Statement of Work (SOW) National Oceanic and Atmospheric Administration (NOAA)

National Marine Fisheries Service (NMFS) Office of Law Enforcement, Southeast Division (SED)

SED Cold Storage and Transportation

SOW APPLIES TO BASE YEAR AND ALL OPTION YEARS

1. Background

The National Oceanic and Atmospheric Administration (NOAA), National Marine Fisheries Service (NMFS), Office of Law Enforcement (OLE), Southeast Division (SED) is seeking to acquire services in Florida and Georgia for cold storage, on-site processing, and transport of seized, perishable property in support of criminal and civil investigations conducted by the SED. The government requires a contractor to provide cold storage services to secure freshly caught seafood that has been seized as potential evidence and for additional sampling for alleged Seafood Import Monitoring Program (SIMP), Lacey Act, and other Federal and State regulatory violations.

The contractor must have the capability to secure, transport, load, unload, and palletize seized property. The OLE SED must have ample workspace at the facility in order to pull and replace palletized product and securely store property seized by the U.S. Government for a period of time, not to exceed the contract period of performance. This to-be seized property is perishable, and has not been forfeited. This means the government has the burden to preserve this property pending a final adjudication of the property.

The Base Period of Performance for this order is from 08/09/2022 to 08/08/2023.

2. Location & Size of the Facilities

2.1. The contractor shall provide cold storage facility services within designated southern U.S. coastline locations at seaports in Florida and Georgia. Specific locations and distances are listed below in Table 1.

2.2. Table 1 – Facility location and size requirements.

3. Task 1 – Facility Storage

3.1. The contractor shall provide a cold storage facility that is large enough to project having ample room for seizures needing to be secured in temperature controlled units with lead time possible within 6 hours. The Government will utilize the storage and space for larger seizures and combining smaller seizure lots.

3.2. The contractor shall provide facilities and operational space accessible to agents) during normal business hours to have evidence picked up and stored for inspections, examinations, sampling efforts, and legal proceedings.

3.2.1. Note: Larger detentions/seizures are generally generated from work in major container ports/airports, while the potential for smaller seizures originates from domestic fisheries. SED has enforcement officers dedicated to port-of-entry work monitoring international illegal, unreported, and unregulated fisheries activities. The port-of-entry work can lead to seizures of large quantities of seafood products requiring immediate cold storage.

3.3. The contractor shall provide facility services that are accessible 24/7, 365 days a year.

3.4. The contractor shall provide storage for perishable seized products at temperatures to prevent spoilage during long-term storage and while being processed, documented, sampled and inventoried.

4. Task 2 – On-Site Processing Work Space

PAGE 8 OF 36 1305M322QNFFK0049

4.1. The contractor shall provide a cold storage facility with ample refrigerated floor space to set up workstations where agents/officers and participating agencies can inventory, sample, and analyze the detained/seized product in a temperature controlled environment. Ample is defined as 170 square foot space to sample evidence. Note:

The inspection process is very important to successful litigation.

4.2. The contractor shall provide workspace that has adequate refrigerated work space for several enforcement personnel to conduct inspections of seized property to include offloading, documenting, sampling, and inspecting entire large refrigerated shipping containers (up to 40 foot).

4.3. The contractor shall provide a workspace/facility that has the ability to store palletized boxes of perishable products in secure designated areas for additional options that may extend the period of performance (the time necessary to effect the investigation and subsequent final disposition of the product) to ensure the seized property is not tampered with and chain of custody is maintained.

4.4. The contractor shall provide onsite processing personnel that have the ability to assist with and/or transport seized products from the storage location in the facility to a workspace within the facility.

4.5. The contractor shall provide a workspace/facility that allows access to seized products to SED and other enforcement personnel during regular business hours for inspections, sampling, and other legal proceedings.

4.6. The contractor shall be able to provide palletizing, sorting and packaging services to ensure seized products remain secure and properly packaged.

5. Task 3 – Transportation Capability

5.1. The contractor shall manage transportation and logistics which includes arranging refrigerated (“reefer”) transport of perishable products seized by SED.

5.2. If agents or enforcement officers get a tip or a random exam results in an evidence seizure, then the product must be moved quickly. The cold storage facility must have available temperature controlled trucks to move evidence when agents and/or enforcement officers are not able to do so themselves. Capabilities must allow flexibility and quick responses to support the law enforcement mission.

Transportation support required includes temperature controlled truck transportation, pickup from origin, and drop off at cold storage facility maintaining constant chain of supervision.

5.3. Once NOAA General Counsel authorizes destruction of evidence, the contractor shall assist as needed with transportation from the cold storage facility to the designated facility for destruction as specified by the government representative.

PAGE 9 OF 36 1305M322QNFFK0049

6. Task 4 – Security

6.1. The Contractor shall provide a facility in order to maintain physical security 24/7/365 to ensure proper care and chain of custody.

6.2. Security and product safeguarding processes are instrumental. Experience supporting Law Enforcement agencies with an understanding of chain of custody requirements is required.

6.3. On-line inventory access:

6.4. Online oversight of all evidence currently held in the warehouse allows SED to manage case evidence for disposal when cases have been finalized and the Department of Justice (DOJ) or NOAA General Counsel (GC)releases evidence for destruction. A demonstration of inventory control methods is requested during proposal review.

7. Task 5 - Special Requirements

7.1. Experience and Federal/State Relationships:

7.1.1. SED may take custody of a seizure, which is later determined better handled by the state. The reverse also occurs, where the state takes custody of a seizure, which is later determined to be best handled by the federal government. A cold storage facility having relationships with multiple federal agencies and state Fish and Wildlife will alleviate the need to move product from one facility to another.

7.1.2. Relationships with state Fish and Wildlife as well as other federal agencies will help to substantiate the cold storage facilities’ security/safeguarding capabilities when working with Law Enforcement.

7.2. The contractor shall be able to bill based on Lot number and/or SED Case number to help ensure accurate accounting of what is being stored, and other services provided for SED investigation.

7.3. The contractor shall be able to provide monthly reports of items stored and location within the facility if moved.

7.4. The contractor shall provide notification if seized items are moved to another location within the facility within 48 hours.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation.

As a minimum, offers must show—

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

PAGE 14 OF 36 1305M322QNFFK0049

(f) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)

(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and-

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.

Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(i) Availability of requirements documents cited in the solicitation.
