Purchase Request (PR) Number: To be cited on individual contract actions utilizing this Class Justification and Approval (J&A)
II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED
This Class Justification & Approval (J&A) authorizes the use of other than full and open competition procedures as prescribed by Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. This is an Air Force Sustainment Center (AFSC) Enterprise-Wide Class J&A, issued in support of requirements generated by the 448th Supply Chain Management Wing (SCMW), where Chromalloy has been identified as the sole source provider for procurement of performance based repair and overhaul or remanufacture of commercial and non-commercial items identified in Attachment A. The Attachment A provides detailed information applicable to all currently known National Stock Numbers (NSNs) and Part Numbers (P/Ns) applicable to this Class J&A. This Class J&A will not be used for any Bridge acquisitions. Individually issued Firm-Fixed- Price (FFP) contract actions including Requirements, Indefinite Delivery Indefinite Quantity (IDIQ) or Definitive Quantity, may be established utilizing this Class J&A. The maximum ceiling value of this Class J&A is $44,000,000.
The contemplated contract actions utilizing this Class J&A, which are identified as follow-on acquisitions on Attachment A, were previously performed by Chromalloy and its entities, to include, but not limited to, the following Commercial and Government Entity (CAGE) codes: 2D505, 2B972, and 0ALH8. Also, Chromalloy has previously provided the required supplies/services on sole-source contracts (see Attachment A for NSNs).
Specific funds/appropriations and contract type will be identified on each individual contract document utilizing this Class J&A.
This J&A will cover an aggregate of acquisitions over an eight-year period, awarded between November 2018 – November 2026 or until the dollar threshold of $44M is reached, whichever comes first. Upon J&A expiration (30 November 2026 or $44M) the J&A authority can no longer be utilized for any new requirements. If authority has been granted to utilize the Class J&A on an acquisition, prior to the expiration, then that authority remains in place at the dollar value and the period of performance originally approved. Further, after the J&A expiration, there may be no increase in quantity, no increase in dollar amount, and no NSNs added to Attachment A for any awarded contract using the authority of the Class J&A. To allow the maximum flexibility and efficiencies, this Class J&A will allow for AFSC Enterprise-wide use, but the overall administration and tracking for the Class J&A will remain under the 448th SCMW at Tinker Air Force Base.
Business Rules have been established for the use of this Class J&A and posted on the Class J&A Share Point Site and are required to be followed for actions utilizing this J&A.
In addition to the specific items identified in this J&A, an additional ceiling amount has been included in the J&A to allow for the addition of NSNs for overhaul, repair, or remanufacture of the items, where market research has shown the supplier, Chromalloy, to be the only responsible source and where no other supplier or services will satisfy agency requirements. This additional ceiling, referred to in this J&A as “potential adds” of repair, overhaul or remanufacture items, allows the J&A to remain flexible to new developing systems or changes to existing support structures not fully definite at this time. A process has been documented which will control the use of, additions to, and deletions from the Class J&A. The process is documented in the Business Rules, posted on the 429th Supply Chain Management Squadron (SCMS) J&A SharePoint site.
Any potential adds for repairs, overhaul or remanufacture will be incorporated as an amendment to this J&A Attachment A. Any J&A amendment will be processed through the Procuring Contracting Officer (PCO), and approved by the local AFSC Competition Advocate (CA). The CA will validate that the effort meets the sole source requirements established in this J&A prior to inclusion on Attachment A. The add process will take place when there is a new request that meets the Class J&A requirements. The Class J&A may only be used for any added item after approval by 429 SCMS GUMAB J&A review team at Tinker AFB, and the Class J&A Usage Form must still be used to obtain approval to use of the Class J&A for any added NSN. Any NSN will be removed from Attachment A due to competition or any other rationale that could be used in order to gain approval for a deleted NSN. Once deleted, the NSN will be removed from the Class J&A and not added again by the 429th SCMS until an updated 762 is provided and identifying only one approved source and an amendment to J&A Attachment A is processed.
All computations for best estimated quantities were calculated using requirements data (D200/Automated Budget Compilation System (ABCS)) for all part number variants for each specified NSN, backorders, user modifications and acquisition schedules, total future flying hours projected and historical repair data. The Business Rules establish a two-step process required to utilize the Class J&A. Step 1: Prior to solicitation the request for “Authorization to Use Class J&A” must be completed and approved.
Step 2: Prior to contract award, the PCO will annotate the Class J&A Usage Form with the final award value, and forward the Class J&A Usage Form to the 429 SCMS/GUMAB for overall tracking purposes. While scope determination is the Procuring Contracting Officer’s (PCO) decision, the use of this Class J&A authority will be limited to the award value of the individual contract action. Any overages will require coordination through the 429 SCMS/GUMAB prior to awarding an action.
Attachment A Includes the current NSN’s applicable to this Class J&A and other pertinent information including but not limited to Repair Method Codes (RMC)/Repair Method Suffix Codes (RMSC), previous contract number, type of award, and contract award date.
III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE
AGENCY’S NEEDS
This Class J&A will be used to support acquisitions using other than full and open competition to acquire repair, overhaul, or remanufacture of any NSNs in Attachment A where the supplier, Chromalloy is the only responsible source. These items will be utilized on various U.S. Air Force air and ground weapon systems and platforms. Each contemplated contract utilizing this J&A may also include line items in support of the effort e.g. Over and Above, Beyond Economical Repair, Item Unique Identification Description, Data, and will be identified on the individual contract action.
Each contract utilizing this Class J&A will identify the specific NSN, Period of Performance, Contract Line Item Number (CLIN), and type of appropriation and dollars for each CLIN on the resultant contract.
The dollar ceiling for this Class J&A is $44,000,000. This dollar amount is reflective of the projected eight-year requirement for the assets listed in Attachment A, the projected unit cost (with inflation) and a 10% variance factor to address such elements as unexpected variation in demand and/or price or ‘potential adds’ to this J&A.
Due to the circumstances described below in Sections V, IX and XI there are no immediate actions that could be taken to develop competition. Therefore, it is considered appropriate to seek approval for more than one fiscal year’s requirements. If other qualified or approved sources are identified, full and open competition will be considered and utilized to the maximum extent practicable after identification.
Type of appropriation: To be cited on individual contract action
IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION
10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2)(ii and/or iii)(B)
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE
QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE
USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF
AUTHORITY)
This Class J&A addresses 448 SCMW requirements and the circumstances surrounding and substantiating sole-source acquisition of the items identified in Attachment A. For these items, the only source that can satisfy the requirement at this time is Chromalloy.
Appendix A identifies Critical Application Items or Critical Safety Items, as defined by the Aviation Critical Safety Item Management Handbook, and if there are Qualification Requirements (QRs) prospective vendors must satisfy prior to being listed as an approved source. In certain situations where QRs apply, potential sources may be required to obtain necessary data independently. These items are highly specialized components of their respective military weapon systems.
Market Research and analysis revealed there exists four major factors that categorically limit the ability of the Government to obtain competition for the items identified in Attachment A in all instances, and any potential ‘adds’ which may in the future be incorporated into Attachment A. These factors are described herein and cover the following Repair Method Suffix Codes (RMSCs): B, C, D, K, M, N, P, Q, R,V, and Z.
All other RMSCs are not applicable to this Class J&A. Reference business rules supporting documents which provides definition of the Repair Method Code (RMC)/Repair Method Suffix (RMSC) Codes.
Factor 1 – Items for which the Government does not have adequate technical data (RMSCs B, D, Q, R, V and Z)
The current repair source, Chromalloy, is the only known source that possesses the requisite technical data to repair/overhaul/remanufacture the items specified in Attachment A. Additionally, Chromalloy is the only known source to possess unique sub-assemblies or piece parts, expertise, special tooling, special test equipment, and design engineering resources required to meet the Government’s requirement. Items subject to this Factor may or may not require special tooling and special test equipment. This tooling/test equipment should not be mistaken for the specialized and unique equipment described in Factor 4. Although the Government has unlimited use-rights to form, fit, and function (FFF) and Operation, Maintenance, Installation, and Training (OMIT) data, this information lacks sufficient detail to fully define the repair/overhaul/remanufacture requirement. The Government has queried all available sources of data to include, but not be limited to, the Joint Engineering Data Management Information and Control System (JEDMICS), the Military Engineering Data Asset Locator System (MEDALS), and the Enhanced Technical Information Management System (ETIMS); no data was found.
Factor 2 – Items for which the Government does not have adequate use-rights to available technical data (RMSC P)
The Government does not have Government-purpose or unlimited rights to the necessary technical data to acquire these supplies/services from an alternate source. The current repair source is the only known source that possesses the requisite use-rights to the required technical data. Chromalloy has previously provided the required supplies/services on sole-source contracts (see Attachment A).. Although the Government has unlimited use-rights to FFF and OMIT data, this information lacks sufficient detail to fully define the repair/overhaul/remanufacture requirement. The Government has queried all available sources of data to include, but not be limited to, JEDMICS, MEDALS, and ETIMS searching for appropriate use-rights information.
Items subject to this Factor may or may not require special tooling and special test equipment. This tooling/test equipment should not be mistaken for the specialized and unique equipment described in Factor 4.
Factor 3 – Items for which the Government has sufficient technical data but no additional sources have qualified (RMSC C)
The Government possesses sufficient technical data to establish QRs which a prospective source must satisfy to become an approved source. The establishment of QRs has been justified in writing as required by FAR 9.202(a) on a Justification for Qualification Requirements (JQR). The JQR is coordinated through Small Business and the Competition Advocate; it is approved by the Chief of Contracting Office. Items subject to this factor require engineering source approval by the design control authority in order to maintain the quality of the item. Prospective sources must be approved by the cognizant engineering authority through the Source Approval Request (SAR) process. Items subject to this factor are currently sole-source but have the greatest potential to become competitive assuming a prospective source can meet the defined requirements.
Factor 4 – Items requiring specialized and unique equipment (RMSCs K, M, and N) Items subject to this factor require either Class 1 castings or similar forging equipment, master or coordinated tooling, or ultra-precision test or inspection equipment. This unique equipment is only available to the current repair source. Suitable substitute equipment or facilities cannot be made available to or re-produced by alternate sources.
The equipment described within this Factor are not to be mistaken for more common, albeit special, tooling and test equipment that may be required for repair/overhaul/remanufacture of the items subject to the previous three Factors 1, 2 or 3.
The 448th SCMW believes that award of any items identified on Attachment A, to any other source than Chromalloy, would result in unacceptable delays in fulfilling the Air Force’s requirements thereby leaving the Air Force unable to meet critical mission requirements and hampering the Air Force’s ability to execute its global mission.
Accordingly, Chromalloy is the only firm capable of providing the repair/overhaul/remanufacture described in Section III above without the Air Force experiencing unacceptable delays due to parts shortages thus fulfilling mission requirements.
Additional information can be found in Section IX.
VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE
IAW FAR 5.201, all requirements utilizing this Class J&A must be synopsized and the Request for Proposals (RFP) for each individual acquisition utilizing this Class J&A must be posted to the FBO website. Market research for individual actions using this class J&A is required prior to using the Class J&A. If new sources become qualified, or a change in the marketplace leading to a competitive environment, full and open competition will be considered and utilized to the maximum extent practicable.
Pursuant to FAR 10, in support of market research to identify potential sources for the repair, overhaul, and remanufacture of the NSN listed in Attachment A, a Sources Sought Synopsis (SSS) was posted on 19 Jan 18 to the Federal Business Opportunities (FedBizOpps) website, www.FBO.gov. The SSS included Sources Sought Number:
Multi NSN-2_2840 and Multi NSN-3_2840_Turbine_Nozzle and was issued with a close and response date of 20 Feb 18. This SSS included all items on Attachment A including the NSN, P/N and Best Estimated Quantity (BEQ) for each item. In addition, the SSS separated the NSNs by the following categories: NSNs where the government has data and NSNs where the data is proprietary. The SSS was posted in FBO to provide the widest dissemination of information to the marketplace. At this time, Turbine Controls, Inc., and Green Dream International LLC have both showed interest in all NSNs on Attachment A and that begin with the NSNs in SSS Multi NSN-2_2840 and Multi NSN- 3_2840_Turbine_Nozzle. The interested vendors have not submitted (SAR) packages as stipulated in the established QRs for those items that require QRs and therefore are not approved sources for any of the current NSNs listed in Attachment A.
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND
REASONABLE
The Contracting Officer will ensure that all individual acquisitions utilizing this Class J&A will be negotiated at a fair and reasonable price to the Government. In accordance with Federal Acquisition Regulations (FAR) and supplements, the contractor may be required to provide certified cost or pricing data, and/or data other than certified cost or pricing data, to be used in supporting the Government’s evaluation of the proposed costs.
A detailed cost analysis and/or price analysis will be performed on any acquisition using this Class J&A. The Contracting Officer may request a technical evaluation from the Defense Contract Management Agency to aid in the evaluation of the contractor’s proposal if necessary or required. The Contracting Officer may seek audit assistance from the Defense Contract Audit Agency if necessary or required. The Contracting Officer will determine that the overall cost of any acquisition will be determined fair and reasonable to the Government in every acquisition using this J&A.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH
WAS NOT CONDUCTED
Market Research, IAW FAR Part 10, was conducted by a multi-functional team consisting of the J&A Specialists, a Market Research subject matter expert, Small Business representative, cognizant engineer, and Contracting Officer for each item on Attachment A. This research included inquiries into internet sites including Google, the Thomas Register, Haystack, Dynamic Small Business, Ability One, Aviation Parts, NSN Now and similar item manufacture’s websites beginning 2 Feb 18. This research was performed to identify alternate sources or alternate equipment that might fill the Government needs with only minor modifications, within either the commercial or noncommercial market. Current screening results are documented on the AFMC 762 Form, Contract Repair Screening Analysis Worksheets (CRSAWs), for all NSNs listed on Attachment A. The current AFMC 762 Form information was used extensively to determine the competitive environment for each NSN covered by the scope of this J&A.
These screening results were used to determine the capability of supporting the repair or remanufacture by verifying RMSC codes and verifying overhaul, repair or remanufacture capabilities of the relevant parts. Also, the Automated Budget Compilation System (ABCS) computation from Mar 2017 cycles were used based on eight year out requirements for estimated unit cost and required repair quantity. These screening results were relied on significantly to identify initial NSNs associated with this Class J&A.
Market research determined there are no other current vendors, other than Chromalloy, capable of conducting the repairs, overhaul or remanufacturing, within engineering established QRs. Additionally, individual market research will be conducted for new requirements utilizing Class J&A.
The Government has attempted to purchase any missing data from Chromalloy many times individually in the past on the items listed on Attachment A. Chromalloy has failed to respond to past inquiries, or has responded with a negative statement. On 19 Jan 18 a Rough Order of Magnitude Price request was submitted to Chromalloy to estimate the cost for the Government to purchase Technical Orders and / or drawings containing more detail than FFF or OMIT data currently in the Government’s possession. To date, Chromalloy has refused to respond to this request.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND
OPEN COMPETITION
Regarding Factors 1, 2, and 4 from section V, it is not possible to develop repair, overhaul, or remanufacture procedures, or the specialized and unique equipment described in Factor 4, without detailed production level technical data. This data is described in part in section V. Reverse engineering is an opportunity to develop some of the requisite detailed production level technical data, however completion of a reverse engineering program of this scope (e.g. highly specialized end-items found on major weapon systems) will take a minimum average of five years through the Consolidated Sustainment Activity Group (CSAG) Sustaining Engineering program. This timeframe includes the budget request period, purchase request processing, contract negotiation and award, period of performance qualification testing, and source qualification. A cost estimate to conduct reverse engineering for these NSNs has not been generated due to lack of historical project cost information for similar equipment and scope of qualification testing, which is required to ensure no change to the item’s approved technical baseline and airworthiness certification. Finally, reverse engineering is considered a high-risk endeavor for highly-specialized end-items requiring unique contractor skill sets and considerable government resources to provide items for inspection and destructive analysis.
Regarding Factor 3 from section V, the government has sufficient data to qualify additional sources, however there have been no Source Approval Request (SAR) packages submitted against the items with Qualification Requirement (QRs) listed in Attachment A. SAR processing time can vary from organization to organization, however on average the expected processing time is 6-12 months from receipt of the package. The variance in this process is due to different requirements including package contents, source demonstration (site-visit), and production evaluation/qualification. The organization responsible for establishing the QRs for a given item, will periodically synopsize the QR’s as required by FAR 9.204(a)(1).
