This action is subject to the availability of funds as as prescribed in FAR 52.232-18, contained herein. In the event of a Continuing Resolution (CR), the contractor shall perform within the constraints of the CR. In the event of full funding for the Fiscal Year, the contract shall be in full force and effect as of 10/01/2020.

5. SUBMISSION OF OFFER:

a. Offerors shall complete Blocks 17, and 30 of SF 1449, the Contract Administration Data on Page 3, and the Price/Cost Schedule listed on page 6.

b. Offerors shall also complete and return all information designated in:

· 52.212-1, INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS, incorporated by reference;

· Instructions for Submission of Bid, pages 52 – 53;

· 52.212-3 Representations and Certifications on pages 56 – 73. (Representations and Certifications need not be completed if offeror completed them at the online site www.SAM.gov)

The information/documentation listed above in sections 5 a-b must be returned prior to the date and time specified in Block 8 of SF 1449 in order to be considered for award. Offers will only be received via email sent to gregory.stevens@va.gov The Simplified Acquisition Procedures of FAR Subpart 12.6 and 13.5 are being used to conduct this procurement.

c. By submission of an offer, the offeror acknowledges the requirement that they shall be registered in the System for Award Management (SAM). Offerors who are not registered in SAM should consider applying for registration immediately. Registration in SAM is a requirement to conduct business with the Federal Government. If the offeror is not registered in SAM at the due date and time for the submission of bids, the offeror will be removed from further consideration for award.

d. This procurement includes price evaluation preferences for Service Disabled, Veteran-Owned Small Businesses (see FAR 52.212-2 herein). In order to be considered for award, Offerors shall have a valid, current registration at the VA’s Vendor Information Pages (VIP) (https://www.vip.vetbiz.gov/) at the due date and time for the submission of bids. Offerors who are not VIP verified will not be eligible for price evaluation preferences.

e. Any resultant contract, if awarded to an SDVOSB or VOSB, will be subject to the Limitations on Subcontracting clause set forth in this solicitation. For the Government to determine the extent and viability of a contractor being able to comply with this clause, the Government will evaluate the degree to which a prospective offeror will utilize other than service-disabled veteran owned or veteran owned small business concerns in the performance of the contract. (see Instructions for Submission of Bid for further details)

PART I: GENERAL INFORMATION

A. INTRODUCTION

The Milwaukee VA Regional Office has a requirement for Annual Preventive Maintenance/Emergency Service and Other Unscheduled Repairs as needed for two (2) pieces of Pitney Bowes mailing equipment located at the Milwaukee Regional Office, 5400 W. National Avenue, Milwaukee, WI. 53214.

B. BACKGROUND

This is a Firm Fixed Price Services contract for a contractor to provide Annual Preventive Maintenance/Emergency Service and Other Unscheduled Repair services in accordance with the scope of work.

C. SCOPE OF WORK

The Milwaukee VA Regional Office is seeking a Maintenance Agreement to perform Annual Preventive Maintenance/Emergency Service and Other Unscheduled Maintenance as needed on the Pitney Bowes mailing equipment used in the Mail Room.

PART II: WORK REQUIREMENTS

A. TECHNICAL REQUIREMENTS

1. The contractor shall provide annual preventive maintenance/emergency service and other unscheduled repairs for two (2) Pitney Bowes machines located at the VA Regional Office – Milwaukee, mail room. The maintenance agreement shall include: On-site service calls for repairs, OEM replacement parts, labor, technical telephone support, training, replacement print head, loaner equipment, postage rates and software/firmware updates for the postage meter.

2. Calls for unscheduled maintenance made during regular operating hours shall be responded to the same day. If the call is made outside of normal operating hours, the contractor shall respond within 24 hours. Operating hours for the purpose of this request is Monday-Friday 8:00 am to 4:30 pm, local time.

3. For calls for maintenance in which the remedy is outside of what is covered by the maintenance agreement, the contractor shall provide a written estimate of cost to the Contracting Officer’s Representative (COR) or designee and the service request must be approved by the Contracting Officer or designee prior to the contractor providing service not covered in the maintenance agreement.

4. The COR will monitor the service.

5. The contractor is responsible for maintaining liability insurance for the duration of the contract and for following all pertinent federal security regulations regarding VA Information and Information System Security.

B. ADDITIONAL REQUIREMENTS

Deliverables

1. Invoice: The contractor shall prepare and submit to the Regional Office COR an original invoice within 14 working days of services rendered.

2. The contractor shall provide the service identified in this contract between the hours of 8:00am and 4:30pm Monday through Friday (Central Time), except Federal Holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings.

PART III: SUPPORTING INFORMATION

C. PLACE OF PERFORMANCE: VA Regional Office, 5400 W. National Ave, Milwaukee WI.

D. PERIOD OF PERFORMANCE: October 1, 2020 through September 30, 2021 plus four (4) twelve-month options exercisable at the sole discretion of the Government as outlined below:

Option Period 1: October 1, 2021 through September 30, 2022.

Option Period 2: October 1, 2022 through September 30, 2023.

Option Period 3: October 1, 2023 through September 30, 2024.

Option Period 4: October 1, 2024 through September 30, 2025.

E. GOVERNMENT FURNISHED PROPERTY: None

F. WARRANTY: Work performed by the contractor under this contract shall be warranted by the contractor at no additional cost to the Government to include reperformance for 12 months from the date of completion of the work and replacement of any parts repaired or replaced during the initial work.

G. CONTRACT CHANGES/MODIFICATIONS:

The Contracting Officer (CO) is the only person authorized to approve changes or modify any of the requirements under this project and not withstanding any provisions contained elsewhere in this solicitation/contract, said authority remains solely with the CO. In the event the contractor effects any such change at the direction of any person other than the CO, the change will be considered to have been made without authority, and no adjustment will be made in the contract price to cover any increase in cost incurred as a result thereof.

Contractual problems, of any nature, which might occur during the life of the contract must be handled in conformance with very specific public laws and regulations (e.g., Federal Acquisition Regulation), and must be referred to the CO for resolution. Only the CO is authorized to formally resolve such problems. Therefore, the user and the contractor are hereby directed to bring all such contractual problems to the immediate attention of the CO.

Any request for contract changes/modifications shall be submitted to the CO.

All correspondence concerning this contract, such as requests for information, explanation of terms, and contract interpretations, shall be submitted to the CO.

H. WORKING HOURS: Monday-Friday 8:00 am to 4:30 pm, local time.

C.1 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

C.2 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.

(d) Comptroller General Examination of Record. D.1 SERVICE CONTRACT ACT WAGE DETERMINATION, MILWAUKEE COUNTY, WI.

The McNamara-O'Hara Service Contract Act (SCA) applies to every contract entered into by the United States or the District of Columbia, the principal purpose of which is to furnish services to the United States through the use of service employees. The SCA requires contractors and subcontractors performing services on covered federal or District of Columbia contracts in excess of $2,500 to pay service employees in various classes no less than the monetary wage rates and to furnish fringe benefits found prevailing in the locality, or the rates (including prospective increases) contained in a predecessor contractor's collective bargaining agreement. Safety and health standards also apply to such contracts.
