About this file
This document is a Limited Sources Justification (LSJ) for a sole source award to Johnson Controls, Inc. (JCI) under the GSA Multiple Award Schedule (MAS) contract GS-07F-225CA. The purpose is to obtain a fully functional and operational solution to update the Access Control System at the VA Hartford Regional Office to the JCI C-Cure 9000 Security System Platform, in order to align it with the system used at the co-located Newington VAMC.
The LSJ cites FAR 8.405-6(a)(1)(B) as the justification, stating that JCI's C-Cure 9000 system is unique and highly specialized, as it must be compatible with the existing system at the Newington VAMC. The contract will include one base year with four option years for continued maintenance and support. No competitive offers will be solicited, but responsible sources may submit capability statements for future procurements. The contract was awarded to JCI on 2024-09-25 under the cited GSA contract.

FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; The current historic P2K Access Control System is the older version of JCI Management System which will be updated with the unique JCI C-Cure 9000 Security System Platform. This new system will allow the VBA Newington Office to be aligned with the same Security System as the VA Hospitals Campus located in Connecticut.
FAR 8.405-6(a)(1)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures.
For Brand Name only:
FAR 8.405-6(b): Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.
(5) Describe Why You Determined the Order Represents the Best Value consistent with FAR 8.404(d):
This requirement involves the digital migration and upgrade of the existing PACS system to make it compatible with the PACS system of the Newington VAMC which the VBA Regional Office is co-located within. JCI has proven competent and capable of providing the required components, services, and licenses required for operation, and does not create additional risk of invalidating existing warranties and contracts for continued servicing of the VAMC PACS system. As such, the CO has determined that a sole source award to JCI represents the greatest overall benefit in response to this requirement.
(6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted.
Contracting Officer reviewed SBA VetCert as well as FSS Category 561621, and determined that while an expectation of competition from 2 or more SDVOSB and/or VOSBs was likely to be met, there was not a reasonable expectation that an award could be made at a fair and reasonable price that offered the best value to the government IAW 383 USC 8127(d)(1) due to the factors and conditions noted above in Sect. 5 of this document. Those same conditions would preclude a best value award to any Small Business covered under FAR 19, and as such support the pursuit of a sole-source award to Johnson Controls Inc.
(7) Any Other Facts Supporting the Justification:
This requirement involves the digital migration and upgrade of the existing PACS system to make it compatible with the PACS system of the Newington VAMC which the VBA Regional Office is located within. As such, the only source available to provide these services is Johnson Controls Inc, which installed and provided maintenance services to the Newington VAMC PACS system.
(8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made:
Future requirements for PACS requirements at this location should be coordinated with the co-located VHA component, and handled as a combined requirement in order to ensure competition is sought and received to the greatest extent possible.
(9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge.
Michael C. Burkhardt Supervisor, SSD
