOSB, we will still be on the MSPV on December 1?

A: This is an open market solicitation. Any Original Equipment Manufacture (OEM) or authorized distributor with a current Authorized Distributor Letter (ADL) can respond to this solicitation. OEMs have the right to chose if they want to work with authorized distributors or not. The VA is not mandating that OEMs use authorized distributors.

DAPA items will not automatically transfer to a MSPV BPA. Each item will be evaluated separately and awarded according to the terms of the solicitation, outlined on pages 35 and 36. Items from this solicitation awarded to current MSPV BPA holders will be added to the existing BPA via modification. A new BPA will be awarded for any items awarded to vendors that do not hold a current MSPV BPA.

Q: I see the bid is marked under SDVOSB and reading the solicitation it seems geared toward distributors. I would like to see if as a manufacturer we should respond.

This procurement is set-aside according to the order of priority for contracting preferences as established in 38 U.S.C. § 8127 and includes a tiered evaluation approach.

Refer to page 35 of the solicitation for additional information.

Q: Does this MSPV Open Market medical/surgical supplies BPA request for proposal supersede the current MSPV BPA agreements and Distribution and Pricing Agreements?

A: The pricing on DAPAs are effective until the agreement expires on November 30, 2022. The items under this solicitation will be added to the MSPV Program through BPAs. This solicitation will not affect items already on MSPV BPAs.

Q: What is the tentative effective date for these new BPA agreements?

A: The items under this solicitation will be awarded as soon as possible after evaluation outlined in the solicitation is complete.

Q: Will the existing MSPV BPA agreements and Distribution and Pricing Agreements be extended to coincide with the new BPA effective date?

A: The current MSPV DAPAs expire November 30, 2022 and will not be extended. Existing MSPV BPAs are not expiring.

Q: Manufacturers reserve the right to cancel or terminate a Letter of Supply (LOS) and limit reseller/distributor agreements to annual review. Will the government accept active manufacturer LOS with less than a year?

A. OEMs control their letters of supply. The government will accept letters of supply within the last year. Additionally, per the SOW they must have been signed within the last 90 days.

Q: Please confirm the VA desires all suppliers and manufacturers, large and small, to participate in the MSPV Open Market medical/surgical supplies BPA request for proposal?

A: Yes, all authorized distributors are encouraged to respond. This is an open market solicitation. Any Original Equipment Manufacture (OEM) or authorized distributor with a current Authorized Distributor Letter (ADL) can respond to this solicitation.

This procurement is set-aside according to the order of priority for contracting preferences as established in 38 U.S.C. § 8127 and includes a tiered evaluation approach.

Refer to page 35 of the solicitation for additional information.

Q: Request RFP submission extension to 10 November 2022 to allow 10-business days to complete all documentation requirements for the submission.

A: The solicitation closes 11:00AM EST on Monday, 11/7/2022.

Q: Solicitation 36C24123Q0051 seems to be marked with SDVOSB. If we are a manufacturer and are not a SDVOSB, should we receive a new form with this not checked, submit as is, or is this solicitation for SDVOSB only?

A: This is an open market solicitation. Any Original Equipment Manufacture (OEM) or authorized distributor with a current Authorized Distributor Letter (ADL) can respond to this solicitation.

This procurement is set-aside according to the order of priority for contracting preferences as established in 38 U.S.C. § 8127 and includes a tiered evaluation approach.

Refer to page 35 of the solicitation for additional information.

Q: We are a manufacturer so I would like to ensure that we should respond as this seems to be geared toward the MSPV?

A: This is an open market solicitation. Any Original Equipment Manufacture (OEM) or authorized distributor with a current Authorized Distributor Letter (ADL) can respond to this solicitation. OEMs have the right to chose if they want to work with authorized distributors or not. The VA is not mandating that OEMs use authorized distributors.

This procurement is set-aside according to the order of priority for contracting preferences as established in 38 U.S.C. § 8127 and includes a tiered evaluation approach.

Refer to page 35 of the solicitation for additional information.

Q: Are the products in the solicitation for direct to VA sales or OEM to MSPV then to VA sale?

A: Per the SOW I.A2., MSPV will utilize Prime Vendor (PV) contracts for distribution and supply management services. Facilities will order from the MSPV Product List, which will be formed by awarding Blanket Purchase Agreements (BPA) to Original Equipment Manufacturers (OEM), suppliers, and authorized resellers of medical/surgical supplies (referred to as “Authorized Suppliers” herein).

Q: If this is for the MSPV program, why would the manufacturer return the solicitation?

A: That is a decision for individual manufacturers to make. Any Original Equipment Manufacture (OEM) or authorized distributor with a current Authorized Distributor Letter (ADL) can respond to this solicitation.

Q: If a manufacturer has items on an FSS contract, are those the items that the MSPV should default to or is this solicitation going to act as the default?

A: The FSS Contracts and MSPV Program are separate and do not overlap or default to each other. In accordance with VHA Directive 1761, dated December 30, 2020, valid through recertification date of December 31, 2025, use of the MSPV Program is mandatory for all VAMCs.

Q: I only see a few of our items in the list, we sell other items through the MSPV program, should those be included or should we only quote what is in the “All Supplies” tab in the Supply Solicitation Template?

A: The current solicitation only includes high use items from the MSPV DAPAs, which the loss of these items would have a large impact to many VAMCs across the country. There will be additional opportunities in the future to add the remaining VA DAPA items that have spend to the MSPV BPAs. However, the current MSPV DAPAs expire November 30, 2022 so any items that are not awarded during this initial solicitation will be able to be purchase by the VA by use of purchase card or through a network contracting office.

Q. Are we to factor-in potential Prime Vendor fees when proposing the pricing in support of items under RFQ 36C24123Q0051?

A. No, there are currently no Prime Vendor distributions fees allowed on the MSPV program. If the new PV distribution contracts allow fees we will address with the BPA holders at that time.
