About this file
This document is a justification for other than full and open competition for a federal contract opportunity for gate maintenance services at the Alabama Institute for the Deaf and Blind. The contract action will be modified on a sole source basis with the incumbent contractor, Total Automation Group, due to their experience maintaining the B&B ARMR manufactured gate products and Allen Bradley control system. Market research found only one contractor capable of meeting the requirement, as the gate equipment requires specialized certification and expertise that the incumbent possesses. The justification provides the solicitation number, a description of the gate maintenance services required, details of the market research conducted with no other viable alternatives identified, and the contracting agency as the Department of Veterans Affairs Strategic Acquisition Center Frederick.

JOFOC FOR AITC GATE MAINTENANCE
The proposed contract action will be synopsized in accordance with FAR 5.201(b)(1) and 5.203(a) with the Government’s intent to solicit and negotiate with only one source under the authority of FAR 6.302-1.
The Government plans to modify the existing contract as stated above. As required by FAR 6.305(a), VA shall the justification make publicly available within 14 days after modification award.
7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable:
No award shall be made until the Contracting Officer (CO) determines the price to the Government is fair and reasonable. This determination will be based on a comparison of current contract pricing in the market, the Independent Government Cost Estimate (IGCE), or other information made available consistent with FAR 13.106.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
A sources sought notice was posted to SAM.gov on August 4, 2023, for 12 days with a response date of August 16, 2023, at 10:00 ET, to identify contractors capable of meeting the requirement.
One contractor, Sanford Federal, Inc., a Service-Disabled Veteran Owned Small Business (SDVOSB), responded to the sources sought with a capability statement that included the company’s experience with the specific gate. The Contract Specialist (CS) requested the contractor to provide documentation demonstrating that the technicians are certified in B&B ARMR products and Allen Bradley controls.
However, no response received from the contractor.
A search of the Small Business Administration (SBA) VetCert database found no results using North American Industry Classification System (NAICS) code 561621 and the keywords “Gate Maintenance.”
A search for the keywords "Security Gate Maintenance" in the General Services Administration (GSA) eLibray yielded no results. The NAICS code 561621 - Security Systems Services (except Locksmiths) was also used to find a capable contractor, yielding one result; the NAICS codes 561621H - Harbor/Waterfront Security and Services and Professional Marine Security Services appeared as a result but were not applicable to Security Gate Maintenance.
The program office reviewed the websites of five (5) contractors listed below and inquired about the organization's ability to perform the job. The program office also inquired if their organization is a certified maintenance provider for B&B ARMR equipment and if it is an SDVOSB. However, no contractor responded to the inquiry.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
The FAR allows restrictive provisions or conditions to the extent necessary to satisfy the needs of the agency or as authorized by law (FAR 11.002(a)(1)(ii)). As such, the Government has discretion to reasonably restrict competition as long as that requirement is needed to meet the agency’s minimum need. Such was determined to be the case in this instance for the modification of AITC Gate Maintenance Services contract.
