This amendment incorporates the following changes:

1. The Government has an overall need for 20 beds per day but will accept quotes for less than 20 beds noted in Performance Work Statement (PWS) paragraph 2.1.

2. The Government reserves the right to make multiple awards if the Contracting Officer's, in at their sole discretion, determines it is in the best interest of the Government.

3. FAR 52.212-2, Evaluation - Commercial Items, is replaced in entirety by the version included in this amendment.

4. Added VAAR clause 852.219-76, Subcontracting Plans Monitoring and Compliance.

5. The response due date is hereby extended to 8/10/2018.

52.212-2 EVALUATION—COMMERCIAL ITEMS (OCT 2014)

Submission of Quotes:

1. Quotes shall be received on or before the date and time specified in Block 8 of the SF 1449. Note: Offers received after the due date and time shall not be considered.

1. Offerors may submit their quotes electronically via email to Christopher Field, Contract Specialist, at christopher.field@va.gov.

1. Questions: Questions shall be submitted to the Contracting Officer in writing via e-mail. Oral questions are not acceptable due to the possibility of misunderstanding or misinterpretation. The cut-off date and time for receipt of questions three business days prior to the date and time specified in Block 8 of the SF 1449. Questions received after this date and time may not be answered. Questions will be answered in a formal amendment to the solicitation so all interested parties can see the answers.

1. Quote Format: The submission should be clearly indexed and logically assembled in order of the evaluation criteria below. All pages of the quote shall be appropriately numbered and identified by the complete company name, date and solicitation number in the header and/or footer.

1. Ensure your representations and certifications are complete in the System for Award Management (SAM)( https://www.sam.gov). Otherwise, you will need to fill out solicitation Clause 52.212-3 "Offeror Representation and Certifications -Commercial Items", and submit with the quote. Federal Acquisition Regulations require that federal contractors register in the SAM database at http://www.sam.gov and enter all mandatory information into the system. Award cannot be made until the contractor has registered. Offerors are encouraged to ensure that they are registered in SAM prior to submitting their quotation.

1. Offerors shall submit a signed Business Associate Agreement (BAA) with the quotes. See attachment 5.

1. Small Business Subcontracting Plans:

6. This Request for Quotes (RFQ) was not set aside under the provisions of FAR Part 19, Small Business Programs. In accordance with 15 USC 637(d)(4)(B), Small Business Subcontracting Plans are required for contracts which exceed $700,000--inclusive of base and option periods--unless the contracting officer determines in writing that subcontracting opportunities do not exist. Prior to submitting a quote, offerors should consider their overall business operations and determine if subcontracting opportunities exist. Commercial subcontracting plans allow for inclusion of indirect costs or those costs not directly associated with performance on the anticipated contract so ancillary support services such as snow plowing, yard and building maintenance, and food supply should be considered as potential subcontracting opportunities. Attachment 6 is an optional-use commercial subcontracting plan template for reference.

6. If offeror concludes no subcontracting opportunities exist, offeror should submit, with their quote, a statement describing their determination and a brief explanation of the business analysis supporting their conclusion. This is not an evaluation factor; the contracting officer will consider the successful offeror’s determination prior to contract award and make their own determination to include or exclude subcontracting requirements on the resulting contract. If subcontracting plan requirements remain in the resulting contract, the successful offeror will be required to negotiate an acceptable subcontracting plan in good faith after contract award.

Evaluation Process:

Award will be made on a best value basis, as determined to be the most beneficial to the Government. Please read each section below carefully for the submittals and information required as part of the evaluation. Failure to provide the requested information below shall be considered non-compliant and your quote could be removed from the evaluation process.

Quotes shall be evaluated under FAR Part 13.106-2(b) -- Evaluation of Quotations or Offers. Therefore, the Government will not determine a competitive range, conduct discussions with contractors, solicit final revised quotes, and use other techniques associated with FAR Part 15. Comparative evaluations of quotes will be conducted.

The Government has an overall requirement for up to 20 beds based on historical data. The Government expects that more than one contractor may be necessary to provide the required number of beds. The Government, at the contracting officer’s sole discretion, reserves the right to make multiple awards to obtain the required services. The Government will award one or more contracts resulting from this solicitation to the responsible offeror(s) whose quotes conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. Price (Follow these instructions):

0. Offerors shall submit one quote using the attached “RFQ Attachment 7 Vendor Pricing Quote Matrix” for the number of beds per day they are able to provide. An offeror, based on their capabilities, may submit price quotes for different numbers of beds if necessary. For example, a vendor may submit pricing for 5 beds per day available at one facility and additional pricing for 15 beds they have an additional suitable facility available. The resulting purchase order(s) will be issued not to exceed that estimated number of bed-days on the successful quotes and the contractor(s) shall invoice based on the actual number of rooms utilized. The PWS associated with each resulting purchase order will also be adjusted to reflect the bed-days awarded.

1. Past Performance:

1. Provide (3) references of work, similar in scope and size with the requirement detailed in the Performance Work Statement. References must include contact information, brief description of the work completed, and contract # (if relevant). Please utilize Attachment 3 – Past Performance Worksheet for your references and please submit as part of your quote submission. References may be checked by the Contracting Officer to ensure your company is capable of performing the Statement of Work. The Government also reserves the right to obtain information for use in the evaluation of past performance from any and all sources.

1. Site Inspection:

2. The apparent successful offeror(s) shall successfully pass a facility inspection by a VA inspection team prior to award if they have not passed such inspection in the past twelve months. This inspection shall be scheduled once the apparently successful offeror(s) are identified; the contracting officer will coordinate with the program manager to schedule the inspection with the apparent awardee(s). Failure to pass inspection or correct minor deficiencies noted during the inspection in a timely manner will result in the quote being eliminated from further consideration. See attached inspection checklist and performance work statement for more information.

1. Veterans Preference Factor (per 852.215-70): The Government will assign evaluation credit for an Offeror (prime contractor) which is a Service-Disabled Veteran-Owned (SDVOSB) or a Veteran-Owned Small Business (VOSB). Non-SDVOSB/VOSB Offerors proposing to use SDVOSBs or VOSBs as subcontractors will receive some consideration under this evaluation Factor.

3. For SDVOSBS/VOSBs: In order to receive credit under this Factor, an Offeror shall submit a statement of compliance that it qualifies as a SDVOSB or VOSB in accordance with VAAR 852.215-70, “Service-Disabled Veteran-Owned and Veteran-Owned Small Business Evaluation Factors”. Offerors are cautioned that they must be registered and verified in Vendor Information Pages (VIP) database (http://www.VetBiz.gov).

0. Verified SDVOSBs will receive a 10% price credit (e.g. if a SDVOSB submits an offer of $100.00, it will be evaluated as if it submitted an offer of $90.00).

0. Verified VOSBs will received a 5% price credit (e.g. if a VOSB submits an offer of $100.00, it will be evaluated as if it submitted an offer of $95.00).

3. For Non-SDVOSBs/VOSBs: To receive some consideration under this Factor, an Offeror must state in its proposal the names of SDVOSB(s) and/or VOSB(s) with whom it intends to subcontract, and provide a brief description and the approximate dollar values of the proposed subcontracts. Additionally, proposed SDVOSB/VOSB Subcontractors must be registered and verified in VIP database (http://www.VetBiz.gov) in order to receive some consideration under the Veteran’s Involvement Factor.

1. If a vendor submits a subcontracting plan where it will be using a SDVOSB, it will receive a 3.5% price credit (e.g. if this vendor submits an offer of $100.00, it will be evaluated as if it submitted an offer of $95.00).

1. If a vendor submits a subcontracting plan where it will be using a VOSB, it will receive a 2.5% price credit (e.g. if this vendor submits an offer of $100.00, it will be evaluated as if it submitted an offer of $97.50).

852.219-76 Subcontracting Plans Monitoring and Compliance.

As prescribed in 819.7203(c) insert the following clause:

SUBCONTRACTING PLANS MONITORING AND COMPLIANCE (JUL 2018)

(a) This solicitation includes FAR 52.219-9, Small Business Subcontracting Plan, and VAAR 852.219-9, VA Small Business Subcontracting Plan Minimum Requirement.

(b) Accordingly, any contract resulting from this solicitation will include these clauses, unless the contract is awarded to a small business concern. The Contractor is advised in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) to assist in assessing the Contractor's compliance with the plan, including reviewing the Contractor's accomplishments in achieving the subcontracting goals in the plan. To that end, the support contractor(s) may require access to the Contractor's business records or other proprietary data to review such business records regarding the Contractor's compliance with this requirement.

(c) All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor's business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.

(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor compliance with the subcontracting plan.
