About this file
This document is a justification and approval for using other than full and open competition to award a contract. The Naval Surface Warfare Center Port Hueneme Division intends to award a single contract to API Technologies Inc. as a brand name requirement to procure 4 each of X4 frequency multipliers and 4 each of X6 frequency multipliers. These components are required to support equipment and have been tested by Raytheon to achieve comparable noise performance to the original equipment manufacturer's components. Qualifying other brands would require first article testing, non-recurring engineering costs, and delay the project at least one year. The total value of the contract is $476,984. Market research found no other suppliers for these components. The justification cites the statutory authority to use other than full and open competition when only one responsible source can meet the agency's requirements.

4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304(c)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency
Requirements. The particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular features, do not meet, or cannot be modified to meet, the agency’s needs.
5. Rationale Justifying Use of Cited Statutory Authority
Testing of API Technologies Corp. replacement multiplier X4 and X6 has been completed by
Raytheon. The determination is that the API X6 and X4 multipliers achieve noise performance comparable to the OEM TECHTROL CYCLONETICS, INC. (legacy) components. The API components are deemed acceptable.
Testing of API Multipliers G638744-1 and G638745-1 to determine performance to noise requirements specified for the as X-Band was performed
May 4-14, 2018 to determine suitability for use. In performance of this testing three frequency channels allocated to the , representing the lowest, highest and mid-band supporting , were evaluated. Baseline noise performance was established for the transmitter with legacy production multipliers manufactured by Techtrol Cyclonetics, Inc. (TCI), and compared to requirements.
The test setup used a Raytheon CNA-21a Carrier Noise Analyzer, a cavity tuned discriminator, whose output was provided to an Agilent E4440a Low Frequency Spectrum Analyzer (LFSA).
Modulating the detected carrier with a 22.377 kHz sinewave input to the CNA-21a allows display line for both FM (-50dBc) and AM (-60dBc) to be established. Detected noise is referenced to this line. This signal is switched out during noise evaluation and the input is terminated with a 50 ohm BNC load to minimize 60 Hz coherencies produced by the test equipment. The CNA-21 is also isolated operating only on battery power. The presence of 60
Hz coherencies displayed in the test results are from LFSA, since a DC Block was not inserted between the CNA-21a and the LFSA. All 60 Hz coherencies are demonstrated to be within acceptable levels.
Based on the performance results, and the consideration given to the issue of peak modulation discriminator adjustment affecting the results obtained in AM Noise for API X4 only testing, particularly when compared to AM Noise results obtained for API X6 only and API X6/X4 testing, the determination is that the API X6 and X4 multipliers achieve noise performance comparable to the TCI (legacy) components. The API components are deemed acceptable for use in the EFC P/N H311204-1 in place of the TCI components.
The technical data package specifically identifies the multipliers and the multipliers have been tested and verified to be compatible with equipment.
In order to use other brands, in place of the API Technology, the other brand multipliers would need to be tested for functionality and compatibility. Testing and qualifying other brand multipliers would require other vendors to manufacture multipliers that are form, fit and function and undergo first article testing to verify compatibility with equipment.
If we were to find another manufacturer we would have had to do First Article Testing (FAT) which would require Non-Recurring Engineering (NRE) and delay at least a year to complete the
FAT, Engineering Change Proposal (ECP) generation. Our installation schedule will be impacted for class vessels. Estimated cost for NRE and prototype for FAT .
The estimated cost for testing each multiplier is , which is based on previous testing conducted by Raytheon. Additionally, it would take one-year to test each multiplier for form fit or function.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
The X4 and X6 multiplier are not available in the Navy Supply System. After exhausting all
Navy Supply resources, quote was obtained from TRIMAN INDUSTRIES, INC. authorized distributor of API Technology Inc.
7. Determination of Fair and Reasonable Costs
The Contracting Officer shall determine that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For reasons set forth in Paragraph 5, NSWC PHD will continue to conduct market research as warranted to provide a broader vendor base as applicable for the types of supplies/services covered by this document. If another potential source emerges, NSWC PHD will assess whether competition for future requirements is feasible.
