About this file

This is a State Corporation Commission (SCC) compliance requirement form for the Virginia state and local contract opportunity for Tree Trimming & Removal Services. The document outlines mandatory provisions that must be included in all written contracts issued by public bodies in Virginia, establishing requirements for business entities seeking to bid on or enter into contracts with the Commonwealth.

The form requires bidders to provide specific SCC registration information or documentation demonstrating their authorization to transact business in Virginia. Bidders must select one of four options: provide their SCC identification number if organized as a corporation, limited liability company, business trust, limited partnership, or registered limited liability partnership; confirm they are not a business entity requiring registration; certify they are an out-of-state entity without regular and continuous business presence in Virginia; or submit legal counsel's opinion explaining their Virginia contacts and why they do not constitute transacting business in the state. Bidders failing to provide the required information are ineligible for award unless granted a waiver by the Director of the Department of General Services or the chief executive of the local governing body. The form includes a provision allowing bidders with pending SCC applications to request a waiver for submission after the bid due date, subject to the Commonwealth's sole discretion. Any awarded contractor must maintain active SCC authorization or registration throughout the contract term, with violation of these requirements subjecting the contract to potential voidance by the public body.
