*****BEGIN PERFORMANCE WORK STATEMENT*****
1.0 BACKGROUND
The Department of Veterans Affairs (VA) Law Enforcement Training Center (LETC) is a franchise fund site authorized pursuant to the Government Management Reform Act of 1994 (Public Law 103-356). The Act authorizes designated agencies to provide certain common administrative support services on a reimbursable basis both internally and to other government agencies. In 2006, permanent status was conferred upon the VA Franchise Fund under the “Military Quality of Life and Veterans Affairs Appropriations Act 2006”, Public Law 109-114. Consequently, the VA-LETC received no federally appropriated funding and is required to market VA-LETC services to customers.
The VA-LETC provides training for federal police officers working in health care or service-oriented environments.
The VA-LETC requires services to clean and mine the shooting ranges and dispose of hazardous waste generated from this service. The VA- LETC currently has two full time operational indoor firing ranges. Each range is exact in dimensions, number of shooting lanes and types of bullet traps installed.

Trained, on site personnel will run OSHA personal air samples on each job classification employee. The contractor shall also run an inside and outside area sample daily while performing the ranges maintenance requested. Final air clearances will be run on the last day of the job with a 24-hour turnaround time for results on air quality in the shooting range prior to re-occupancy. The samples will be run from 2-8 hours per day depending upon the daily activity. All final air clearance samples will be less than the action level of 30 gh/m3 (micrograms per cubic meter of air) in an 8-hour TWA (time weighted average) which is an employee’s average airborne exposure in any 8- hour work shift of a 40-hour work week which shall not be exceeded per OSHA 1910.1025 and 1926.62. Sampling methodology will be per American Industrial Hygiene Association (AIHA) recommendations using .8mm mixed cellulose sampling cassettes. All samples will be closed faced. Sampling pump flow rates shall be between 3 and 10 liters/minute and each sample shall encompass a minimum of 200 liters. Sampling pumps shall be calibrated immediately before and after samples drawn. The samples will be analyzed by an AIHA Accredited and OSHA approved laboratory using NIOSH method 7082 (atomic absorption) for lead content. Upon receipt of laboratory lead in air totals, the contractor shall calculate the 8-hour time weighted average for each sample and provide a written report of the finding to the LETC. The final report shall include original copies of laboratory certified data results. Sampling shall meet the OSHA 1910.1025 and 1926.62 requirements for shooter’s exposure monitoring of personnel for compliance purposes.
3.2.2.3 The contractor shall remover approximately 135 cubic feet or 5 cubic yard of granular rubber and projectiles per lane concentrating on target zones. The contractor will ensure that all rubber material has been removed from the bullet trap. The rubber material removed from the bullet trap will be recycled by special vacuums that will separate most of the spent lead projectiles from the rubber. The granular rubber will then be put back into the bullet trap during the recycle and leveled to the proper slope.
3.2.2.4 For services that require complete rubber replacement, all rubber will be removed from the bullet trap and properly packaged for disposal. The bullet trap will be refilled with new, unused rubber and leveled to the proper slope. The bullet trap is estimated to hold 51,000 lbs of granulated rubber. The granulated rubber will be provided by the VA LETC.
3.2.2.5 Wet method for lead dust control. The contractor will use an airless sprayer with amended water to mist the air during shoveling and recycling of the granular rubber. This task shall be performed after the regulated work area is established. During this task, lead exposure levels above the action level are expected and personal protective gear shall be worn.
3.2.2.6 Shoveling Rubber. The contractor shall remove the granular rubber and spent lead projectiles out of the bullet trap by hand using medium and small size shovels. The material shall be placed slowly on the floor and never thrown from the bullet trap onto the floor.

The following provisions are incorporated into 52.212-1 as an addendum to this solicitation:
G.3 EVALUATION AND AWARD
A. BASIS FOR AWARD
The Government intends to award a Single Contract to the responsible, lowest price, technically acceptable (LPTA) quoter that meets or exceeds the acceptability standards for all non‐cost factors. This requirement is 100% set-aside for Small Businesses (SBs)
For each proposal received, the Government will evaluate the following factors:
· Price Factor Factor 1: Price
· Non-Price Factor
· Factor 2: Technical Acceptability o Technical Capability o Past Performance
The process of selection will be the following: The Government will evaluate all price quotes first to determine completeness.
After determination of completeness with regard to Price, the Government will rank the quotes from lowest to highest price. Once the price quotes are ranked, the Government will evaluate the lowest price quoter’ s Technical Capability and Past Performance Volumes. If that quoter is determined to be Acceptable, the Government will select that quoter as the awardee. If the lowest price quoter is determined to be unacceptable, the Government will evaluate the next lowest price quoter and will continue this process until the LPTA quote from a responsible vendor is identified.
Quotes determined to be unrealistic in terms of Price or Acceptability may be rejected at any time during the evaluation process. Failure to meet a requirement may result in an offer being determined technically unacceptable.
The Government will review the required documents as outlined in the proposal volumes in F.1 Instructions to quoters. A proposal that is determined to be incomplete or fails to fully meet any material requirement may render a proposal unacceptable, thus ineligible for award.
The Government reserves the right to award with or without discussions based upon the initial evaluation of proposals. As such, quoters are encouraged to submit their best proposal upon initial

G7. EVALUATION APPROACH
The proposal is subject to evaluation by a team of Government personnel. The proposal will be evaluated strictly in accordance with its written content.
1. PRICE FACTOR
a. PRICE EVALUATION
Price will not be evaluated adjectivally or assigned a score. Price will be evaluated to determine whether it is fair and reasonable. For a price to be reasonable, it must represent a price to the Government that a prudent person would pay when consideration is given to prices in the market. The Government expects that price reasonableness will be established through adequate price competition, but it may also determine price reasonableness through price analysis techniques as described in FAR Subpart 13.106.
2. NON-PRICE FACTOR
a. TECHNICAL ACCEPTABILITY EVALUATION The Government will evaluate Technical Acceptability as follows:
The Technical Acceptability evaluation process will consider the extent to which the quote meets the specified requirements set forth in the solicitation. The Government will evaluate the vendors quotes based on their:
(1): Technical Capability: Quote must meet or exceed the acceptability standards for conformance to the requirements stated in the solicitation’s PWS.
(2): Past Performance: Past Performance will be evaluated based on the narrative and other Government sources for quality, timeliness, and relevance (i.e., experience in providing services similar in size, scope, and complexity as described in the PWS). The Government will make determination of relevance. For Past Performance to be found acceptable, all referenced Past Performance must be at least rated as Satisfactory to be considered acceptable.
The quoter’ s initial proposal shall contain the quoter ’s best terms from a price and technical standpoint.
The Government reserves the right to make no award as a result of this solicitation.
