A.1 52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Technical Approach Past Performance Price

Technical and past performance, when combined, are equal to Price..

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of Provision) Each vendor shall submit a proposal consisting of the following sections, in electronic format, to the contract specialist identified in the request for quotations (RFQ). Unless otherwise stated, pages shall be 8 ½ by 11 inches, with one (1) inch margins. Arial font no smaller than 11 pitch shall be used (except for tables or charts which may use 8 pitch). The footer of each page shall depict the RFQ number and page number(s). Vendors may use MS Word Office 365 (.docx) or Adobe Acrobat (.pdf) for text documents and MS Excel 365 for spreadsheets. Spreadsheets (e.g., for pricing information) shall be unlocked, such that formulas used, if any, may be clearly seen. There is no page count minimum. Quotes must be, within the page limits, sufficient to address the requirement and associated evaluation factors.

NOTE: All relevant information in the RFQ, (e.g., SF 1449 Page 1, Section 30a-30c, Sections B.1.1 a. and C.5 VAAR 852.219-75 VA NOTICE OF LIMITATIONS ON SUBCONTRACTING—CERTIFICATE OF COMPLIANCE FOR SERVICES AND CONSTRUCTION (JAN 2023) (DEVIATION)) and any other section requiring the vendors input, shall be completed in the submitted quote. Failure to complete required sections may render the quote ineligible or evaluation.

Quote Cover Page(s): The name of the requirement (RFQ title) and RFQ number shall be included, as shall the submitting vendor’s name, address and POC information (name, email, phone number). The vendors UEI and CAGE shall also be included on the cover page. The cover pate is limited to two (2) pages with the second page being an index of the quote content (e.g., volume number and number of pages, Names/designators for tables/charts and page number).

Technical Approach: The narrative of each vendor’s quote shall address each element of the Technical Approach Factor. Simply restating the element and indicating the intent to fulfill the requirement is insufficient and may be considered non-responsive. Content of the narrative could include, as an example (not to be construed as all-inclusive or mandatory) understanding of needed resources (e.g., trades or equipment), copies of or pertinent data (e.g., company name, policy numbers, term, etc.) associated with licenses or insurance, anticipated task schedule (duration rather than calendar dates). Quotes shall contain clear supporting rationale. The technical approach is limited to five (5) pages front and back or 10 pages total, exclusive of tables or charts for which there is no page count limit.

Past Performance: Vendors may submit data addressing up to three (3) examples of past performance conducting work the same as or similar to the requirement detailed in the RFQ SOW. Performance must have concluded not more than five (5) years from the quotation submission due date. Narratives for similar work shall clearly define the association. Vendors shall use the appropriate EVALUATION OF CONTRACTOR PERFORMANCE (Non-Government or COR/POC) template attached to this RFQ, to obtain information from prior customers. As one or all of the three samples, vendors may provide the contract numbers and periods of performance for records maintained within the Contractor Performance Assessment Reporting system (CPARS). Past performance page count is limited to three (3) pages front and back or six (6) pages total. Exception: CPARS reports page number quantity are unlimited, as there are few, if any, page number limitations definable by system users.

Price: Vendor’s shall complete Section B.2 Price/Cost Schedule and submit a copy of the entire (all pages) of the completed and signed RFQ as part of their quote. Vendors may, but are not required to, include, narrative pages or tables with details of how their price for CLIN 0001 of the RFQ was determined. Such pages shall be clearly identified as a Price Attachment. All MS Excel spreadsheets provided shall be unlocked, such that formulas used, if any, may be clearly seen. There is no page limitation for the price section.

Evaluation Criteria Factor #1 – Technical Approach Each vendor shall submit a technical approach narrative which demonstrates how the vendor intends to accomplish the requirements as stated in the Statement of Work and satisfies each element.

Element 1 – Understanding: Interpretation of scope.

Element 2 – Feasibility: Access to required resources and meet industry standards, teaming partners/subcontractors, subject-matter experts, consultants, and/or specialized trades.

Element 3 – Adequacy: The vendor (and/or its subcontractors or third parties) must be certified, bonded, and insured and is responsible for maintaining minimum liability insurance required by the state of Florida, for the duration of the contract. Proof of insurance to include expiration date, shall be provided.

Element 4 – Completeness: Vendors shall provide proof of certification as a contractor and/or project manager (for the Prime) authorized to work within the state of Florida. Vendors shall disclose any and all negative licensing information and any pending litigation involving any of the quoting firms that will be either Prime or Sub contractors on this project.

Rating Scheme - The technical approach factor will receive one of the ratings defined below. Ratings will be used to determine an overall rating for the technical approach factor. A rating of unacceptable for either standard will equate to an unacceptable rating for the project approach factor and the proposal will not be further evaluated.

Adjectival Rating Standards

Rating
Description
Acceptable
Quotation clearly meets the requirements of the solicitation.
Unacceptable
Quotation does not clearly meet the minimum requirements of the solicitation.

Evaluation Factor #2 - Past Performance (Similar projects).

Evaluation of past performance will consist of the Government reviewing one or more of the following:

1. The contracting officer’s knowledge of and previous experience with the supply or service being acquired;

2. Customer Evaluation of Contractor Past Performance surveys;

3. Data gleaned from the Contractor Performance Assessment Reporting System (CPARS) at https://www.cpars.gov; or

4. Any other reasonable basis.

For vendors without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the vendor may not be evaluated favorably or unfavorably on past performance. Therefore, the vendor shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “neutral.” If a rating of unacceptable for the past performance factor is assessed, the entire proposal will be determined unacceptable, and will not be further evaluated.

Past Performance Ratings

Rating
Description
Acceptable
The Government has a reasonable expectation that the vendor will successfully perform the required effort, or the vendor’s performance record is unknown.
Unacceptable
Based on the vendor’s performance record, the Government has no reasonable expectation that the vendor will be able to successfully perform the required effort
Neutral
Vendors without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the vendor may not be evaluated favorably or unfavorably on past performance.

Pricing Data: Vendor’s shall complete Section B.2 Price/Cost Schedule of the RFQ. Additional price information, is submitted, must reflect consistency with the price entered for CLIN 0001. Failure submit the completed RFQ document (SF 1449) will render the vendor ineligible for award.

Award will be made on the basis of the lowest evaluated price of quotations meeting or exceeding the acceptability standards for non-cost factors. The evaluation will be conducted by receiving all quotations submitted and reviewing the lowest price proposal to verify that that quotation meets all solicitation requirements to include the evaluation criteria. If that quotation does not meet the solicitation requirements, then the evaluation team will move on to reviewing the next lowest quotation and proceed in the same manner until a quotation meets all requirements.
