NEC SV8500 to NEC SV9500 Upgrades Control Number TAC-19-53640
JUSTIFICATION
FOR AN EXCEPTION TO FAIR OPPORTUNITY
1 . Contracting Activity: Department of Veterans Affairs (VA) Office of Procurement, Acquisition, and Logistics Technology Acquisition Center 1701 Directors Blvd Austin, TX 78744
2. Description of Action: This proposed action is for the award of a brand name firm fixed-price delivery order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC) for NEC brand name Private Branch Exchange (PBX) systems with associated hardware components and software.
3. Description of the Supplies or Services: VA, Office of Information and Technology, Service Delivery and Engineering, Field Operations, supports telecommunications capabilities at VA Medical Center (VAMC). The SV8500 NEC Private Branch Exchanges (PBX) need to be upgraded to the SV9500 platform in order to ensure VAMC's telecommunication systems are working properly, get orginal equipment manufacturer (OEM) support, updates, software patches, security updates. This upgrade will keep the same NEC brand PBX systems, but will upgrade some of the CPU's, common control cards and other hardware components to work with the newer version of software. This will help provide security and uninterrupted support for telecommunications at VAMC and their sites, ensuring they can continue providing service to Veterans. The total estimated value of the proposed action is inclusive of optional quantities.
Also, there is an optional requirement for 28 additional NEC Sip Gateways, with 1 at each site.
4. Statutory Authority: Pursuant to Federal Acquisition Regulation (FAR) 16.505(a)(4), the following brand name requirement is being justified and approved as an exception to fair opportunity under the statutory authority of Section 41 U.S.C. 4106(c)(2) as implemented by FAR 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized".
5. Rationale Supporting Use of Authority Cited Above: Based on market research, as described in Section 8 of this justification, it was determined that limited competition is available for the required NEC brand name PBX system associated hardware and software. The facility will upgrade the SV8500 to the SV9500 PBX. The requested PBX systems with associated hardware and software are the only PBX systems available that are compatible with the current NEC infrastructure. There are no other parts that are currently compatible and interoperable with the existing VA NEC PBX systems other the NEC parts. Only NEC or an authorized reseller can provide the necessary products
